    So I decided to stop riding and sell (consign) my saddle at a local consignment shop/saddlery (local as in an hour away). My saddle is in excellent shape and we agreed to sell it for $700. That's what I paid for it and I didn't use it. OK, fine and dandy
    A month goes buy, it's a really nice saddle at a really low price (high end Beval for those horse people) and I wanted to know if it sold yet or if there was any interest shown in it. Here are the following conversations I've had with this place: Red is what i'm thinking

    Day 1)
    me:Hi, my name is _______ and I'm calling about the status of my saddle. The number is ____ and my vendor number is ____

    emp.K, let me check (put on hold) I can't seem to find your saddle (oh really), the person that does consignments isn't here she'll call you tomorrow.

    me: OK

    I wait a week and call because nobody has bothered calling me back

    me: Hi my name is yadda yadd
    emp: Oh right you had the beval saddle.
    me: yes, have you found it? Is it on trial?
    emp: We haven't found it. We'll look for it and give you a call (WTF, you LOST MY FUCKING SADDLE?)
    tomorrow
    me: OK thank you

    I hear from no one, it is now week 2 of the AOL saddle

    me: Hi my name is ...(I get cut off)
    Emp: RIGHT! You're the girl with the missing saddle (IT"S STILL NOT FOUND YET WTF")
    me: You mean, you still haven't been able to track it down?
    Emp: I'm going to have the owner call you tomorrow
    me: OK, in a somewhat agitated voice.

    I HEAR NOTHING AGAIN FOR 4 DAYS!!!!!!!!!!!!
    me: Hi my name is yadda yadda
    owner: yes, there's a note sitting on my desk
    me: what's happened with my saddle, what's the situation
    owner: we can't find it, we're looking for it
    me: How long are you going to look for it, and what happens if you can't find it
    owner: We'll cross that bridge when we get to it (FUCK YOU I WANT MY MONEY OR MY SADDLE BACK!!! THE BRIDGE HAS ARRIVED AND I"M FUCKING IRRATATED!!!!!!!!!)
    me: So how long do I wait?
    owner: a week or two (WHAT!!!!!)
    me: Thank you

    It's been yet another week, and I have heard nothing. These people NEVER call back when they say they will, they seem irratated when I call and are not even polite or apologetic.
    I read the contract "Not responsible for lost or stolen items"
    FUCK ME!! I ALMOST THINK YOU STOLE THE SADDLE AND AM SCREWING ME OVER
    It wouldn't be so bad if they were NICE or SORRY that my $700 item is MIA. How about some compassion people, I'm pretty sure if one of YOUR saddles went missing/stolen you'd be upset. I've been kind and patient and I'm not going to be anymore. I'm calling tomorrow and demanding I get my money or my saddle. If they can't provide I am threatening to speak with every horse association in the area, review and rate them badly online, and contact the better business bureau. I understand I signed a contract, and I'd have been nicer if you would have nice to begin with. Point is they fucked up, and somehow they will pay. I don't know if I'm being over the top, but I talked to my former trainer and she said I was being ridiculously patient and resonable. She would have thrown a fit in the store by now if it was her.
    So I'm going to nicely ask to speak with the manager. Explain we are on a month of no saddle, and I want to know what steps he plans on taking. The bridge has come, and you need to deal with it. If he offers up nothing, I will indeed file with the BBB, at least for shitty service if not for a lost/stolen item. Also, my trainer already knows the situation. She is highly regarded in the area, and the moment she knows they're screwing her over ALL area horse people will know the shadyness. I'm really pissed. Sorry for the long rant.

    That's exactly what you should do. I mean, it's a saddle for pete's sake and a nice one too. Not like you were trying to pawn off an old scratched up Breyer pony for five bucks.

    What you need to do is call and ask about consignments. Ask when they take them (so you know the consignment lady is there)

    You need to go down there and be strict and to the point with NO EMOTION.

    Hi. Here is my ticket. I dropped off my saddle x amount of time ago and seem to be getting the run around. I am very upset about this. What are you going to do about it?

    Wait for bs answer.

    "That is just not acceptable. My situation is that I left a saddle with you and had trust in your company. I have now lost trust in this company and feel others should be warned about how you treat your customers"

    Wait for them to spew bs.

    "No no. I told you this is not acceptable. I will give you one more week to find my saddle or give me the amount we agreed upon when I left it here as a consignment. If neither of these happen I will have to take action and contact so and so and let them know how you do business."

    You need to stay calm and collected and for some reason the words "That is not acceptable" work like a CHARM. Having no emotion with those words. Threaten but do NOT SHOW EMOTION. Say everything very matter of factly. You will get what you want.

    I do this all the time.... im an expert at getting what i want...

    ^^Thanks...I'm very good at staying unemotional (either crying or screaming)and using unacceptable is fantastic advice. Thanks a ton. Now hopefully I get a good response.

    I just love saying "That is unacceptable" Im going to say it to my husband when he tries to have sex with me tonight with a totally straight face. I also like saying "I do not approve of that decision"

    that's completely unprofessional and definitely unacceptable! it seems like a saddle would be a difficult thing to just misplace, and i would want to know if a tack shop that i frequented did some shady business like that. what a drag!

    i think this is very good advice, the only thing i wanted to add is to mention contacting the better business bureau. that always seems to light a fire under their ass around where i live
    These days I like to count my money. I like to wash it delicately and iron it. Sometimes I dry it with some bounty to make it all nice and cuddly. I love my money... did I say that out loud?

    What she said. I'm actually surprised, because at least around here the hourse community is small and they look out for each other. That being said it would only cost $20 or so to file a small court claim. Many people find more motivatation to do the right thing knowing that they will have to explain their actions in a public court. Good luck and be persistent.

    I contacted the company the conversations went something like this. It's the abbreviated version
    1st call-
    Me: hi may I speak with the manager please
    Emp: may I ask who's calling
    me: ______name here___
    Emp: one moment
    placed on hold
    Emp: He's busy he'll call you back
    Me: Thank you. Also, let him know if he does not call me back by monday I will be filing a complaint with the BBB
    Emp: OK



    RING RING RING:
    Owner: Amanda, listen, I've looked top to bottom front and back and your saddle is lost
    me: pause...OK
    O: If you'll look at the bottom of the contract it says not responsible for lost or stolen items. So that's that.
    pause pause pause
    me: so you're not going to do anything about this?
    O: No, read the contract
    me: this is an unacceptable business practice. Not only do I find it odd that such a large expensive item has "gone missing" I have yet to receive an apology or any sympathy. I've already spoken with the local horse associations.
    O: mmkay.
    Me: You will be hearing from someone on my behelf
    O: right..OK

    ETA: I have since filed with the BBB, contacted an attorney friend of mine, and am about to send and email to the largest and most active horse association in the area.

    Wow. Really. How do you 'lose' a saddle.... its not like a small thing.

    Really, do they have you sign the receipt? Is there a part that says "Not responsible for lost or stolen items" that was pointed out to you and that you signed? Or is it like on the back really small where no one would notice?

    If the second is the case Id file with BBB and then file small claims court. That is NOT a good policy. They should have it very noticable or point it out and have you sign it. I really think even tho it says that you may have a case. Ive seen it before - I love judge shows... take em on Judge Joe Brown...

    Agreed with Audrey.

    If there are customers in the store, I like to keep my voice raised a bit (not screaming, but not a "polite" conversation)...you know...just to make sure everyone hears what is being said, but don't think that I'm coming off as a crazed bitch.

    Then, I like to say what Audrey says. Except I emphasize NOT...and I use my mommy "you're in deep shit" look...and if they keep trying to give me the run around, I'll slam my hand on the counter (to get everyone's attention and put the bs'er on edge) and say, "This behavior is NOT acceptable." Again, not screaming...but getting the point across.

    And, I would not give them any more time. They've had a month. Plenty of time.

    And, read that contract. Does it say that they are not responsible for lost or stolen items that they are consigning? Or that they are not responsible for lost/stolen items that have been left behind, etc? And, then look into the laws/rules/regs about that in your area. Just because you sign a contract, if the contract is not LEGAL, then you can not be held to it. Just because they say that they are not responsible for lost/stolen consignment items...doesn't mean that they're not. And, horse saddles are not small...how would someone steal it? Unless it was one of the employees...or it was sold and they don't want to pay you.

    Definitely contact everyone you stated. And in turn remind them that you will post this on every single online place you can.

    You'll either get a check or they'll "find" your saddle.

    Yea, theyll have to go through all their records and see if it was sold... It didnt just 'disappear' and is hard to steal so they HAD to have sold it or have an employee steal it. Its bs and the courts will see through it.

    So far, I filed with BBB, contacted my riding instructor who is involed A TON in the horse industry and requested her to pass on an email letter about how I was treated. Then I signed up to 1 site (will get to more later) and gave it a terrible review. I have a lawyer friend that could probably help me out as well.
    It says on the bottom of the paper, in no special font or titled disclaimer/contract, as follows:
    "Not responsible for lost or damaged goods.
    All items except saddles donated to charity after one year."
    It just sounds too loose, and not legal. I'm going to have someone look at it. Here I come Judge Joe Brown.
    I should give all the dancers on this site the number and my name..call and pretend they're from the area and how they heard about the terrible service I was given, and they're telling their friends too. WE'LL FLOOD THEM OUT!!!!!
    I hate people like this for real. I have good karma, and have done nothing but nice things to people. WTF did I do to deserve this?

    Oh I just thought of this. You need to file a police report. I would GO DOWN THERE and try to get it resolved. If theyre no help - again. Just calmly say "Im going to file a police report now." and go to the local police dept and file a report. It takes 5 minutes and will come in handy when/if you go to court.

    Not only that it doesnt sound legal. It may be BUT its a friggen saddle - its not something easily lost or stolen. AND why didnt they file a police report if they think your saddle was stolen because it certainly wasnt 'just lost'. THATS where you can get them. Ask them why if it was stolen they didnt file a police report and tell them that since they didnt do it that you are going to.

    I'm going to look into that. At this point I'm not going to contact then anymore. I'm going to speak with a lawyer of mine.
    Do I just call them and say "hey since the saddle is not in your possesion I am going to assume it is not in the building, which means it has been stolen by someone. Since that is what I am to assume I will be filing a police report for a stolen item."
    Do I even need to tell them that?

    Here's what I've done:
    Talked to attorney. Rec'd not yet reporting it stolen..I have 30 days and you want to hold that over their heads like a bargaining tool. I contacted BBB, and the county's consumer affairs dept. Both will act on my behalf to get this resolved. If they choose not to resolve then I have a SOLID case against them for fraud, and negligence. Their contract is barely, if even legal. It is so not well written or disclaimed. Also, if they claim it lost (it's too big anyways) they'd have to prove it. Otherwise they have to claim it stolen, in which case is in large part negligence for anothers property yadda yadda.
    I'll type more later. I'm going to take all this anger and turn into hustle.
