We drove out to NY from Indianapolis, brought out a good number of people for an out of town band, played a kick ass show, tipped our friendly bartender well, and left totally empty-handed.
At the end of the show we inquired about getting paid and were told to come back in an hour. When we did as we were told, the squirrely little manager dude said, "It all went to expenses." I said, "What expenses? Your tampons?" He didn't like that very much.
FUCK The Delancey. Fuck that place. And FUCK the 9 trillion shitty bands who are more than happy to play shows at popular, lucrative venues for FREE because they think this is all about some sacred brotherhood of the pick of destiny. Have some goddamned respect for yourself and your professional integrity or get out of the game and make room for those of us who have the fucking chutzpah for it.

I'm good friends of two local bands here in BFE and they get that alot. "We just did not make enough money at the door" is what they hear all the time.

Didnt you have a contract before you hauled ass all the way to NYC?? If you did...sue his ass. If you didnt...well..sadly lesson learned..dont EVER accept a gig(esp when it involves traveling) without everything in writing first.

^ It's tricky. Entertainment law is a beast all unto itself.
It's always best to come at it as a breach of contract, which would be a civil, not a criminal, action. If no contract/agreement was signed, it's makes it more difficult, but not impossible. Sometimes you don't even need a formal contract -- just an agreement to appear and some wording on how the agreement contemplates compensation. It's possible The Delancy itself might be on the hook, as it benefitted directly from the performance.
DR, can you give us any detail on the paperwork, if any, that you signed on this gig?
I have a few NY attorneys who I will call on this today and see what can be done. I'll report back soon.
