Default Asking about Welfare on Job App?!

    Can they do this?!

I just filled out an application for Ulta.

It goes thru the normal stuff

Then asks for permission for a background check. Asks about felonies, blah blah. Normal stuff but a lot more intense.

Then has a 120 question 'personality test'. Fine, ok. Cept that they have 4 questions per page and its a pain in the ass.

THEN it goes on to this:

    Work Opportunity Tax Credit

The following questions are voluntary and pertain only to the Work Opportunity Tax Credit Program. The information collected will not be available to the hiring manager and will not be used to determine employment eligibility.

Yet theres no way to NOT answer these voluntary questions

    Heres some of the questions

Are you a foster child on behalf of whom state or local government payments are made?

How many members are in your immediate family?

What was your family income over the last 6 months?
It goes on to ask about have you ever been on AFDC, have you ever gotten food stamps... all kinds of questions about this... over and over for like 20 pages of questions about AFDC.

They SAY its voluntary but theres no way to not answer them. Theres not a 'Would you like to continue and do the Work Opportunity Tax Credit questionaire 'yes' 'no' like there is on other questions.

Ive NEVER EVER EVER seen this on any other application. Ever. Is this even legal?

It irked me because I got welfare for a few months when i was 18 but this was YEARS ago and see no relevance to welfare that i got 6 years ago and a job im applying for now. I filled it out because I didnt want to lie to a potential employer but WTF?! It made me feel like crap to have gotten welfare but i was 18 and had a full time job but was making min wage. Was on a few mos til i started dancing... is it even legal to ask this?

They SAY its voluntary but its NOT... theres no way around it. You click exit to not answer and you cant finish the application.

    What IS this?

Those questions are highly illegal in the state of California. If it is "voluntary" then leave the fucker blank. I can't believe how invasive that application is. Isn't Ulta a fucking beauty supply store? It's not like you're working for the government or anything.

Jeez, it's not like you are applying to be a fucking surgeon. Why would any of that matter to work at Ulta (and most other places)? I feel the same way about places that drug test people for jobs that could be done by a monkey.

i may be wrong, but the reason they ask that is because the work place gets some kind of credit from the government if they hire enough people that meet a certain criteria. From what i've heard, in these cases if you answer yes to any of these questions it is in your benefit and increases your crances of getting hired. This is in California, right? i've come across these questions when applying for a job several times.

^^^ Which makes it discrimination whether its for my benefit or against it... they actually asked our income! Ive NEVER heard of anything like that before...

I cant leave it blank. Its an online application and if you dont answer you cannot finish the application.

You know, I had this on my work application. It says it was mandatory but then before I did an interview the manager said she was required to have me fill it out.

Illegal. Thats like forcing you to give them race, color, creed, etc which is DISCRIMINATION.

Its one thing to be voluntary (even tho it really wasnt) and another to say mandatory.

My friend is an attorney and I left him a message about this. Im waiting for him to call back with more info.

hmmm, in my mind the discrimination is the elevated probability that a person who HAS been on welfare will be hired before someone who hasn't !!! Welcome to the People's Republic of California !

I can certainly understand why potential employers would want to hire former welfare recipients - because the State of California provides a de-facto subsidy for their salaries via the state 'work opportunity' tax credit granted to the employer (and actually paid for by California taxpayers).

I guess it varies from state to state, I've seen that on every single job app I've ever filled out in NJ (that was more than one sheet long). I guess I just thought it had something to do with your taxes.

Ive never seen it in CA.

I spoke with my guy and he said when he hired people - in CA. That AFTER they were hired filling this out was mandatory but not before as it can be seen as discrimination...

It has nothing to do with YOUR taxes. It has to do with - of the company hires people that were/are on welfare/state programs the company gets a tax benefit.

So its beneficial for them to hire someone whos considered low income or who is on welfare over someone who is middleclass because if they hire the first they get a tax cut/benefit.

Am I right? Thats the only thing that makes sense to me and it pisses me off.

I think it varies state to state and company to company.

You are right on the money! This tax credit isn't available is every state, but California has this program.

Do you blame them? The cost of living is outrageous.

We have this on apps in NJ, but if I recall, it's only if you've been on it recently (with the question about being a veteran and things) and for tax purposes. Ever seems a bit of a stretch.

I think it says in the last 5 years in NJ. I think yea it's after you're hired or at least into step 2 of the hiring process. That's crazy that it's mandatory to admit the 6 months out of yr life when you were 18---that's really ridiculous. I always just assume "employers never read apps anyway" and won't memorize all yr info when they sit down to meet you. But I dunno what Ulta is tho. I always thought, if I ever went on Welfare, I'd think "who cares" about the whole thing. Free money. Free juice. Whatever. Not like it's going to affect your credit.

Hell yea it is. And I noticed gas went up almost a quarter in the last week around here. Welfare isnt even worth all the hassle it takes to get it. Hence why I started dancing. They want to know EVERYTHING about you. I hated it. I would never go on it again - no matter how hard things got.... its so invasive.

Well yeah, Chapter 7 is pretty easy, but I wouldn't say painless, which is why it sucks so much.

So what's the status of the OP? Where you going to continue the app with Ulta, have you, or what? My friend worked there and they were good to her. This Ulta was in Tucson though.
