At what age can a child choose which parent they live with? It may vary by state, so this question is for Idaho...
in maryland there is no set age that i know of that a child can choose. in my family law class last year i learned that there is much more weight put on the child's decision the older they are. actually, maybe 16 is the age they can choose. you can prob google it and find some info.

actually, after googling and reading some stuff, im not sure that theres any court that will let the child choose and have that be the final decision. i think it's only a factor.
I don't know if there is a "set" age. The judge will consider the child's request regardless of age. When I was granted custody of my nephew and nieces, the judge in the case asked E where he wanted to live. He was a little guy then and the girls were a year. They also had a child advocate . I find a lot do take it into consideration, all of my friends have who've gone through custody proceeding have had the judge ask their child's opinions.
When I was younger I thought about living with my dad. Yea some idea that turned out to be. Anyways, I could decide at the age of 16 what parent I wanted to live with and if I wanted to be emancipated. The next would be considered by the courts if the parent I wanted to live with was fit to be a parent.

In PA it was 13. At age 13 a child could choose what parent to live with.
Before age 13...the judge will heavily weigh the chil'd wants, with what parent would be better. So the child always had a say, but at13 he got to choose.
Glam- I'm in Idaho= 12 years. My daughter just did this this last year... she told the judge who/what/where and it was granted. No problem.
A bit of background- my ex and I had split 50/50 custody. My daughter hated it. So we petitioned for a modification. We went three weeks after her 12th birthday, it was a piece of cake. I had no issues with my ex either.

But yes, 12 years. My daughter just went in and told the judge what and why she wanted to be with me full time instead of being split... it works much better now.... he still gets her for the every other weekend thing, and on odd years for holidays- that part really sucked though... last year she was with him and since we modified, she will spend this year also- but its fine since she's happier.
