    Default Copyrights?

I'm recording some videos for my webcam work. Does anyone know if it's illegal to have music playing in the background? I heard it was, but that could just be catty girl talk. You never know.

It is likely to be a copyright infringement, yes. Its also why porn soundtracks are generally so crap. Producers aren't willing to spend the cash required to license quality music.

There was also this famous incident not too long ago, about a baby dancing to one of Prince's songs in a Youtube video.

If you're making any sort of monetary gain off of someone else's work, then there is infringement. It is possible if you don't have the entire song, then you may not be in violation, but this is most certainly worth investigating before you run into that situation.

Copyright infringement doesn't require making money

Radio stations can play a song for 30 seconds, after which, the station has to pay the record company.

I'm guessing something pretty similar applies.

But if you don't make money, they can't collect damages. The most they can do is order you to cease and desist.

Why not get access to a Mac, get Garageband, and make your own driving techno beat song? It is not hard to do, and you don't need Grammy quality music for a background to your porn film.

PC people, is their a comparable product for Windows users?

Or get something from a place like this: http://www.partnersinrhyme.com/pir/PIRsfx.shtml

That is the first hit on Google, where I searched for Public Domain Techno Music.

So far as I've ever found, when in doubt, get the rights.

Actually, with copyright infringement, there are statutory damages if it is a registered work--and almost all music is registered--which can be as much as $150,000.00 per infringement even if you made no money.

That is why the RIAA was able to sue thousands of people who merely downloaded songs to their computers for personal use and get them all to settle for a few thousand dollars.
