Re: Can The Manager Do This?
Legally he can't but I'd like to see you fight it.
Re: Can The Manager Do This?
Yeah... I don't think she'll be able to do anything about it but it still upsets me. :(
Re: Can The Manager Do This?
Not cool...but she can't really fight it like Lysondra said. She should just go looking for another place to work. Some clubs can however ask you to sign a contract that you will not work at another place of employment in the same industry. I know a few around here. If you don't sign they won't hire you...simple as that.
Re: Can The Manager Do This?
I worked at a club where they would fine you if they found out you did a bachelor party. I agree that I don't think it's legal. The only thing to do would be to try and talk to him about getting her job back.
Re: Can The Manager Do This?
Does she have a contract with the club? Over in this thread, AkashaM posted the contract for one of the clubs:
Quote:
13. Artist shall, during the term of this contract, render the services provided in this contract exclusively for owner, and shall not during such time, make any public or private appearances in any way connected with the dancing or entertainment business or performing arts, or engage in any similar activity, either for compensation or without, unless having prior, express, written consent of owner.
Even if she doesn't have a contract, a business in the US can generally fire someone for any reason that's not protected under law (such as race, gender, etc). Guam may have some special employment laws. Hopefully someone will jump in that knows the situation over there.
Re: Can The Manager Do This?
The big question is whether she is a perm resident of Guam or is she there on a contract. If she is there on a contract, all contracts have a clause stating you can do no work outside of the club.

I'm not sure how aware people are of this but... Guam IS in the US.
Re: Can The Manager Do This?
Nah she was at another club on contract but she's not on contract at our club. And he didn't fire the girl who she did the bachelor party with, and she IS on contract.
Re: Can The Manager Do This?
Hhhhmmm...he could just be going on a bias, then, if he kept the contract girl. He does have the right to site that stupid little clause and fire her if he wants to. I would chalk it up to management just being assholes. It sucks but it happens out here, for sure. Hopefully, she can get work somewhere else in Tumon.
Just out of curiosity, how did the management find out at all? This just sucks all around. I'm sorry to here about it. I'm not going to try to guess who it is but I have an idea of what jerks would pull that kind of stunt.
Re: Can The Manager Do This?
If it's in the paperwork you signed when you agreed to be an indy contractor, they can. A lot of clubs do this.
Re: Can The Manager Do This?
I guess they both came in and they told one of the girls and the girl told him?
