    American Airlines Over Peanuts
    Mother Says Civil Rights Were Violated

    MELVILLE, N.Y. (CBS) ? A mother claims American Airlines put her son in danger on a cross-country trip. That's because the 4-year-old boy is allergic to something passengers receive on almost every flight.

    Ryahn Khan has a life-threatening allergy to nuts. His mom is an ophthalmologist, his dad a surgeon. They always travel with emergency medication should Ryahn go into Anaphylactic Shock: suffocation triggered by airborne peanut or tree nut dust.

    And that is why they claim they made it clear to American Airlines, when making their reservations that their son and peanuts shouldn't mix.

    "I was told at the gate prior to boarding that there would be no nuts served on the plane by a gate agent who had checked the computer screen," Dr. Tehmina Haque said.

    It's a long flight from Kennedy International Airport to Los Angeles at 35,000 feet up. Ryahn's parents had traveled with him previously on other airlines, they said, where announcements were made and flyers posted, informing passengers to take reasonable precautions to keep nuts off the flights.

    "An allergy to nuts, whether peanuts, tree nuts or any type of nuts has been deemed a disability under the FAA regulations and federal code," attorney Kenneth Mollins said.

    An excerpt from the lawsuit reads: "...plaintiff's son who has a severe life threatening tree nut and peanut allergy is considered disabled under the Air Carrier Access Act, and must be afforded the ability to travel comfortably."

    They are suing because they say their son's civil rights were violated by flight attendants.

    "She was loud, sarcastic, belittling, and pretty much said: 'I do not care what you have been told up to now. I will be serving nuts in the main cabin,'" Haque said.

    Nuts were sold to passengers in the main cabin, served warm -- for free -- in first class she says.

    American says they try to accommodate all passenger requests, but there are no absolutes. They have no control over other passengers.

    "...We cannot guarantee customers will not be exposed to peanuts during flight and strongly encourage customers to prepare for the possibility of exposure."

    "I think they put a dollar value on my son's life," Haque said.

    She says the airline took a risk selling the nuts, but admits Ryahn did not get sick from the exposure.

    Ryahn's parents and their lawyer say if they win the peanut lawsuit every penny will be donated to The Food Allergy and Anaphylaxis Network.

    American says the company does have a peanut policy which is posted on its Web site.

    I myself have severe food allergies, and I know better than to place my trust in anyone else concerning these allergies. Recently on a southwest airlines flight, where they frequently serve peanuts, they announced they would only be serving cheese crackers because some kid on the plane had a peanut allergy. So I am allergic to milk, and had to go without a snack on the flight because of this. On the same plane the very flight before they served peanuts. Nothing was wiped down to get rid of any traces of peanuts. Basicly as a fellow food allergy sufferer I think it is stupid to fly if a person is going through a phase of extreme sensitivity. Also I hate the fact that those with peanut allergy's are catered to when there are many, many other food allergies out there. Because of this I think people need to be responsible for their own food allergies and what ever precautions ther need to take. I bet that mother suing American airlines did not take the time to wipe he sons seat down( to remove all peanut traces) before she sat him down in it. I know that parents of the peanut allergy kid on southwest did not. But God forbid anyone be responsible for themselves or their own children these days .

    The thing that puzzled me most about this article is why the hell the kid's parents added the "h" to his name.

    Maybe if they cared so much, they could have put a surgical mask over the kid's face. What if a passenger brought nuts for themselves that weren't served by the airline? If his allergy is that bad, fucking drive where you're going. Unless you seriously invest, I can't imagine expecting a full plane full of passengers and employees following your specific wishes. I understand his allergy is serious, but I would never expect a hundred people to be put out by me. I'd like it, but I'd never expect it.

    OMG, what a fat ass! Like that's a big deal, she had to sit through a flite without a G***damned snack?

    And maybe Rayhn's mom should have remembered to bring his protective bubble on the plane...the only reason I don't feel that bad for him is my ex boyfriend had the same allergy, and he was an internal auditor for GE, so he had to fly every one week to once a month... I just talked to him, he moved back to London but he's still alive 5 years later

    Frivolous lawsuit.

    As a parent it's her responsibility to care for her sons medical issues in a public space. If that means a medical mask or not flying then that is what she needs to do.

    I could maybe understand suing if the child did have an allergic reaction - maybe. But nothing happened?! Theyre suing over a 'could have been'.

    Thats like me suing any restaurant because my chili 'could have' had a finger in it. Or I 'could have' slipped and fell.

    WTF?! Wheres the rationale?

    Peanut Allergies
    American recognizes that some passengers are allergic to peanuts. Although we do not serve peanuts, we do serve other nut products and there may be trace elements of unspecified peanut ingredients, including peanut oils, in meal and snacks. We make no provisions to be peanut-free. Additionally, other customers may bring peanuts on board. Therefore, we cannot guarantee customers will not be exposed to peanuts during flight and strongly encourage customers to take all necessary medical precautions to prepare for the possibility of exposure.

    1) shes too big to be wearing that underwear...if the one they show in the video is the actual one...its like 10 sizes too small for her. NO wonder she broke it. Shop at Sears honey..they have your size

    These people are assholes.

    I was once on a flight where the entire group of passengers was denied biscotti because some douchebag on board had a nut allergy.

    That family should have taken a fucking Greyhound bus (or brought a filtration mask) if their kid was so severely allergic.
