    Default I got a speeding ticket, 20 miles over.

    This is the first time I've gotten one that much over. I just got one in January as well which I still havn't taken defensive driving for. Now I got another one tonight, and since it's 20 miles over I have to go to court. Is there any way to talk them into lowering my speed bracket once I'm there? What would happen if i plead not guilty? Anything else I should know?

    alright- request trial by declaration first, plead not guilty, if that doesn't work, request a new trial (trial de novo) and then if that STILL doesn't work you can always do traffic school so the points don't appear on your license. NEVER just pay & settle. always, always, always fight your tickets.

    do a google search for the vehicle codes in your states, search for the pdf files for trial by declaration, request one and state your case. you have a good chance of winning simply off this because a lot of officers are too lazy to fill them out & send them in. It's a good idea too, if the road appears old/if you think it might have been a speed trap, to get the traffic and engineering survey and prove a speed trap- they're illegal in many states and will nullify your ticket.

    ^ Question...everyone says plead not guilty. So when got this huge speeding ticket, I went to court, pead not guilty, expecting to get my fine reduced.

    The judge says, " So you weren't speeding?"
    Well, yes, I was...
    Then you are guilty?
    well..I guess...but...everyone told me to plead not guilty, so I am.

    so....How does pleading not guilty to a crime you know you are guilty of work?

    I made such an ass out of myself that day. That and the fact that I was told to dress nicely but slight provacative....so I wore a cute yellow sundress with no bra. Little did I know that you could see right through my top.

    anyway...curious to know how not guilty works?

    Here in Australia if you can contest the ticket you can say that according to your speedo you were doing the speed limit or else not the speed that was registered ... this works better for older cars. Or else you can ask for them to prove to you that it is working fine and not malfunctioning as there are well known speed cameras in Sydney that work wrong all the time.

    I always pay my speeding tickets. Purely for the fact I did the crime - I deserve to pay for it. I KNOW I fucked up and I think it's kinda crap you wanna get out of something or get something lowered because you want to, not because you were more innocent.

    You screwed up, you pay for it.

    Don't speed next time. Lesson learned.

    also, you should/could get the data on the radar gun used, if there have been any reported errors with that model, certificate of calibration, FCC Licenses for the gun, see if the officer was using the gun correctly.

    If you can build up a case, it will work that much more for you.

    no, seriously though; the idea is to call into QUESTion the officer's perception of your speed: if he used visual estimation, the fact that it's not metrologically viable and therefore not permissible evidence; if he was hiding using a laser on a street with a T&E survey older than 5 yrs, he used a speed trap which is inadmissable, if he used a radar, call the calibration into question... act like a lawyer and question everything. Cops aren't prepared for people to be smart about their tickets.

    Not sure where you are Fawn, but here the ticketing officer does not have to be present for the hearing in fromnt of a majistrate, trial he does. So you can use that to your advantage by asking questions, to the stand-in officer. He/She obviously can only read the report. Therefore you can ask general questions, and they have to answer.

    Also, go through your ticket with a fine-tooth comb. If there are any inconsistencies/errors on the ticket, that could lead to you being cleared on a technicallity. Also, if you didn't sign the ticket, that could also be cause for dismissal, as the ticket was done against state-law (depending what state your in).

    Overall, if you do go to trial, don't put all your eggs in one basket, come up with a few arguments. Just saying, "Well your honor, I did not sign the ticket, therefore it could never be confirmed that I recieved it." does not sound good. But ifyou can say "Your honor, this is a speedtraps (ass CC mentioned), as well as the officer did used a radar gun in an inapproriate manner as it was uncalibrated, and used in correctly, AND the officer failed to have me sign the ticket." it makes the officer look "bad" instead of you.

    I do believe it is a speed trap because I see people pulled over there literally ALL the time. I just wasn't paying attention to speed because it was 3 am and there were very few cars on the road. I myself have been pulled over at the same spot and given a warning several months ago. How would I get a T&E survay? How would I find out the model number of the uh is it called a callibrator?

    I just got my very first ticket in October...it was a speeding ticket . I was going 30 in a 20. It was pretty weird getting a speeding ticket for going 30 mph ha! Since it was my first ticket I just paid the fine and the points did not show up on my record. The cop was a real ass about it but that is kind of how they are around here. I had lived in my new house for two days and had not yet noticed this area is swarming with cops. I'd rather pay the cash then have the points.

    When you plead not guilty, and the judge asks you if you did it, you say no.

    And then you have SOME sort of story to tell...."I was near other car and I don't think he got me" or "I saw him just as he was aiming his radar at me, and so I looked down, and I was doing XX mph (close to the limit)"

    Say something, but don't plead not guilty and then admit you did it.

    Yes, but speeding is subjective. Laws are not necessarily absolutes. What if the conditions one were in necessitated speeding? Speeding laws are meant to increase safety...what if you were travelling a safe speed but happened to be over the limit? Do you know who sets speed limits? People who sometimes want to get people to pay more fines. Why is it fair that they can do this?

    She just said she wasn't paying attention and she'd be warned at the EXACT same spot before. C'mon. She knew it. She should pay up. Not lie.

There was a time it clocked me at 30 over and I had my GPS on and in the window of the car you could see I was going ONE KM PER HOUR over the speed limit (my GPS displays it)... so I said, look, not fucking paying a $300+4 point bill. So they took the money off and gave me one point anyway.

    But still... 'not paying attention' doesn't fly by my book. If you're gonna not pay attention, put the car on cruise at the limit.

    Well I have A LOT of points all from speeding in NJ. I would show up for the court early and talk to the prosecutor and ask if he will down grade the ticket. I think your offense will land you 4 points if my memory serves me right. Maybe he will give you 2 points instead. I never found it successful fighting the ticket unless I consulted an attorney first. Just my opinion and what has worked for me in the past.

    I've gotten speeding tickets...most I didnt deserve, a few I did. The ones where the cop was nice and didnt treat me like crap and I knew damn well I was wrong..I just paid. The others I fought. Won some , lost some.

    If he got you on radar, you can request to see the printout. I've had cops pull me over and tell me I was doing a ridiculous speed that I knew damn well I wasnt doing. Other people in the car testified to it as well. These are usually the cops who act like a-holes. One wouldnt speak to me or answer any of my questions..just gave me a really nasty look and literally THREW the ticket at me. Fucking power trip douchebag.

    I have had good luck with those "we'll get you out of any ticket for $99" type of lawyers...doesnt hurt to call.

    Anytime I've been in court for traffic violations, I always plead nolo contendere (no contest) as opposed to guilty/not guilty. Or, I call a lawyer to get it cleared from my record. I don't know how difficult that would be since your violation is so much over the speed limit, but I'm certain a lawyer can wipe your slate clean for a price. That even takes away your need to take defensive driving, at least it did in my case.
    People equate sexy with promiscuous. They think that because I'm shaped this way, I must be scandalous - like running around and bringing men into my hotel room. But it's just the opposite.

    Realize the most expensive part of a speeding ticket isn't the fine, or the court costs. Its when your insurance company finds out and raises your premium accordingly. Over time, this may well exceed the cost of a lawyer who specializes in this sort of thing and can get you off or at least things reduced. Considering the consequences, you should always fight it. Even if you're 90% certain that you're screwed.

    About most things, I tend to agree. I'm a big "Self-responsibility" person...I just happen to disagree with speeding as a law. I honestly don't think we should even have speed limits...instead, cops should give tickets out for reckless driving, and have to prove it in court. Speeding in and of itself is a crap law, half designed to bring in money on fines.

    ???? Why punish yourself with paying the fine and admitting guilt?? Like doc-catfish said, it's always WAAAAY more than necessary (it's f*cking extortion, if anything) and it always makes your rates SKYROcket. Paying tickets instead of fighting them is pure martyrdom and absolutely stupid. IMHO. sorry.

    Here are some sites to help you fight:

    (this is in CA, but will give you some REALLY good ideas and show you how to use case law)
    (look at how they argue laser/radar inconsistencies and prove speed traps/red lights/cameras, etc...)

    Also... Traffic and Engineering surveys are available from your local city hall... they must have been done within the last FIVE YEARS or you can contest that the speed is no longer justifiable. ALso, if the speed is not in the 85th percentile, unjustifiable. Or, like in one of my cases, if they CHANGE THE FUCKING SPEED LIMIT between the time you got your ticket and the date of your court appearance (assuming you didn't know better than to do a TBD first), that's also arguably unjustifiable.

    Highways- T&E surveys may not be available at city halls/libraries... you may have to go through highway authorities. However, most highway surveys will have been updated pretty frequently, though you never know. Good luck!

    aslso, when you ask for the traffic data, state that you will be willing to pay for a copy, it cost me 20 bucks I think and a self-addressed stamped envelope. But, the town was happy to help out.

    I know cuz I had to get out of a ticket a year ago and had all my sh*t ready to go but the majistrate just looked at me and said "don't do it again, no-contest (not guilty) and I was free to go.

    I was sorta disapointed that I had so much evidence, but, didn't have to use it.

    I go to traffic court for fun here.

    90% of what you need to do is at the time of the stop, though.

    Mmm tickets and arrests. I've even caught 416s here due to racing cars and bikes.

    NEVER EVER ADMIT TO A CRIME. ANY CRIME. AT ANY TIME.

    You can't sweet talk your way out that way.

    San Diego County is the fucking worst, too. Our heritage of street racing has spawned an amazing cottage industry on both sides of the issue.

    The easiest, but rarest, way to get out of a ticket is if the cop doesn't show up to court(if they aren't paying overtime that period for some reason)

    I'm in Texas, San Marcos (Hays county) to be exact. I got a speeding ticket on highway I-35 and was going 85 in a 65. I do think the speed is unjustifieable. It's rediculous to go that slow in that particular section.

    Also, it is a speed trap, but I'm not sure if those are illegal in Texas. I may hire one of those lawyers, but I'm going to check out those websites first. Also, while I didn't admit to speeding right out, I did tell him "I'm sorry, I wasn't paying attention" which I guess is admitting wrong by de-fault. Do I still have a chance?
