You should have stopped payment on the check but you've probably already come to that realization. I'd say call the Consumer Affairs Division of the District Attorney's office. See what they say and then you may need to report it to the police. Its important you go on record ASAP.

you said you've been dealing with the tenant so you're going to need to start dotting your I's and crossing your T's. there might be a situation between tenant and landlord and the LL's simply using your money to brace agains the tenant (maybe he/she's in arrears).
not saying the unscrupluous LL's right but i'm just saying that's how the LL might be looking at it. regardless, the LL's gotta return your money.
regardless, do NOT lease/rent from either of these jokers. even if it's resolved and everybody makes nice (smile, get your money, and run).

Send a letter (I forget what it's called... the sort they have to sign for) requesting your money back. Tell them that if they do not give you back your money IMMEDIATELY, that they will be hearing from your lawyer. (Scare the crap out of them... and go ahead and sue them for your money, any interest that you could have gotten from it, the mental energy and time this has cost you, and the lawyer fees.)

The address for his "company" is a PO Box though. Can you send a registered letter to a PO?
Do you know this person's first and last name? The police should be able to get that info through whoever registered them their PO box. I don't know what sort of red tape they'd have to pass, though.

Yeah, if I got here sooner I was going to say you have to go to small claims court. The police won't deal with it because it's a civil matter.

Send him a letter demanding your money back by certified mail when you do get his address, explaining that if he does not comply you will be filing a lawsuit (include any moving expenses, the court costs, and even the price of sending him the certified letter). I think you have to prove that you made an attempt to contact him (verifiable) before the courts will deal with it. I could be wrong though and you should probably ask them down at the courthouse if it's not too much of a inconvenience to do so.
I have a silly question. Did you write anything in the note section of the check? It could help if this bullshit goes to court.

Awesome! Marking the check (I'm guessing with "rent" or "security deposit") will be a freaking slam dunk if you have to take it to court. And it sounds like you will have to. Since you are in Jersey file your papers asking for THREE TIMES the deposit amount. You are entitled to treble damages ONLY IF you ask for that amount upfront. I successfully suded a landlord for my deposit but didn't know I needed to put the triple amount in my demand. I thought the judge would award me when I won. Don't miss out.

Aaaaand...if all else fails, contact the media. They love juicy stories like this. Especially on a slow news day. Brother of the mayor...taking deposits for places that are not vacant, not for rent, and refusing to refund.
I would just skip the whole, "I'll get my lawyer on you" bit and just pay a small sum to have an actual lawyer draft the letter using all kinds of nice wording and legalese.
I would also send a similar letter to the tenant of the place you were going to sublet. A nicely worded letter from a lawyer threatening legal action for breaking a contract would probably go over nicely.




If the check was to the tenant you would only be able to call the police and file a small claims suit. However since it was to the landlord, your local Fair Housing Authority may also be able to help. They are government backed non profit and specialize in landlord/tenant issues as well as discrimination. They may be able to give you some advice and possibly cite any laws he is surely breaking, and unlike an attorney they will not charge you for any advice they can give you.



$20.00 to file Small Claims Court. He doesn't show, you get a default and you can garnish. Slow, but you will get your money.

My bf wants to move in with his friend into some slum ass apartments (also in a college town) and the guy in the "office" is never there I've been standing next to him on campus and he answered the phone and told the person on the other line that he was at the apartments office a 20 minute walk away. He took the deposit but never called to have the lease signed, sooooo shady and irresponsible, but my BF REALLY wants to move in with his friend that currently lives there and has gone without AC in TEXAS for over a week.
I refused to sign the lease or make any payment to the land lord for anything. I told my bf that he will pay for me if he wants me there, because I can see this going so wrong. Can we say losing POWER for a week...yha....He's even regretting it now. Ridiculous.

That's awesome it was resolved so quickly. Most people suddenly cough up when they get served court papers. Good for you, ma'am. So where are you going to move now?

BTW, was the letter overnighted? I bet he waited until he got served, panicked because someone knew how to handle the problem and mailed it to you. He never would have if you didn't file, I'd put money on it.
