Fired...!
So my manager just texted me and said he's incredibly sorry, but the owner told him he has to fire me.
I'm in fucking shock here. I've danced for two and a half years, and only at this club. I'm literally one of the top girls there--I've definitely consistently been a top seller, for a long time. I make the club a ton of money. I'm 100% clean, I've never done an extra in my life. I follow the rules. I'm there on time. I treat the staff well, and I tip well. I try like hell to stay out of the drama--which is admittedly not the easiest thing. I'm polite to the customers, and they love me.
I'm shaking. I don't know what to do. There's other clubs in the area, but the majority of them are fully nude and rather sketchy, and I'm not sure I'm comfortable with any of them. And I'm too upset to call and set up an audition right now, anyways.
The manager is begging me not to be mad at him, he has to do what the owner says. The owner is like this 70-year-old man that treats the club like his personal harem. He's gotten a good portion of the best-looking dancers to fuck him for cash over the years, and lots of those girls then end up looking for special treatment in the club. The owner doesn't run the place like a business at all. They got busted by the labor department about the house fee thing, and they were required to give us all the option of being put on the books. Within like two days of us being on the payroll, the owner started trying to make the DJ's and bouncers give him the tips we gave, so he could make up for house fee. He's been trying for months to implement the house fee thing again. He's running the place into the ground, and it has a ton of potential.
This thing has come completely out of left field. I'm so angry I'm seeing little red spots. And I'm definitely in shock. I cannot fucking BELIEVE this shit.

Were you given any reason?
If I were you I'd make a telephone call to the owner and record the conversation. Be upfront and ask why you are being let go.
During the conversation if anything questionable is said, take it to the labour board of your city/state.

The owner would never answer the phone at work. He makes the manager do all his dirty work.
The manager told me he doesn't know why the owner wants me gone. However, he did say that it had nothing to do with business, cause he knows I'm one of the top girls at the club. It's some personal reason. There might be some drama going on behind the scenes at the club that I'm unaware of--which is entirely possible, and I've been suspecting there's been some of that anyways. My name's been thrown around with some weird gossipy stuff about girls I barely even know. Or it could be because I won't fuck the owner, and never even pretended I would consider it. The owner causes more drama than any of the girls.

Perhaps the owner doesn't want clean girls, he wants a sleaze pit because he thinks he will earn a ton more. He obviously doesn't care about the girls at all. Or perhaps he just doesn't like you for whatever reason (probably) or a combo of things. I'm very sorry that happened, and I hope you can find something better. What is your nationality? Sometimes clubs just don't want any black/hispanic girls working there or they simply feel they have too many, so they end up getting fired for petty reasons or no reason at all. I'll keep my fingers crossed that the old prick dies soon.

if he is not firing you for business reasons then yea... i dont think thats legal. i would follow kylea's advice. they cant just terminate your job for no reason.

Obviously something fishy (that's putting it mildly) is up for you to get fired for no reason at all. The owner has got to be the most horrid evil strip club owner on the planet!
I know you're not in any condition to go out and look for work now ... and I don't know how far Buffalo is from you, but I met 2 cool dancers at my club this month that go to Buffalo just to work ... they told me the $$ is great and I should do a work trip when ever I have the chance. If you want info PM me and I'll give you the details.

A key question for you is this ... after the club's run-in with the NY State DOL, did you choose to be 'put on the payroll' as an employee dancer - receiving paychecks from the club with hourly base pay with estimated income taxes and Social Security taxes withheld ? If so, then you would have status to directly pursue a 'wrongful dismissal' claim with the DOL. If not, as an independent contractor you have little recourse available.
From the standpoint of any 'employer' ... and that includes a clubowner who must treat dancers as 'employees' due to a DOL ruling ... there are a lot of (new) costs to the club for every employee dancer carried on the books. These (new) costs include the employer's share of Social Security tax, insurance premiums to state unemployment and disability systems ( which are rising ), the employer's share of (new) national health care premiums or penalties etc. on top of the hourly base pay. Avoiding these (new) costs provides a strong incentive for 'employers' to get rid of as many employees as possible.
While your clubowner may be a major 'tool', the fact remains that when dancers must be treated as employees that the club winds up incurring much higher costs per dancer. Ultimately, for a club with employee dancers to remain in business, enough customer dollars must find their way into the club's pocket to cover these higher costs per dancer in addition to covering the cost of the club's mortgage / lease payment, property taxes, utility bills etc. A very famous employee dancer club, the Lusty Lady, has just announced that it is closing its doors forever because there simply isn't enough customer money to go around to allow the employee dancers to earn a reasonable average hourly pay rate ( I think it was down to $10 an hour ), to also allow the club to cover its operating expenses, and to also allow the club to cover the (rising) employee SSI, disability and unemployment insurance costs.
If your particular club has the ability to hire new independent contractor dancers as replacements for existing employee dancers, then it's pretty obvious what's taking place and why.

New York is what is known as an "employment at will" state. That means, absent a collective bargaining agreement or an unlawful purpose, an employer can terminate any employee at any time. Now, exercising the right does entitle you to unemployment insurance, if you are not an independent contractor. You have a couple of issues:
1. Employee or Independent Contractor;
2. collective bargaining agreement; or
3. unlawful purpose?
If you are covered by a CBA, the answer is obvious, and probably not applicable here. If not, then you really need to resolve the employee or IC issue. In New York, as most states, the presumption is employee, but that can be rebutted by the employer showing evidence that you were an IC. In New York, the rebuttal evidence has to be fairly strong now because of some tax crackdowns and because the state is looking for revenue wherever they can find it. However, you do have to do some work to prove up your claim for UI.
Another issue is getting your job back. Probably won't happen unless you can prove some unlawful purpose such as discrimination based on a recognized protection in the law. There is case law in NY that says an employer cannot fire someone because they are attempting to organize a union. (Union organizing being a recognized protection in the law.) You need to consult an employment lawyer to see if the facts of your particular dismissal fit.

How do you get fired in a text? Are you an IC? Talk to the owner. Don't take the managers word. This sounds like bullshit.
Also if you can't get in touch with the owner I'd call the state attorney general and see if they can do anything about it. If you are an IC they are a business and you are using their service.

You are lucky you don't live in Florida ....it's a right to work state. You can be fired for anything. I was fired because" I come and go as I want and I act like I own the place."
Um i worked there for 5 years and we are allowed to come and go as we please.

See, not knowing why you got fired is kind of par for the course for this club. Over a year ago, we lost our best DJ because the owner decided he didn't like him. The manager fought tooth and nail to keep him on for as long as possible, but in the end he had to fire him. We lost several bouncers because one of the girls the manager was fucking decided she didn't like them. As I said before, the owner doesn't treat the place like a business. He gets involved with all the drama in the club--starts a lot of it, in fact. He's extraordinarily spoiled and immature when it comes to dealing with his employees. I don't even think it would occur to him that there's anything wrong with the way he's handling the place.

Maybe it's for the best. I have been in a rut for a couple years and this has been a good thing for me. I 've always said I wanted to travel and with nothing here to stop me IM FUCKING OUT.

I'm just curious, how do you know how sketchy the other clubs are if you haven't worked at them? A new club is a wonderful oppertunity to build on your dancing experience. If your stuck on the old place, dance elsewear for 6 mo's, pick up some new ideas, then head back home and show off for an hour throwing a few hundred ones on the stage and get your old job back. It's really that easy. Go to a new club, make new clients, bring them back to old club. Standard reason to fire a girl thats comfortable.
