Website copyright, what's okay?
Recently I found a yahoo auction seller who was using my ebay pics and copying my description text word for word. I reported them, and am waiting for a response from yahoo.
All my merchandise pics, a store graphics, and text are my creations so I assume that others aren't supposed to use them. I wouldn't seek damages, but would expect the right to force other sellers to take them down. Is this correct?
But this got me thinking, sometimes I use celeb photos from gossip magazines and internet sites that I didn't take myself. Can I get in trouble for doing this? What's the worst that could happen? How do I tell if an image is okay for use?

there is a doctrine called 'fair use', which more or less allows others to use material as long as is not being used for direct profit. It sounds like your e-bay situation clearly violates the 'fair use' doctrine, and e-bay will probably agree to rectify your copyright complaint.

^I think your safest bet is to NOT use other people's pics.
As for the other seller copying your stuff, I would assume a site like yahoo would enforce copyright infringement. If nothing happens soon, report again and again until you get some action.

Read above. It depends on what you are using them for. If you are using them to put in picture frames and hang in your living room. No. If you are using them on a web site that generates profit in some capacity, then yes, you are in violation of the photographer and/or magazine's copyright.

what about recordings of shows being posted on porn sites without our permission? This literally JUST happened to me...or well...I just found out about it. Can I do anything to get these taken down or is it "fair use" :/

Send them a DCMA notice stating you are the owner artist creator of the material.

There are tons of pics that you can use :) Google copyright/loyalty free images and plenty will pop up. You just have to make sure you double check that they are for sure just that. Some sites will pop up, but they are pulling the images from other sites and are a bit questionable.
