^^^ I already told K to spread the word against Kellogg's cereal at work, and I called my family and told them not to eat any. I want resolution in this. I was even glaring at a box of Kashi this morning and couldn't bring myself to eat it. This sort of thing is terrifying.

There were probably rats in the factory and somehow the poison got into the machines. Yours can't be the ONLY box that was contaminated.

Yep, pulled our box out of our cupboard before we even opened it, called mom and lil sis and told them to throw theirs away.

Ofcourse they both said "But we never heard anything on the news! It'd be on the news by now! Or at least a recall!"

Which ofcourse made me want to launch into my "we are not sheep" speech, but instead I just begged them to promise they'd throw the cereal out.

i will say this though.... if you take that shit to court and they can PROVE it was in the cereal prior to you opening it...

K, this is scary. I went to my neighbors house, just a mintue ago. She was unloading groceries from WalMart, pulled a box of kellogs min wheats out of the bag...the kids 5 & 7 are standing there waiting to have a bowl of cereal for a snack!

Yes, ofcourse I told her... and told her to hang on to the box too, some place high and out of the way with a note on it to not eat it.

I would not eat ANY kellogs cereal right now..not just mini wheats...

I don't know how they make cereal or how the factories work, but until it's determined how poison got in the cereal..I would be scared of the entire kellogs factory.

I hope you feel better. I'm soo glad it didn't turn out worse, and that you'r alive and (semi) healthy.

so basically the guy from the poison center told me i would be better off "letting it go" because i will probably not win against walmart or keloggs. He said if anything they could drag it out for years(years of lawyer costs that i couldent afford)>:( it was just his "friendly advice"

Miss Marina- I mentioned your situation to a friend who is a attorney at a very prominent firm and he thinks you should DEFINITELY talk to a lawyer- not because you will necessarily win the case, but because big companies like Kellogg's and Wal-mart are likely to settle out of court in order to avoid bad publicity. Somebody screwed up if you have rat poison in your cereal and you got very sick. You are entitled to compensation. Also, it might cost them less to settle out of court than to fight it.

My friend is in a different area than you, but he could find someone through his firm that would be able to help you. PM me if you would like him to do that.

Good luck! This was one of the scariest things I've read on here in awhile. (Not necessarliy bc of the fact I literally finished a box of mini-wheats FROM WAL-MART purchased at the exact same time as yours.)

As a dancer, you have a much higher income threshold than the average american, so you should be able to get a sizeable chunk of $$$ for lost wages, as well as for pain/suffering. After all, cyanide kills. And it kills gruesomely. It can also cause permanent gastrointestinal damage, brain damage that can take years to diagnose, and all sorts of liver and kidney complications. Not to mention the emotional and mental distress of knowing you were poisoned by a box of cereal that is supposed to be safe... Who knows what kind of paranoid fears or eating disorders could be spawned by such an experience!

Get every penny you can.

This shit pisses me off. My aunt fell at Disney and broke her arm. She has a metal rod in her arm for life now.

Anyway, NO lawyer would take her case because they said that Disney would drag it out, and basically they can continue to pay while she would be piss broke in lawyer fees, etc. EXACT same thing you are saying.

Soooo, my aunt tried and tried and no one would take her case. Imagine that shit???

^ No offense, but I think someone tripping and falling in a huge busy theme park is very minor (even with broken arm) compared to a company putting rat poison in their food and trying to cover it up. Your aunt fell of her own accord (unless it was a huge wire sticking out in an obvious walking area) where tripping is very common... I don't think rat poison in your food is common at all.. or expected.

^^yeah. as someone else pointed out, that's a really different situation than a deadly poison ending up in someone's food. You can pretty much fall anywhere and break your arm. Doesn't mean you necessarily get to sue the place that you fell. I can see why no lawyer would want to take that case...it'd be difficult to prove that Disney was actually responsible for your aunt falling. If I were a lawyer I wouldn't take it either. And Disney probably would have won. Obviously I don't know the situation of how it happened though. Did she fall off a ride or something? That's a different story...

In addition, the lawyer taking that case would have recieved a lot of media and public backlash, as Americans are (rightly) getting sick of lawsuits that seem absurd.

I think the OP's situation is very different and she has a very valid case from what we know.

A lawyer should be able to take the case on contingency. Its not the same as pro-bono.

This has happened to me when I was vegan and went for hours without eating. I had an episode at a gym once and the manager came found me on the floor in the locker room. She had gone through this too. She said is was a combinaton of low blood sugar and a body that was too acid.

I would add to this theory and say I was gluten intolerant which made have an even more adverse reaction to other foods (including tree nuts and soy). Sometimes when you eat too much of something (or something everydya for a period of time), you build an INtolerance to it.

I haven't had an episode in a few years now that my diet changed.

I'm officially boycotting all kellogs products. what low standards..... how can I think anything else they make (like individually wrapped granola type bars) is safe?

I think this is one of those rare cases where restitution is DESERVED!!!!!!

I hope you get very rich off this. loosing $$ is the ONLY think that makes companys this large listen, it seems.

To sum it up-Went to court for this, got offered a small amount of cash(under 3 grand) my Lawyer said no, We ran out of time in the courthouse and had to reschedule. This is going to be a huge headache. I threatened going to the media a couple weeks ago. Thats the only thing that got them in court(of course)

Have you and your laywer decided how much money to ask for, or how much you deserve?

I assume the medical bills alone amount to more than $3000. Plus did you miss work? Do you keep records or work so you can show aaverages? That way you can say, Look, I had to miss 3 days of work, according to my records, I would have made at least $2000 in thoes 3 days. Plus the suffering and pain you went through, no idea how they decide how much cash that's worth...plus missing work to meet with laywers, and go to court. Off the top of my head...I'd at least want 10grand....but more than that...I'd want to know they found the source of the poison, and know what they are doing to make sure that it never, ever happens again.

Have a court date soon...Really all i wanted was the money for my medical bills(for this it was 5 grand since I have no insurance) I have other medical bills from other stuff only under 3 grand. All i asked for was the 5 grand for the bills FROM the cereal. My lawyer told me I could get more then that, etc. Im not exactly sure how I feel about it, I just honestly want my medical bills done with. I'd be happy with that. Does that make sense? I've had a couple drinks tonight and im sleepy lol...

She should hold all her cards close to her in my opinion. Even talking about it this much could ruin her case because it's already 'leaked' and there's no point getting a higher compensation.
