Ridiculous. What do they suggest that clubs play if not CDs or records? Gah. Do the same rules apply to a club that has only a jukebox? Or is that okay because someone's making money off of it? Blah.
ummm all the restaurants/ bars on the list are all not franchises. Why don't they go after every Red Lobester, Hooters, etc. in the country that is playing music vs. going after the little guy.

You'd be utterly stunned at all the things that require an ASCAP/BMI license. Even that Muzak crap you hear in elevators, grocery stores, and while you're on hold on the phone requires licensing.Quote:

Music should not be "free for the taking" - and yes, the same rules apply to any playing of the music (kenney rogers got busted $15,000 one night for "covering" another artist's song without permission). What's really sad is it is SO EASY for the club to be legal....pay the ASCAP fee directly, or buy CDs created specifically for DJs (with the ASCAP fee built in...by the way, AsCAP/BMI is the same contract)
Just as lap dances shouldn't be free, and people shouldn't be allowed to sell (or use for profit or trade) your picture without your permission (and getting$$ whereappropriate) nor should anyone be able to steal creative property.
That having been said, the record industry really screwed up in this whole download thing...add a couplepennies to every song and be done with it.

I've been working on a video for my grandfathers bomb group from WWII. Our goal is to have it aired on Discovery or the Military channel. So we are checking into every little thing.
And wouldn't ya know it......the music thing came up. I can not use the music that I had selected because of copyright laws. What chaps my ass more.....is that I am working for Non Profit, and I STILL cant get permission to use the music.
Samart...who has done the asking for you? If it's someone that knows the ropes, they can probably get you a knock off song (that sounds basically the same but is legal) or they can convince the artist to do it for a donation or delayed payment (due when Discovery buys the show, and assuming it's really for a nonprofit). Possibly Discovery's ASCAP fees will even cover you...depending on the specifics.

Since anything you create should be put "out there" for general use, where exactly does the line get drawn? Is it just things you want that should be "out there" and not things you make a living from?
Assuming your want to "score" the video in some form, individual songs may be a poor option, not the least because of the clearance issues. You need "clearance" to use music with three sets of rights: 1) mechanical rights, i.e. copying the music in some tangible form (CD, DVD, etc.) 2) synchronization rights (using the music with images), and 3) broadcast rights (TV).Quote:
