    Default Im ripping my hair out!

    We just got our tax refund less $3,385 to back child support. Back support that we DONT OWE. All the back support was paid off like 6 months ago. Anyone been through this and know how we get our money back or how long it will take? Im so po'd because we got a letter stating were all caught up and then they take money from us. Urgh. Can nothing go right?!?

    lol. I wish... its now in Placer or Lorraine countys hands.... I was curious how long it would take to get back. It better not go to that greedy bitch...

    Did she file another claim that you are unaware of?

    It seems weird that they would send you a PIF letter and then take taxes, again.

    ^^^ it's undoubtedly the slow parade of family court paperwork ... which in this particular case is more complicated than usual due to more than one state being involved. But ultimately the IRS is not going to make any self-initiated moves to send you a check for $3,385. If you can afford to wait, you could claim it as a tax credit agains your 2008 tax return next April. If you can't afford to wait, you're going to have to sue the IRS for the money.

    I just spoke with the IRS and Placer County. The IRS lady felt bad but said the system automatically takes the money and theres nothing she can do.. the Child Support lady said it could take 6-8 weeks for them to get the money.. even tho last time it took 6-8 MONTHS to update the system that they had taken our return.

    I just pray they dont send them money to Lorraine County when they get the money (in 6-8 weeks) then have it sent back to Placer, etc, etc. This is such BS.

    We dont like NEED the money as in were in dire straights but we were planning on paying off a couple of high interest credit cards with it and this just sucks because we wanted to pay off all our cards and then buy a house at the end of this year and at this rate it looks like no house for us. This shit makes me wish I wasnt married. The IRS lady said theres a form 8379 that keeps them from taking MY portion of the refund to pay HIS support. I had no idea this existed.

    Thanks Mel - thats a good idea. Im just so irritated. Why does it take SO LONG to update systems. Im so frustrated.

    What sucks even more is I have to ammend my taxes to claim my daughter (long story) and Im so sick of dealing with the IRS!

    ^^^ oh yea ! first you get to sue Lorraine county Ohio, and IF you win, THEN you can sue the IRS ! over $3000 !

    The IRS Lady did point out a way to get some of the $3000 back for free ... by filing an 'innocent spouse' form. I'd do it, since the rest of this sounds like a hugely deep mess ... with the least expensive option probably being kissing the child support money goodbye.

    I was kidding. No ones suing anyone. It wont go bye bye. If we did have to actually sue someone (as in if it doesnt get straightened out) it would be the babys mama because she received the overpayment - and it would be small claims court.

    Only reason this is so frustrating is because if I have to say it again - the bitch already gets $1400 a MONTH for the little girl and I think thats PLENTY. Its not like we pay $300 a month like I was getting for my daughter and thats not enough to actually raise a child... obviously $1400 is fine because the broad isnt working... shed rather live with her mother at 37 years old than get a job... and she feels entitled to more more more and already tried to get MY money so Im done....

    ew. If $1400 isn't enough for her, she should get off her ass and work. Living off her mother and sponging off her ex and his wife? Where is her pride? I'm sorry you have to deal with that.

    I just re-read this. I thought you said I CAN kiss the money goodbye. I was like now I get it. Well yea, of course its not worth $20k in attorney fees to get $3k... lol...

    Oh no no no. Not ex wife. 3 week fling... she got pregnant - thought he would do the "right thing" and marry her, etc. (since they were both in their 30s, he has a good job, never married, no kids, etc) She tried to trap him and is now really really pissed that hes married and shes a loser living with mommy. Her plan didnt work. Its laughable. Shes an idiot.

    My husband says the only difference between her and a welfare mom is that she gets paid better...

    Nope. Im guessing when Lorraine County got the money from last year when they took the back child support they didnt cancel the claim or something because they took the exact same amount this time... thats the most interesting part.

    We dont know. I said hey! When were least expecting it were going to get a check for $3400! Hes super pissed over it which makes ME all frustrated.

    And I just want to say this back child support is because she dodged his custody/support/paternity test papers when the baby was first born. Moved out of state and waited until the baby was 15 months old to file. So its not like he didnt pay - he just owes back support because CA gave her support from 9 month (so he owed 6 months of support before a support order) I just wanted to throw that in there because hes not a bad guy running from responsibility which is why its much more frustrating to him.

    We found out what happened. They put a claim in for a bit over six grand. They took last years return to cover it - that was $2,800. Fine and dandy. Well, in the past year the rest of the back support was paid up but Lorain County didnt let the IRS know so they still had us in the system as owing $3,385. Loarin County is blaming Placer County. The lady at Placer is irritated at them because they had nothing to do with it.

    Needless to say Placers dealing with Loraine. Telling Loraine to let the IRS know they screwed up so that the money is released to us. I dont know how long it will take to get but Im just glad the two counties are finally talking - they can take care of this crap.
