He was insured... but I have a $600 pay out of all repairs... the repairs are $2000... I'm paying $600. :/
And AUGH I bought it THIS MORNING at 10am! It wasn't even 8pm when it was hit! :(

I am so sorry. This happened to my mom once... except MUCH worse... She had just bought a new Aerostar 1 hr before, and some asshole rear-ended us doing 30... (myself and my little sister were with her) at a red light, pushing us into the 2 cars in front of us....
4 car accident, broken glass from blown out back window, airbag went off, mom had a broken nose, I had major whiplash for weeks, sister had big bruise on head, Fire dept. had to come and pry our door loose, cuts everywhere from glass. Car was totalled. Family hasn't gotten another SUV/Minivan since, nor will they. Funniest part? Mom's broken nose afforded her 2 black eyes, and my father was suspiciously away for 2 weeks playing a concert...

Why do you have a deductible if it's his insurance? That should be his deductible, not yours.
We were both insured and the deductible is coming from my insurance and his deductible is coming from his. His is a write-off I think, though.
Also, that's what the cop at the scene told me... so I could be wrong. I'm still shaken up.

maybe aussie law is different, that's what i figured before but i would think his insurance (since he's at fault) should pay for your deductible too. his deductible is his problem but any out-of-pocket expenses you incur out of this should be his (insurance's) responsibility.
but that's in a perfectly rational and justice-prevailing world though. we, on the other hand, live on earth. *head-smack*

So sorry to hear about this glad you are okay . I am so careful now from my own experience I drive slower and wait a little longer at the intersections . People just don't realize what damage they can do to others by a stupid decision . So you gain three seconds bfd ! Glad your ok ;)

yes, its definately his insurance that pays, regardless if you have a deductible or not. the deductable is if YOU hit somebody else, you have to pay that amount to fix their car. depending on the type of insurance you have, liability vs collision. with collision you have a deductable to fix their car and your car in the case that YOU cause an accident.
however, because it was HIS fault, you have no expenses, and in fact should keep records of any expenses that you do incur because of the accident (added transportation costs to rent car/take a bus/etc, lost wages bc of inability to get to work, medical bills for check ups and medications, even reciepts for over the counter pain meds for any muscle aches caused by the accident.) as his insurance is supposed to cover them. if you have any problems getting his insurance to pay, first talk to your insurance and see if they will help you out or have any suggestions, then go to your local insurance commmision or whatever it may be called in your area (whatever commitee type group that governs insurance companies and makes sure theyre doing their job) and ask them for advise, as a very last resort get a lawyer. but hopefully it wont come to that. most lawyers in the car accident field are going to screw you over majorly rather that actually get your car fixed or your bills paid.
i completely understand how you feel. every time i buy a new car it gets wrecked, not the same day, but shortly thereafter! i had a bright fucking red toyota when i was 18, i'd parked it in front of my friends house and as i was sitting on the porch we watched his neighbor back into it from down the street. i'd had that car for 10 days.
the next car i got was a bmw a few years ago, i had it for 2 months when some idiot decided that he was just too damn good to stop at the red light that everybody else was already stopped at, thus rear ending me at 45 miles an hour. o hot shit damn was i pissed!

All that I really really care about it that my car is repairable. I think third party insurance in Australia covers both parties but they have to cover some damage themselves... I'm not entirely sure. I'm kinda willing right now to pay the full $2k in repairs just so insurance doesn't know about it and I can cry alone.
I'm really...really...really depressed right now.
And not in a good way.
I feel like a complete fuck-up who can't have anything (except my career) go right. I will fuck up EVERYTHING, but somehow my career will end up intact...wtf...
