Default What Is the Right Way to Handle This Situation?

I live in a triplex. My neighbor in the middle unit has 3 kids, and also the house next door has kids as well.

Now normally i don't have a problem with kids or my neighbors. But i have a serious issue with my neighbor AND her kids!

The mother: SCREAMS at her kids everyday. Yells at them from inside the house. Yells at them from her car. I mean this woman is constantly yelling! And to make matters worse.....

The kids: Screamers as well! I think they learned it from their mother, because they scream all the time right outside my window. I know kids play, and a little screaming intermittently is fine. But this is constant. To the point where naps aren't possible and studying is getting impossible as well. And it seems ALL the neighbor kids hang out in MY yard instead of their own. And I can't do a thing or they become more obnoxious, and some are older kids. Just now I finally got frustrated and went out and said "PLEASE stop with the yelling."

    And guess what?

They moved closer to my window and screamed double the volume!

    This is ridiculous.

On one hand I want to file a complaint with the property management.

On the other hand I don't want to piss off the mother. Sure, it's anonymous, but I have a feeling she'll know it was me who filed the complaint because the other neighbors don't seem to be home much. I'm also afraid she'll start some kind of retaliation and/or get her kids to do something. I've also only asked the kids to tone it down 2x in 5 months, but still it's more than the other neighbors because they don't play in the other neighbors' yard!

I have no way of knowing if she'd do anything because she keeps to herself.

What should I do? I want to study! I want to sleep!

Contact your landlord or leasing office about this. You have a reasonable expectation of peace and quiet and they are responsible for that. If your neighbors are that disruptive, I'm sure you aren't the only one with a complaint. But be careful about saying anything to the woman or to her kids. People like that get psycho when it comes to their kids.

I'm afraid that she'll file a complaint right back if she suspects it's us that did it. Like if we yelled ONCE for a brief moment, she'll claim what we did was something that we did all the time (constant noise disruption). Will landlords really know the difference between legitimate and retaliatory?

Honestly I have no idea what my rights are with renting as I've always been in house

Take a look at your lease. Your rights should be detailed on there. The landlord should be able to talk to your neighbor in a way that won't make it obvious that you made the complaint.

tape recorder or video recorder. do it for a week then make your complaint.

In your yard screamin? Can you set up a sprinkler? or is that not possible this time of year. They do have those sprinkler attachments for chasing away dogs from your yard. Swivels towards movement and sprays until the offneder moves out.

Document with video then call the cops. or kick the mothers ass...............

I seriously doubt the cops would come over for a noise complaint. I have heard that many times people have called an nobody came so people called back and were told TPD was too busy to come out for simple disturbances.

Plus my front yard is rock; it would get too muddy with a sprinkler. I also seriously doubt the kids would be stopped by a sprinkler; they are constantly playing with the water hose in bathing suits to cool off!

I think you DO need to talk with the mother, because if you file a complaint with anyone, one of the things they will ask you as if you tried to work it out with her.

But do not do this by yourself. Take someone along. If possible, take someone who looks highly respectable. Like when I went to confront AAMCO transmission, I took along an intern pastor from my church, who wore his clerical collar. He nver said a thing, just stood in the background.

But even if you don't have nayone like that, take along a second party who can be a witness in case she decides to say you attacked her, etc.

Make "I" statements rather than "You and your kids" statements. "I feel like I can't ever sleep or study because of the noise in the yard. My work and my grades are suffering because of this. Couldn't we negotiate some quiet time when I could sleep or study?"

I don't know about the mom, but you can get rid of the kids by buying a Mosquito noise maker. Only kids can hear it and it is very annoying like fingernails on a chalk board.

Or you could place speakers by their window and play the recording of their own screaming at piercing decibels all night long. They would sound real funny complaining about themselves screaming as a noise complaint .

Call the council and report them as breaking sound laws. Sounds like your neighbours kids are just like my neighbours dogs.

I think you should talk to her first if you think she seems like a reasonable person. Some people would much rather hear from you first rather than have a mark on their rental history. She might not realize what a nuisance her kids are being. If she won't cooperate with you, go to your landlord.
