I've known a lot of dealers over the years....they usually dont want to inflict suffering..on the contrary..they want the drug to make you feel good and make you addicted so you keep buying more.
In the MacDonald's coffee case, if I'm not mistaken, they awarded some fairly.. vigorous punitive damages because they knew the cups were inadequate to hold the temperature of the beverage, the woman was not the first one burned and they just didn't feel like paying for cups that would "work".
As well, for "real damages" - think about the changes and losses to your life that would ensue from having scar tissue all over your lap. That is - your crotch. Come on. Those are some legitimate real damages.
Cam - an addiction is, in itself, a harmful state that constitutes suffering. I don't know. Criminal sanction are ineffective against dealers because they have a vested interest into continuing to break the law. Civil liability has the potential to interfere with that interest. I mean, even if you think that drugs should be wholly decriminalized there is no particular reason that they should not be responsible for what they are selling when it is used exactly the way it was intended to be used.

It sucks that this happened and I would have a lot of sympathy for her IF she hadn't gone and sued her dealer. That's just messed up.
Plus, if you sue your dealer, who are you gonna get shit from in the future![]()
I understand that it must be devastating for her, but...suing the drug dealer? Dunno about that one.
