Ok...so I just happened to look at my bank statement online. Only to find that my account is wiped out. Why, you ask? Because someone got a hold of my "MasterMoney" card and decided to fucking go shopping!! Most of the charges made were to online merchants. What a pain in the ass!! I now have to go file a police report...and then contact all of the merchants and let them know that this happened. I don't have credit cards for a reason...cuz I don't want the debt, but grrrrrrrr...the moron tried to open their own Yahoo domain...and Yahoo said that they will not release the person's name or any other identifying information without a court order or search warrent. WTF?? Laws can sometimes be very annoying, you know??

Holy SHIT VG!!! Hopefully you can figure this out. This is so wrong and I hope they have to pay everything back.
My grandmother had her CC stolen from her HOUSE by the homemaker that was taking care of my great grandmother. The bitch charged my grandmothers account $700 worth of food and shit. When my grandmother complained and things got found out, they only made the woman PAY the $700 instead of doing something bigger. So hopefully you can get everything cleared up, AND have the person pay for everything, or they get arrested for fraud.

File a police report. I had all my credit cards stolen and my checkbook stolen when I lived in California-the girl got caught and served a year in jail.
Be glad you caught it early.. sometimes people don't.

Federal regulations state your fraud liability is $50 on credit cards but could be as high as $500 on debit cards. Credit card liability is capped by the Truth In Lending Act at $50. Regardless of the cap, you're in a dispute with the bank only about whether you owe the money. On the other hand, ATM debit card liability can go as high as $500, or even all the money in your checking account, under certain circumstances. You have to call the bank, which is NOT going to just automatically put the money back into your account.. they WILL investigate and get back to you, but the money's GONE until their investigation is finished. Usually takes about 30 days or so and they will replace your funds. It has happened to me.
ATM debit cards are regulated by the Electronic Funds Transfer Act (Federal Reserve Board Regulation E). Although many banks say your liability is limited to $50 with debit cards, you should ask to see their written policy. Some states, such as Massachusetts, may limit your liability to less than the Regulation E maximums. Ask your attorney general or state banking commissioner. (In late July-early August 1997, VISA and Mastercard banks announced that they would voluntarily limit liability to $50 or less, although some banks may not comply until 1 January 1998.)
Under federal ATM debit card law, Regulation E, you may be held liable for unauthorized transactions in 3 tiers:
I) $50 IF YOU NOTIFY THE BANK WITHIN 2 DAYS OF FINDING OUT YOUR CARD IS LOST OR STOLEN;
II) UP TO $500 IF YOU NOTIFY YOUR BANK AFTER 2 DAYS OF LEARNING OF THE LOSS OR THEFT;
III) POTENTIALLY, UNLIMITED LIABILITY FOR ALL UNAUTHORIZED TRANSACTIONS THAT OCCUR AFTER 60 DAYS FROM WHEN YOU RECEIVE YOUR STATEMENT CONTAINING THE UNAUTHORIZED TRANSACTIONS IF YOU FAIL TO NOTIFY YOUR BANK WITHIN 60 DAYS OF RECEIVING YOUR BANK STATEMENT.
Your liability for unauthorized transactions made before your statement is sent, and up to 60 days following, is based on the first two tiers of liability. If someone makes an unauthorized transaction on your account without actually obtaining your card, the first two tiers of liability do not apply, but you would be liable for all transactions that occur after the close of 60 days of receiving your statement and before you give notice to the bank. Even if the bank does not impose the maximum liability under the three-tiered structure, you can be without the use of your money for up to 10 days, and in some cases, up to 45 days while the bank investigates the reported unauthorized transaction. If the transaction resulted from a point-of-sale debit card transaction (at a merchant location), the time periods allowed for the bank to complete its investigation are doubled -- to 20 days which may be extended to 90 days.

Last summer someone went to the small town bank where I still have a savings account, and on multiple occasions withdrew sums of money that totaled $1300. One day it dawned on me that I hadn't gotten a bank statement from them in a while, so I used my ATM card to check my balance and sure enough, a big ol' chunk of money was missing. Some bitch had the balls to go to the bank, fill out a withdrawl slip and enter my account number and forge my name, and withdraw money on three separate occasions, and the idiot bank teller didn't ask for ID one time, even though on two of the days the person withdrew $500 and $700. At first the bank was like, Well, we will investigate and then when our investigation is over you will get your money back. Ummm, I don't THINK so!! I sent my parents in there and my money was put back in my account as soon as I went there to sign something saying I would help prosecute whoever stole from my account. At first they thought I did it...they tried checking their cameras to see who was in the bank on those days, but the times didn't match up. Yeah, like I would have known that. Anyway, it was the same teller every time, and the statements just stopped coming to my house, which leads me to believe it was an inside job. I haven't heard anything from the bank since about them prosecuting anyone, as long as I got my money back I guess I don't care, though I would have liked to find out who tried to fuck me over. Oh well.

Ok...went to the police department and filed a report. Already called the bank and told them about it. Seems that the thief is still attempting to run the credit card (ran it about 15 times this morning as of noon). I DID order one thing online (don't usually do that) from the Pole Tricks 101 website. Actually, that was the only online merchant I ever used my card at. Ordered that and 5 days later my card number is being used to order stuff online.
If they (the bank) contact all of these merchants and find out that the stuff was shipped to any other address besides the billing address then the merchant is at fault and will have to do a refund, or the bank will reverse the charges. I was also informed that I will not be liable for any charges that are incurred because of the fraudulent activities.

Oh damn.. That would completely piss me off too, Venus. I hope everything gets straightened out. What really irritates me about things like this, is that in most cases, they don't even give you the information you'll need to track the person down (like their IP Address). Sometimes the whole confidentiality policy screws the victim.

well at least you won't be liable for any charges because like you said if they ship anywhere else you're covered and if they ship to your house (which you know they won't) you can return it.
Reminds me of that commercial on tv...the big fat trucker and when he opens his mouth to talk it's a bubbly valley girl saying how she went shopping and bought some $X,XXX leather bustier "I just HAD to have it. It's not like I'M paying for it."
Theresa it probably was the teller. They refunded your money and end of story is their view. Hopefully she's not working at the bank anymore!

hi, yes somthing simalar happend to me, they hacked into my paypal account and used that to buy somting off of ebay. but he was a dumb ass and had it shipped to his house, i contected the women he got it from and she gave me the shipping info and i told her that it was not me and not to ship it. i found his number thre dir. ast. and called him and bitched him out hard core, he got another thing from ebay so i called the cops and they went over there and talked to him he has not done any thing sents, i have taken down my pay pal and ebay info now. i do not use my c.c online or post any info like that any where no matter how good the site may be. in the end i did get my money back.

My ex had several thousand dollars (plus $1900 to the negative) taken from his bank account, NOT credit card, bank account - while he was on a trip to Brazil 2 years ago. All within 2 days. He went to get cash from an ATM and couldn't get money. Called the bank to find out he was cleaned out plus $1900 (had overdraft protection). He had to jump through a whole bunch of hoops to get it all filed and investigated, and the bank had to research and verify everything. It took 4 months, but he eventually got his money back. Unfortunately at the time he was out of work (software developer between contracts, went to Brazil to spend the off time) and what they got from his bank account was all he had. Bad times indeed.
Turned out someone had used a swipe machine at a restaurant he'd gone to and used his card to pay the bill. Got the info from the magnetic code and used it to 'buy' all kinds of crap at dummy stores. Apparently they were just getting the money, not merchandise.
I'm sorry this happened to you VG, but take heart knowing you'll eventually get your money back. Have to keep at them though, and it will be a pain in the ass, but you'll get it back. Too bad there's no law to make the criminals pay you back for the time and hassles you have to spend getting the bastards to pay once they're caught, on top of just repaying what they stole! I HATE THIEVES!!! :beat:

Thanks everyone!! I have an update!
First, since I just used my card online to purchase a DVD not too long ago before the thefts...the thief either hacked into the company's database OR someone at that company is selling lists of credit cards. It seems that it is a lucrative business (and high paying) for some desperate person to print out all of the company's credit card customers and sell them to theives. Which, is usually, how people in different countries can obtain US cards. OR a worker at the company is charging stuff to the cards themselves. These kinds of people really piss me off sometimes...grrrrrrr...
One of the merchants emailed me all of the information...they were shipping stuff to my name to someplace in BRAZIL. They also gave me the IP address that was logged into the transaction. I will find out where the actual criminal is. The bad thing is, that if it's out of the country theft, there's nothing that can really be done about it. If it's in country, then I hope that they get prosecuted.
I was talking with the detective today and he said that sometimes theives are in the US, but have stuff sent to some place in another country (trying to slip through loop holes) and then have the stuff shipped to them in the US. However, since the purchase ORIGINATED in the US (hopefully the IP address is from the US...and they can get the person's information) then they would be subjected to US laws.
Well...I hope it doesn't take 4 months to get this resolved. *Bastard thieves*. Bridgette it sucks what happened to your friend. Glad everything worked out for him, though.

Most of this type of crime generates from people you know who have access to your info, ie family, roomates, lovers.....or people in the hospitality industry...its always a gamble...good luck!

Well, now that there is such a big trend on the online purchases, it is even easier to grab credit card numbers, exp. dates, etc and sell them. It's so much easier than standing over someone at the ATM machine...or purchasing a swiper. In fact, all you really need to do is buy a web domain (which this person attempted to do), build a website that sells something and allow someone to pay online via credit card...ask for all of the pertinent information...and viola!! You have a nice income...without ever having to sell anything. You could even contact the person and say that everything has been back ordered (such a popular product) and then charge the hell out of the card. I just happened to luck out and not wait for my statement (always listen to your intuition) before checking my account.
In the old days, it WAS usually someone you knew. Nowadays, however, it doesn't really matter. Along with all of the freedoms you get with the internet comes a lot of crime to go with it.
From now on, IF I purchase something from the internet, I am going to use the MasterCard Gift Card. You can get them from banks for no charge...put as much money as you need on there and then if someone gets your card number...well, then that's all they can get. It can be a little annoying, I guess...but no more so than being wiped out for all you have (I have several accounts that have most of my money, so the most I was inconvenienced was a fraction of what COULD have happened).
I actually had this happen once before (why don't I learn the first time around??) except I think that my card was taken by one of those "ATM" machines. As 2 days after I used it at one of the "private" machines, I got wiped out of about $3,000. I reported it to my bank, but they kept giving me the run around and I never recovered the money. I since left that bank and went to another bank. I now have 4 different accounts...only one of them could be accessed with the Money Card. I have a savings account (for reserves for bills, etc), a checking account to pay the bills, a checking account for just spending money (which I don't keep a lot of money in to begin with), and a money market account that I just keep adding money to. I'm glad I opened up several different accounts, now.
Well, I have to go down to the bank and give them all of the new information I got. Just found out, from a computer "geek" friend that the IP address originated in the US...so...bastards. :D

After reading this thread I went and purchased a paper shredder. All of my old bills will go through it. Credit card slips and receipts in the garbage are easy prey for identity theives.
