Indiana Workers Comp awarded to dancer!
The Indiana Court of Appeals awarded workers compensation to a dancer injured doing a pole dance at a SC! I am not a lawyer, but I did dance in Indy. At that time and on this board there has raged an argument over the question of a dancer's status - independent contractor or employee. In Indiana, the parties did not raise the IC v employee issue to the court of appeals. But, it is implicit in the opinion that dancers in Indiana are employees and entitled to workers compensation! The entire opinion is available at: http://www.in.gov/judiciary/opinions...0090706jgb.pdf
;D

Interesting. They must have realized that arguing over whether she was an IC or employee was not a battle they could win, so they skipped it.
Re: Indiana Workers Comp awarded to dancer!
A dangerous precedent for other Indiana dancers, to say the least.

I would say dangerous for the clubs. Why do you say it's dangerous for dancers?
Re: Indiana Workers Comp awarded to dancer!
dangers for dancers = paperwork
if you are an employee, you are then tracked paperwise. hirings/firings, taxes, and dealing with typical employee bullshit that must of us like to avoid-- like mandatory 20 or 40 hour weeks.
Re: Indiana Workers Comp awarded to dancer!
Dangerous to the dancers because being legally called an employee WILL ensure decreased earnings, more of the dance money going to the clubs and NOT the girls, more bullshit to put up with from clubs, and the tax issue...
State of CA situation is a perfect example.
