    Default She hit me and now wants to hold me liable..

    Any advice would help so much..
    It's very simple. I was at a stop-light and the woman in front of me backed up and hit me. I saw her reverse lights go on and wondered what the hell she was doing (maybe she was blocking pedestrians crossing in the cross-walk?). I started honking my horn like crazy and she hit me anyway. She apologized profusely once we began to trade info. I noticed her license was expired by over a year. She then asked me to call her husband before I reported the accident to the insurance company. I asked why, and she said, "He own auto-mechanic place, he fix you car real good." I laughed and told her I was going to just report it to our insurance agencies. She did not even give me proper insurance info, I had to get the run-around from her man before he finally gave me the info. Then he told me that his wife told him that I hit her and that they were opening a claim against me.
    It infuriates me, this woman had NO right to be driving, and the insurance companies totally seem to be overlooking the fact that her drivers liscense was expired. Instead they are saying that it is more probable to rear-end somebody, than to have someone back up to hit another person.
    I can NOT have my insurance go up any more that this point. What do I do? Someone please help..
    Do I go to small claims?
    Get a lawyer (that I can't afford)?
    or just let insurance companies battle it out?

    well if a lawyer isn't a financial option at this point, i would suggest going to insurance, and if they have to, their legal department would go after her.

    Why didn't you call the police and have a police report made? I guess you can always go to the police and say she gave you the info but then took off...then she will be held acountable for leaving the scene of an accident. That just sucks.

    This is why you should always call the police when you're in a car accident, no matter how minor. She probably would have been ticketed for not having a license.

    It also sounds like the whole thing is a scam. There are people who will back into people and claim that they were hit so they can pocket the money. I would contact the police to see what they reccomend you do at this point. Be sure to tell your insurance company everything. You may want to look into a lawyer also.

    Oh man thats ridiculous. I would just tell them exactly see what happens. She shouldnt have been driving without insurance in the first place, so atleast she is screwed there.

    Im sorry I have no solid advice though.

    Wait, did you call the police or not? And have you filed a claim with your insurance yet? I know how you feel, I wasn't rear-ended, but this summer a girl hit me and claimed it was my fault

    So if her husband owns a mechanic shop then he can give an outrageous estimate to their insurance co and maybe they can get more $$$?? Maybe a scam.

    I agree with this completely. Also, am I the only one who is wondering if perhaps this woman has tried doing something like this before? I'm curious to see what her driving and/or criminal record has on it...if she did this before and she got found out, then that should make your case a LOT more credible.

    damn. Definitely a scam. I don't know what to tell you. In hindsight you should have called the police. But i know you don't need to hear that now. Go the legal route and definitely have her past looked into. I mean legal as in deal with your ins co first.
    But really. bad things happen to bad people- especially when you know where they live. Revenge is a dish best served cold and by someone else.

    This is totally insurance fraud. She backed up into you. Her husband is a "mechanic" who can make repair estimates (and repair the "make work" she did on the front of your car.) She obviously shouldn't have been on the road.

    Tell the insurance company this person is engaged in fraud upon them.

    (You were smart not to have your car repaired by them because they would give you an outrageous price and hold your car hostage with a mechanics lien.)

    I don't know where you're located but in many large cities the police will not even respond to minor fender benders unless there is an injury or oui involved so calling the police isn't always a viable option.

    With that said, I had the EXACT SAME THING happen to me (there's even a thread buried here somewhere) except it was a strip club customer who backed into me in the club parking lot. This was several years ago so I'm trying to remember exactly what happened. Fwir, I contacted his insurance, they sent out somebody to look at the damage and they cut me a check. Although I ended up getting the amount reduced probably because I refused to go through my own insurance. The customer was a real dick too, trying to get my personal info from his insurance people and just being an all around asshole.

    I agree with everyone else that this sounds rather scammish to me. I'm not totally clear from the posts, you have contacted your insurance or no? If not I think you should and really stress that she was in reverse and that you suspect fraud.

    ^You hit the nail on the head with what you said about the police. I got in a lil' more than a fender bender awhile back and it took three 911 calls and an HOUR and 45 min until the police showed up. Gotta love L.A.
    The only thing that makes me think this might not be a scam is that initially, she did not want to trade information, and rubbed her finger on my car and said, "see? just a scratch, no big deal," like Ok, Can we each part ways now? I insisted on trading info. Now I wish I didn't.
    I reported the incident to both insurance companies. Mine (Progressive) does not appear to be working very hard. They gave me some young, noob who needed goading the first 2 days to get going with this claim because them claming I am liable is stressing me out.
    The thing that makes me even MORE angry is that I issued a thorough detailed statement to their insurance. When mine called them for their statement, the HUSBAND said he would have to give it, because she didn't "speak english."
    WHAT THE FUCK.
    I begged her insurance company to contact only her, and don't speak with the husband. He was not even there and she CAN speak English. She's just stupid and he wants to do it for her because he knows so much about cars, obviously. My manager and I both heard her (manager showed up at the scene while we were trading info).
    I slept like total crap right now. I just can't be liable for this. It will screw me so bad, financially.

    Many police departments will not do an accident report if there were no injuries. They may respond and ensure that a proper exchange of information takes place. Even if the OP had gotten a police report, the police officer would not have witnessed the collision and would not be in a position to confirm your story.

    To the OP, did you get any witnesses? ALWAYS try to get witnesses!

    When I was young and dumb a younger girl backed into me at a convenience store - same deal, tried to blame ME, saying it was my fault b/c I didn't blow my horn! (I LAID on that horn!!) Then she tries to play the race card with me.

    Then I have trouble getting the insurance info. Same thing - father calls me, sez he will look at it and get it fixed out of pocket. I ended up banging the dent out myself and took a royal screwing out of the whole deal because I wanted to avoid the conflict. Big mistake. Never again.

    I think you need to emphatically stress that you were at a complete stop and the other driver put her car in reverse and backed up into you. You mention your manager witnessed the exchange of information? It would be so helpful if your manager overheard the other driver apologize to you for backing up into you. If that is the case and your manager is willing to be a witness, make sure they only talk to YOUR insurance company. Why? Because I also had witnesses (~5) during my incident and (THIS IS SO SHADY) when I gave the other insurance company my witnesses contact info, the rep immediately discounted all witness accounts saying that we could all be in collusion because I knew them and now he had all their names and they weren't valid witnesses. He said he would only accept witnesses that I didn't know. wtf? I'm certain that could have been avoided if I had just gone through my own insurance company to begin with.

    My hugest regret=not insisting that a cop came to the scene no matter how long I had to wait.
    My insurance company says I am not liable, hers says I am so now it is going into arbitration. The decision will be made on May 27th.
    I love random trashy fucking scuzzbuckets just drop into my life and decide to make it miserable for me for some time.
    Sorry, I know this is negative, but I really fucking hate people right now. I really do. They are for the most part, selfish and have no fucking consciences. These assholes could cost me thousands and they don't even care.

    Wow, I got really pissed just reading about how that woman blamed everything on you. It would've been better if you had witnesses. I really hope they don't get away with this, it really does sound like her husband and her are running a scam. They should pay for your damages! Don't let them fuck you over, no matter what.     Dear GOD. It is SO hard to get insurance companies to look into ANY form of re-end collision as the fault of the person being rear-ended.

    I was in an accident similar to this where I re-ended SUV that slammed on the breaks to turn into a hardware store, and totaled my car. I was at fault even though, with pictures, the car in front of me slammed on the breaks SO HARD their SUV's rear end raised up enough to LAND under my hood. The first foot of my car was almost unharmed with a huge dent and scraping in from that point up to the windshield.


    What kind of car did she have?

    If you can get your car to a good insurance-supported mechanic, he can prove, through your transmission/drivetrain/mechanics, that your car was hit while in a stationary position. This can be a HUGE help. Just showing that your rotors/break pads have clockwise wear on them can help if your car was not driven from the accident on.

    just a thought but maybe you can see if there are any cameras in the area and contact whom ever might have footage of the whole thing ie traffic cameras or store fronts who catch some of the streets in their footage. do this quickly if possible because i think they usually have 8 days recorded.

    The cops and witnesses don't always work in your favor. A young guy with a questionable driving record ran a stop sign and completely slammed my car last summer. It was at night, so he and some "witnesses" decided that my lights weren't on causing him to not see me. The cop believed them and gave me a ticket.
    Even court was a joke. One of the witnesses changed her story three times, where I was coming from was entirely pitch black, and a policewoman who was driving by miraculously appeared on my behalf to say she saw that my lights were on.
    I didn't get guilty, but I didn't get not guilty either. Had to pay court fees and such.
    I'm just now getting over this.

    Legally, the car in back (during a rear end collision that is) is ALWAYS at fault. It is very hard to dispute that, unless you have a witness. The reason they assume this is because people rarely keep a safe following distance*.

    It seems like you really need a witness or video proof to back up your story that she backed into you. The law assumes that the person in the second car is at fault without some corroboration.

    All that legalese aside, it really blows that this happened to you. It sounds like she wasn't paying attention to where she was going. This is why I think people should have to re-take their driving test periodically.

    When this is all over, if your insurance company hasn't helped you at all write a full complaint to them about their lack of help and move to a new insurance company.

    Always call the police, even if they're not likely to respond. The call is recorded in their police logs and you can call the information up should it come to a court case and tell the insurance company that you reported it.

    I am insured for such things, that means, I have an insurance policy to cover the costs of an attorney. Isn't there such a thing in the US? Here it costs us about 25 Euro a month.

    She doesn't need to retake her driving test. She knew exactly what she was doing.

    What YOU need to do is report this to the police. Even if the insurance companies are already going at it. Their insurance company is covering a car that is ILLEGALLY on the road (expired plates over a year old). Let the police know that this lady backed into you and is trying to get money out of you...give them her license plate number and tell them that you noticed that she has expired plates...from over a year ago. Chances are...if she's pulled this before, they'll know about her and can inform the insurance companies. She'll also get a nice, big, fat fine for operating an illegal vehicle. Oh, and mention to them that she gave you fraudulent insurance info and took off before you could call them before...

    People like this suck.
