    wow, too bad he doesn't apply that passion and tenaciousness to a more worthy cause. The article said he lost 4 previous similar lawsuits. I like how the bars are planning to circumvent the ruling though, "it's likely many bar owners will now promote more 'gender-neutral' events, like Lipstick Night or Skirt Night."

    I'm all for ending the discrimination, though I fully know why it happens. Guys do follow the girls.

    You know, it seems dumb - but it's true. I don't think you can say cheap drinks serve an ameliorative purpose in society. And seriously - it would seem pretty off if they were charging higher prices for women than men. I think he is mistaken if he thinks he is ever going to get "high payouts".

    I mean the difference is that they are not charging higher prices to exclude men - in fact they are assuming that men will happily pay the higher prices. Although here I think having a "lipstick night" would still constitute discrimination.

    the sad thing is that this happened already up here in the frozen northland, bars around here dont have "ladies nights" as often, they find neutral pc terms for it now.

    Well, you have all sorts of arguments regarding the performance of a job as opposed to providing a service. Like you can offer a thousand bona fide reasons that discrimination is necessary for a job (you might require a male or female model, for example - or stripper, or hooter's girl). There is not really a bona fide reason for discriminating in offering a service.

    Just saying they are different kinds of discrimination that have different kinds of justifications, and it is an usual court and set of laws that will force an organization like Hooters (or the equivalent for male employees) to hire on equal standards.

    Private discrimination of any type should be 100% legal.

    I'm all for a guy having a bar that discriminates against women, blacks, chia pets, whatever.

    It's when we are forced to pay for it(taxes, regulations) that discrimination is really conflict causing.

    In any case - this is one of those things that I'm sure you love to shock people with, but it's been kind of acknowledged generally since about 1972 that blatant or constructive discrimination represents a market failure, so it's really more "Dude, get with the program."

    No "shock" value here, it's just a sensible extension of libertarian principle. If proerty rights are to be respected, people have to be allowed to choose whom they will and WILL NOT do business with. Discriminating against bad credit or people not wearing shirts or shoes is politicaly correct discrimination. But disallowing people by gender(in some cases) or skin color is politically incorrect.

    Generally acknowledged by who? Certainly not the economics profession, which despite all its problems has not embraced the regulation that grew out of the Civil Rights Act, the Americans with Disabilities Act, and similar.

    Anti-discrimination laws usually just lead to resent and probably MORE privately held discrimination. Affirmative action is a type of discrimination related law that is quite contraversial and some would express it is "get with the program", but it is not so clear cut.

    I think our society would be much better off once we got rid of anti-discrimination laws and put respect of property rights first above social engineering.

    How does discrimination represent a market failure if many businesses flourish precisely because of their overt discrimination? For example, women's only gyms and fitness clubs. Discrimination is not in any way related to market failure, but some may see it as a failure of free markets to promote a certain social agenda. That's sociology or philosophy, but not economics.

    Sh0t, you have a 6 year old's concept of property. (I'm about to make at least a handful of people here snicker, but anyway, here goes property is rights, not things, and there are very few instances in which people have unlimited rights in any form of property. So you are looking for a privilege that has never existed at any point in human history, and is about as plausible and useful as examining property rights on Mars.

    Discrimination is related to market failure because there is no rational cause for discrimination on the basis of say race in the context of say employment. Economic models assume a degree of rationality which just doesn't exist, as most economists sort of recognize at this point. Discrimination doesn't work in an economic model because economic models assume, by their nature, that people want to maximize efficiency. Discrimination (in the sense of the social evil we are used to - discrimination in the classic sense of choosing one thing over another is still fine) doesn't care about efficiency. Finally, all due respect, but affirmative action is mostly controversial amongst people who don't know what it is or what it entails.

    LOL, exactly! There are lots of bars around here that have ladies night-all you can drink for $5 or $6 if you're a female, and I've never heard guys complaining about it. There are always tons of guys who come out to the bar on ladies nights. I've had a couple guys say "Ladies Night? What about Men's Night?", but it's always in a joking manner. On weekday nights, most of the bars' clientele is made up of men (at least around here), so bars do ladies nights in order to encourage more women to come out. Men have a lot more fun, stick around a lot longer, and buy more drinks when the bar isn't a total sausage fest.

    Bleh, I had a misogynist friend in college who wanted to sue some 6th st clubs for having Ladies Nights. He also wanted people to be gender neutral. He also couldn't get laid because he was unnatractive but only went for beautiful, stupid, skanky, drugged out chicks.
