    Default Restraining order

I used the search function to research restraining orders, but my specific question was never answered.

It's clear that they will likely be issued if you are in physical danger.

The legal language is ambiguous about whether a pattern - or a few repeated incidents - of verbal abuse and bullying rises to the threshold needed to get an order. Can anyone tell me experiences with getting or not getting an order on that basis?

    Thanks.

It's different in every state. Some places it only needs to be someone who has threatened you, other places you have to have lived together or been married, some places there has to be a police report of assault. Call your local womans shelter during the day and ask to speak to the victims advocate. They'll know specifically for your area.

    ^Thanks Lena.

I did more searching for PA and found something here: http://chat.lawinfo.com/.

There is actually an HRO - harassment restraining order. Never heard of it before.

This site didn't help me specifically, but it's a great resource. I'm happy I found it: http://www.womenslaw.org/

Oh, you're in PA. I was a child advocate there a few years ago, so I know a little about them. They are called PFA's, Protection From Abuse orders, and they're harder to get than in some places because you have to live with the person or prove that you've been fucking them. Here's some info: http://www.womenslaw.org/laws_state_...&state_code=PA

It also really depends on the judge.

    Thank you both.

Also, I figured if there was an incident, the best thing to do is call 911 and ask the police who arrive to start the paper work for an order?

You go to the court house and fill out a complaint. Then they give you a 7 day temporary restraining order until your court date. (That is given no matter what.) If there's been any physical abuse what-so-ever that's usually grounds enough for a restraining order. Statements or threats have to be very direct.

When you fill out the paperwork, try to keep it to the facts and include EVERYTHING.

Also, it would be wise to follow Lena's suggestion and get a victim's advocate. They can advise you too and may know more about the laws and the legal system in your area. Hope that helps!

LuckyOne, great advice. Thanks for sharing your knowledge. The particulars of this stuff are entirely new to me.

I would not have thought of the advocate unless Lena mentioned it - thanks again!
