I'm impressed you got a response that detailed. Two days in a row guys were getting kicked from the room when trying to take me private. SM referred me to the streaming issues page. As though I hadn't visited that already. :O
They were really specific when they repeated my name back to me. So like, if your performer name was JohnSmithXXX, you'd probably be okay if you were on other sites as JohnXXXSmith or SmithJohn or whatever. So you can get around the clause with a slightly different arrangement of your name. Much like registered businesses can have similar-but-not-identical names. (If anyone else gets any different answers from support or whatever, feel free to correct me!)

You guys, with the new rules on SM, are ass cheeks ok? Cuz I usually have a thong on and a pushup bra. I can change that if need be, I just don't want to get in trouble.
Also, if I may put my two cents in about the no topless thing, it'll be great and bring all of us money if everyone follows the rule and people actually get accounts suspended. But it's such a huge site and girls get away with so much that it may not be enforced as well as SM hopes it is. I really don't mind giving up 35% of a five dollar flash to spend more time in private or exclusive. Also, my regulars have stopped making fun of the new layout, so I guess I'm ok with it now lol.

Fraudulent activity* of any sort will not be tolerated – should your account receive any complaints, chargebacks , or reports for fraud, your account will be terminated on the first offense and payments will be withheld. Streamate Limited reserves the right to terminat e any account at any time for any reason if fraud is suspected.
*Fraudulent activity is defined as any activity on the site that results in complaints, chargebacks, or is deemed inappropriate by Streamate Limited Staff.
So they don't take chargebacks off our pay but close our accounts?

I'm sure they mean fraudulent as in 'didn't perform' or 'wasn't streaming live' or other cons. I'm sure they can and do check that out first. Every model is $$ to them, so why ban perfectly legitimate ones?

I'm not a lawyer or anything but I've been in this industry for over a decade. The part about being able to use you likeness, name, voice and "exploit" you is something that is in every single document that I've ever signed before doing a photo shoot or porn scene. Can't tell you how many magazines that I've been in where they've changed what I said in the interview or a website has used my images for advertising, etc. That is what that part is for in the contract. I think they are also putting a clause in there to cover their ass about trade marked names so someone couldn't come and sue them for using their name/pics for advertising if they have a TM. As for owning your content from other sites, it states in the section above that you can work for other sites and operate a personal website as long as you don't poach customers, etc. It says nothing about them owning the content, just what you upload to their site or the live shows you do on there.
Think about it..there's agreements for C4S and ELM, contracts that we have between ourselves and other companies and Streamate can't just swoop in and say to C4S " Guess what? We now own rights to your cam models clip stores." I think C4S would have them in court in a hot second. I could be totally off here but I just woke up to seeing all of this on here and on Twitter and after reading it a couple of times, this is my take on it.
I may have my lawyer look this over, let me know if anyone else already has so we can have this figured out.
The part about owning the rights to out names and trademarks being transferred was unnecessary. I have never seen anything like that in any other cam site contract nor was it in my original Streamate contract from 2011. Obviously they want to own the rights to things such as photos, videos, and our live stream so they can use it for promotion but trust me, the part about names, identities, and personalities was unnecessary.
Either way, I'm told that the wording has been changed to be more appropriate to what their purpose is. I haven't looked at it yet but I completely applaud them for listening to those of us that pointed it out and changing it. There were a lot of people upset for good reason. Streamate acknowledged that it was problematic or they wouldn't have changed it.

RE: Guys not being able to get into our shows
There are soooo many devices being used to access our stream that sometimes it's THEIR equipment.
I referred a friend to the site, he joined & uses his iPad to do shows with me. Half the time he'll take me Exclusive but his damned iPad boots him and I end up going back into Free Chat. If I didn't know him personally, I would have absolutely NO idea why he's constantly having issues getting in to spend with me =p Knowing there is an issue with this very popular device helps lower my stress level, 'cuz I just imagine it's their problem not me or Streamate's issue. (Getting upset doesn't serve me in any way)
So it's not always the site, or our stream.

And I know it's easy to look at something like this and be like "well it's always said that" or "it means this or that" or whatever else but in the world of contracts things need to be very clear and not open for interpretation. That's part of the point of contracts to begin with. So you can't look at what was there and be like oh it's always said that, no it has not always said that even if that's what we have always took it to be implied. Until it's said explicitly, it's not said no matter what we interpret it to mean.
So, clarifying and being very clear is good for all parties because it doesn't matter what we think it says, it matters what it actually says.

I'm pretty sure the license and certificates is a clause to encompass that you're responsible for your business records, if you have an LLC or something, etc..which is not required of course but they have to word everything a certain way to make it legally sound.

Rather, it's CYA, Cover Your Ass, for them.

They won't make us submit anything because a license is only required in certain areas. Definitely a cover your ass thing.
Kind of how MFC technically states no nudity in free chat.... It's so they can put all the blame on the models if need be and say, well we told them not to and they agreed not to and did it anyway so sorry models it's all your fault. ;)

Yeah now it basically says they can use your name/likeness for advertising etc. I think they just wanted a clause in there to protect them from someone with a trademark or otherwise trying to sue them for using their name to promo something. Glad they fixed it.

I have never offered nudity in free chat (not comfortable with it) and those tools have been nagging me ever since they allowed it. Why not just tip a performer that offers it? I will never understand their need to nag performers for anything when you can always find a performer willing to do your request. .
Me too! They are like but you have done porn..what's the big deal....The deal is that I prefer to get naked for you in a private/paid chat!

The problem with that reply is we are signing a contract that states no nudity in free chat period. A contract is a legal binding and that's just an e-mail. If they want to allow topless nudity they need to change the nudity rule in the contract.

my round trip time is good...i think that might be ping? my ping 21ms
and my bitrate is average?? what is bitrate? is that like computer speed? or internet speed?

I agree 100% and yesterday I brought it to their attention. I'd like to think they'll do something about it, since they seem to be re-writing other parts of Section H. Why not better define 'nude'? Grrrrr.......

licenses are needed in Vegas , shit like that. Few places have the law that you need a license to cam from home.
if walmart cashed before, they will continue to cash, the bank has not changed, the name has.
Walmart never cashed for me, check amount is questionable. Banks use to put a 3 day hold, I do direct deposit.
nothing has changed to make you guys go into a state of doomsday camming.
I swear on my daughters eyeballs, you guys are good to go. Trust me, SM is my home, SM is not going to fuck us unless we fuck them or they happen to go under for God only knows what reason. If they go under all of us then have something to worry about.

Also the only thing I worry about now is the chargeback deal like do they investigate it will they check our shows and such to see that it was not our fault?
If a guy or another model/troll wanted to be mean they could just say all kinds of things about us and report us left and right especially some of these asshole guys who get angry when theres no anal in pvt or whatever.

They specifically mean chargebacks in relation to fraudulent activity. They can check our feeds if there's a serious accusation.
Not just the occasional chargeback where a guy's upset that you didn't stand on your head and put your toes in your vag, or something.

Okay good cause I am sure some of these guys don't have money to cover their selves sometimes I feel better about that then I don 't ever want to leave sm lol .
Also I was wondering on the stream page where the topic is it usually lets us write in the box then press the blue set topic box which then turns grey well mine is straying grey and not letting me erase and re set the topic anyone else noticed this or what could be wrong?

Also two other things one is I re read the contract and I do not get how they can use our legal name how they want to but I may have read it wrong :
" Performer/Studio grants to Streamate, its related entities, successors and assigns the perpetual, irrevocable, fully paid, royalty-free, universal and unconditional right to use, portray, publish, copy, distribute, and display Performer/Studio’s identity, name, fictional names (if any), voice, signature, photograph, words, images, personality or other likeness, in whole or in part, for advertising, distribution, marketing, promotion, publicity, and sales purposes."
Also will they be sending something in the messages for us to sign or how will we "Acknowledge we read the new agreement?

This might be a daft question, but anyways. The videos I make for C4S have my twitter handle & email address at the end. If I send them to SM customers, do I need to edit that info out?

^^^^SM doesn't allow people to steal customers but since they allow you to send them videos for shows and such there's nothing they can really do about it. So, you SHOULD edit it out, but no one really does and they probably do it to gain a better following and more custom videos. Depends if you're a naughty girl or not, teehee.

Ping is tied to distance from server, so the best I can do is just over 200ms, as the signal has to make a round trip under the Pacific Ocean all the way from Asia. Having a ping as low as 21ms would be a dream come true.

if someone does a review of your videos, they do send in "customers" that are really support and find this, the account will face a suspension/termination
This is occasionally announced on streamate twitter feed
I would unwater mark with the clips for sale and only use your name, most ppl google your camname and find you other places

I would contact Liz and ask her. I have her message to me stating the logo and url are fine. If she gives you the ok, just save the e-mail.

I hope in time they allow us to have a store that sells more than video's or picture sets.
I'm wondering if they're not trying out the 'my video' feature because models have been redirecting traffic through video links. They obviously read this forum, I figure it was only a matter of time before they cracked down on that.

I haven't seen other models videos but one and it was as cool slideshow about her goldshows. I don't have time to watch videos but it was a wonderful selling idea, pictures into videos instead of a gallery they can easily copy and paste, this is why I only update profile picture.
I asked that and it sounds like they plan to allow us to sell the video's on there in time. It makes sense because giving away free video's doesn't bring the site much money, but having everyone sell them would be good revenue for everyone. I hope in time they allow us to have a store that sells more than video's or picture sets.
Since I have the free, I did ask the paid version as Jane suggest and I am told once again its in Beta, not yet offered, hasn't been tested enough.
It was confirmed as well there is no sign of free video going anywhere. Pay is something they are working on.

Can guys change their ratings after they leave? I only received one rating tonight and it was after a great show.. Was extremely confused to see a 2 star rating. Check it nearly two hours later and it is showing as a 5??
