Ok, so I gotta make a new thread because I'm excited!
My ticket says he gave it to me at 2:am but it was 3:am because of daylight savings time. I'm absolutely sure of this because I got home and was like Fuck, it's 3 am and I have to go to a baby shower in the morning... the ticket says 2, how do I prove it and void the ticket????
Re: Ok, so I gotta make a new thread because I'm excited!
Ok, so according to my google search (and I only looked at one site) time goes from 1:59 to 3 am during daylight savings time, and the ticket says 2 am! So, if 2 am doesn't exist on that day the ticket has to be wrong. Please tell me if I'm wrong, or if this could work.
Re: Ok, so I gotta make a new thread because I'm excited!
The ticket is defective on its face and would likely be thrown out without a verdict.
That doesn't keep the officer from issuing another ticket on the spot, with the correct time, unless the court in throwing it out does so declaring it to be dismissed with prejudice.
Which means it can not be resubmitted to the court for consideration.
Re: Ok, so I gotta make a new thread because I'm excited!
not to burst your bubble, but my name was misspelled on tickets, and my lawyer said that could void them. the judge said "everyone makes mistakes" or something with that general idea.
Re: Ok, so I gotta make a new thread because I'm excited!
My brother once had some sort o fserious ticket thrown out because the officer didn't put the first letter of his last name, but that was nearly 10 years ago, maybe they've changed that?
Re: Ok, so I gotta make a new thread because I'm excited!
Sorry to burst your bubble, but in general it needs to be a fatal mistake to get thrown out. A minor mistake will not invalidate the ticket. Like if he gets the color of the car wrong, the ticket is still valid. Getting the time a little wrong, especially with DST, won't invalidate the ticket.

Yeah,sorry..Ive had my name wrong, my address, the time, the DATE wrong....and these were the ones I LOST. It doesnt automatically mean its thrown out...in fact if thats your defense you will likely lose since they (like the one judge I was up against) said "if thats the only reason you have not to pay this, denied". Ugh.
Re: Ok, so I gotta make a new thread because I'm excited!
yeah again not to break your plate, but that wont help. sorry girl.
Re: Ok, so I gotta make a new thread because I'm excited!
It doesn't seem likely this is enough. If it was good reason, probably a lot more important offenses would be thrown out too because someone forgot to adjust their watch.
In any case, you definitely need a better defense then "But your honor, I was speeding at 3:00am, not 2:00am!"
Re: Ok, so I gotta make a new thread because I'm excited!
I fought a ticket once because my occupation was incorrectly listed; he never asked what I did, but I was in town working on a movie and I volunteered that info since I was on my way back from the set, and he wrote "actress" in the occupation spot (I HAAAAAAAAATE how every female that works in the industry must be an actress because obviously only men are smart enough to be crew). Someone told me that an error like that could get the ticket voided. They were wrong. Whether I was an actress or an art director, I was still speeding.
