    Default Do I have a warrant?

    I got a speeding ticket and my court date was on November 1st. I missed it and my dumb ass forgot to pay the ticket.
    Someone told me in Atlanta (Dekalb co) you have 30 days to pay it before the warrant gets put out.
    I was gonna go up there tomorrow (the 26th) and pay off the ticket.
    ???......

    We have a website here in Fl. where you can look yourself up and see what is filed against you. Tickets, warrants anything.

    Here in Fl. you need to call and get an extension on the ticket. Here you would already have a warrant out...don't know about Georgia.

    It's nothing to be afraid of. This happened to me once purely by accident. When I called to straighten everything out they were so ho hum about it. They just told me to pay it and it would be fixed.

    Sorry to threadjack LC, but it's related...

    R got a 'failure to stop at a stop sign' ticket about a month ago and they've sent a reminder to pay because he hasn't. We simply do not have the money to pay. We barely can feed ourselves. Is there any way to 'defer' the ticket payment, or do payment plans? Where can I find out about this? I don't want R to have a warrant out for his arrest for non payment, but I simply do not have the money and he's still job hunting.

    (Im in CA btw)

    ^^Again, I'd say just call. It's nothing to be afraid of. If you appear to be trying to do the right thing, they will most likely work with you. Puts you ahead of a whole lot of the people they deal with.

    If your state follows the norms, if you didn't pay or challenge the ticket by the date, you probably have a warrant. I don't think it's anything to be really worried about. They're not going to come bang down your door. If you get stopped again, or you do anything which involves a background check or court appearance, it'll show up. It looks better if YOU come to THEM instead of getting pulled over again and having the officer run your license and seeing your warrant. When you make the effort, it makes you look like you're trying to do the right thing. Call the Clerk of Court and talk to him/her. Just don't challenge it. It's normally not a good idea at all to challenge a speeding ticket. Other offenses, maybe.

    when i got in trouble by the law once, they told me all i have to do is set up payment plans. (for bg)

    Seriously. I tried to challenge mine and they said - go talk to the attorney. So he gave me 90 days to pay (instead of 30) and it was the same amount of $$... really, its a pain in the ass and youll probably lose anyway but I did say 'not guilty' and got more time to pay! There were a few other options he gave me but that was best.

    BG just call them... you can set up payments but theyve probably assessed a $300 bail to whatever the ticket amount was before...

    Well, that's not true in any jurisdiction I've ever been caught speeding in. LOL

    The machines are accurate within about 5 mph, so if your ticket is for going 11 miles over the speed limit, you can probably get it knocked down to the 5-10mph over range. Also the officer has to show up to court with the documents showing the last time that machine was calibrated, not just testify that he calibrated it. Also, the officer has to show up to testify. In my experience, going to court always reduces the points, if not the cash.

    Lucki, yeah, you probably have a warrant. Go down there with the money (expect an extra $2-400 on top of the ticket), pay it, and get a reciept. The warrant will go away, but sometimes it takes them a couple days to tell the people they contract with to come arrest you, so you need the reciept just in case they come to arrest you.

    You can always take the chance that the officer won't show up, which worked in my case. With the LIDAR guns, they calibrate automatically when turned on. Most officers give you 10-15 over because it's 5 for the radar, 5 for your car's speedometer, and then they give a 5 mph cushion for the driver as a courtesy. That's how it is in the paces where I've been and spoken to the officers.

    ^^ I highly doubt theyre sending people out to arrest her. But if she gets pulled over again and they run her license theyll tell her she has a warrant and *could* take her to jail... most likely will give her a Promise to Appear.

    BG - In CA thats the bail amount. I mailed my speeding ticket fine out on the day it was due (I called and she said thats ok as long as its postmarked the day due) anyway - I got a thingy in the mail saying they assessed a $300 bail and I now owe $269+$300 and have 30 days to pay. I had already paid and 2 days later got the driving school paperwork but I still need to call and make sure that $300 isnt showing as owed. Next time Ill just drive down there and pay it like I planned in the first place. Pain in the butt...

    They haven't been able to get the initial $166 out of us for the ticket in a month and a half...what makes them think they'll get $300 bail in 30 days?!

    Blood out of a stone....

    What sucks is R swears he did stop. I told him he better figure something out because if he gets sent to jail, I won't be able to afford to get him out! And jail costs money each day you're in there too....

    Dont worry BG. Have him call. I dont think hell get out of the $300 but they can set up a payment plan for the total amount thats now close to $500. They'll tell him to go in and plead guilty.He MAY be able to talk his way out of the bail if he talks to the DA/lawyer/whatever that guy is called. The way I got to talk to him was to plead not-guilty and they gave me choices for pleading guilty (plea bargains?) hehe...

    Theres an admin fee to set up monthly payments but once theyre set up you both will feel better. Even if all you can pay is $10 a month. Just dont set it up for more than you can afford. Make it the lowest payment possible.

    He really needs to call and get this taken care of NOW before it gets worse...

    If he has a warrant, when he's arraigned, he'll most likely be assessed an unsecured bond, which can range from release on his recognizance, to a monetary bond that is only assessed for payment if he doesn't show up on his scheduled court appearance. They don't want to jail someone for running a stop sign. If it's a secured bond, then you can get a bondsman for a percentage of the bond. I highly doubt they'd jail him for running a stop sign. No judge I can think of would want to do that.

    There isn't enough room in jail for these kinds of offenses. Just pay it and that should be that. Or even try to fight it. Most cops are at work and won't show for court unless you have one of the cops that only give tickets for the days they MAKE SURE they are in court. Either way the worst is having to pay. I would start saving the money and delay the court date as long as possible.

    You guys need to read up on your vehicle codes!!!! COME ON!!!!!!

    Lucki- call & ask about payment plans. BG- go to helpigotaticket.com it's all cali-based stuff, previous cases, vehicle code stuff.... and go browse caltrans website for a while.

    It is YOUR DUTY to know your vehicle codes in your state, to know traffic law, to understand that it is ALWAYS worth fighting your tickets.

    ALWAYS. speaking of.... i got my first today on my bike. shee-it.... 80 in a 65. (I was going faster, but the moto-CHippy was nice. late to work coming back from the canyons, what can i say....) Anyway- the first (1.) thing to do is LOOK OVER YOUR TICKET and make sure the information is correct. Your name... your vehicle.... your ethnicity, etc. If that shit is wrong, it can be thrown out. If they cited me for riding a Suzuki Monster rather than a Ducati Monster I can say, "uhhh... I don't own that bike... in fact, I don't believe it's ever been manufactured..." and the judge will throw it out.

    2.) Look at the citation and see if it is a basic speeding law violation or something different (stop sign, distance, etc.)
    3.) Always request a postponement. Why? More time for your dude to forget about appearing. NEVER, NEVER, NEVER say "guilty." always try to find something.
    4.) Get the traffic and engineering survey either through your local municipal/civil bod or through the greater overseers of transportation.... if radar was used & the T&E survey is over 7 yrs old, case can be thrown out.... speed trap. (in ca, anyway... check rules for your state.)
    5.) Even if you say, "not guilty" and you're found guilty, you can still request traffic school!!! and not get pts on your record.

    It wasn't a speeding ticket, it was a ticket for apparently running a stop sign. He thinks he might not qualify for traffic school because he still had his AZ license when he was cited.

    ^^^ i know it wasn't a speeding ticket... the site i posted for you has traffic laws for lots of stuff regarding vehicle code violations in general. the thread DID display an overall lack of VC knowledge, which is pretty critical in these events... plus, OP did have a speeding ticket.
