Nothing exempts them. They're subject to that. I think that when the ordinance went into effect in 1998 it turned out that Flashdancers was JUST more than 500 ft. from the nearest apartment. I can't remember which club it was, but some other club that thought it was in a proper location turned out to be improperly located because it was JUST less than 500 ft. from the nearest church.

Just picking up on what Melonie said in her long post above, remember that this ordinance was initially passed in 1995.* Ten years later, the "60/40" loophole (which by all competent testimony the City never intended to apply to strip clubs in the first place**) is STILL keeping strip clubs open in non-adult zones. Ten years (and counting) in an "illegal" location is a pretty good run, don't you think?

yes it is a VERY good run ... however the end of the run may only be a few weeks away. On the other hand, this could very well percolate in the courts for 10 more years ! However, Mayor Bloomberg has the 2012 olympic committee and a few billion dollars worth of potential olympics business at stake, I suspect that the City of New York will spare no expense and bring all possible political pressure to bear in order to get this matter resolved one way or the other in quick order.

OMG you're right! I never noticed that until now but like, the whol upstairs of my club is completely empty except for the dressing room, office and bathroom, but there are like, 5 more rooms of nothing.
