    Jobs, Background checks, and more

    A friend of mine has come to me asking for help about applying to a job as a substitute teacher and I'm hoping some of you can lend some insight....

    So he's wanting to apply as a substitue teacher. He has several concerns about how his application might appear. One issue is that for a few years several years ago he bounced around jobwise - so if he puts it down it looks very unstable, but if he doesn't put it down he's concerned about looking like he did nothing for a couple years or worse, the schools finding out he worked but didn't admit he did. Any opinions on how to deal with this or maybe how public schools may take this?

    Also, since age 21 (he's 24 now) he's not had any legal issues. Prior to this he apparently had some run ins with the law. I think the worst of it is that he got arrested for a dui - which was later dropped - but unfortunately on his driving record it shows his liscense was suspended but no dui is mentioned. So he's wondering how this may be interpreted by employess, especially school ones. Also, the schools say they do background checks....he's not sure how extensive nor is he positive what might show up. Is there anyway to find out just so he knows what employers might be seeing? There are so many background checks online that are advertised but he's trying to get one that may be comparable to whatever means public schools use to obtain such info.

    Any help on any of this? Sorry this is so long too! He just came to me with this and he doesn't have anyone else to consult so I'd really like to help him.

    i have to say i disagree, sunday. i have a dui. i also have a job at a school. first of all, a dui is worse than a dwi. in maryland(which is where trouble is, and me too - if you dont want that posted though, i'll delete it!), a dwi is classified as a .06-.08 - not over the legal limit but still drinking and got pulled over. a dui is over .08 - mine was .17. so maybe you just have that part backwards. but it is NOT instant disqualification, not in maryland at least. actually, they didnt even question me. if it was dropped, it doesn't come up the same. i got pbj for mine - no guilty conviction. i checked the "no" box when they ask about crimes, and it never came up. my fingerprints came back fine.

    he may have to give an explanation. but that won't disqualify him.

    We don't know your friend's state of residence, so it's hard to give specific advice.

    If he's had only a single DUI/DWI, it's unlikely to end in automatic disqualification. My personal view is that he would gain points by offering that information up front on his application, if they inquire, since it gives him the opportunity to point out that the charge was dismissed. He can also get in front of the issue this way.

    Many public school systems are required by local law to run criminal background checks on potential employees. These do not probe much beyond arrests, convictions, wants and warrants and any other criminal activity. As I've posted elsewhere, most government or public institutions use the NCIC, the National Crime Identification Center database maintained by the FBI for this purpose.

    I think your friend has very little to worry about, honestly.

    is there anyway a regular nongovernment related person can get a NCIC background check done?

    The short answer is no, but this is an example where it's good to have a friend in LE.

    It's a matter of a favor, actually. It's done quickly and can even be run from most patrol cars w/computers since they will often run NCIC checks for simple traffic stops. You would be surprised how many fugitives they find with some out-of-state warrant from a simple traffic stop when, say, a turn indicator is not working.

    Some of these geniuses think it's really smart to take off at high speed as soon as the cop gets back in the car to run the database search. Stupid for two reasons -- they've already been filmed, with their license number -- which has already been called in before they were even stopped --- and, as they say, you can never outrun the radio.

    If he's been stopped for any traffic violation in the last two years and LE in his jurisdiction have computers in their cars (almost all do in major metropolitan areas) then he's probably already had one run on him.

    Nothing or everything.

    DWI is for Driving While Intoxicated, and DUI is for Driving Under the Influence. Depends really on the State and Jurisdiction in which you are stopped. DWI normally refers to an impairment by alcohol, and DUI is impairment by prescribed or recreational drugs. Some Jurisdictions dropped DWI and replaced it with DUI to mean impairment by Alcohol, prescription and/ or recreational drugs.

    like i said, in maryland, .06-.08 is dwi, above that is a dui. dui is more serious and has more serious fines, consequences, etc. .08 is the legal limit but you can still get a dwi if youre pulled over and blow a .06.
