    idk... but I totally sympathize. I moved out of my apartment june 13th, and a month later, I have yet to see my 700 fucking dollars. I have called LL 5-6 times and he just tells me every time, at the end of next week i'm going to try and get it in the mail... blah blah blah. There's already a new tenant in my old apartment, it should be no problem. That reminds me... I need to call him today.. it's been 4 days since i called him last.

    landlords suck. next apartment i'm in.... i'm going to try my hardest and just use my deposit as last month's rent, b/c landlords are money hungry assholes for the most part.

    You send a letter certified mail stating the facts of "moved out of apartment on x/xx. Was told security deposit check was mailed x/xx. As of the date of this letter, I have not received the check. I am formally requesting a replacement check be mailed certified mail to x address by x/xx. If check is not received by x/xx, I will be contacting a lawyer and/or the local housing authorities. Please help me to resolve this amicably by sending the check as soon as possible (or providing the tracking information if the check has already been sent. Thank you." Or something close to that.

    I believe most landlords have up to 30 days to mail a security deposit check back(depends on local laws). However, I do know that it is ILLEGAL for a landlord to not have the security deposit sitting in escrow. They must be able to refund you your full security deposit when it is due, or they will get into deep shit since it is considered theft (I believe). It is not their money but a collateral which is refundable once the lease expires and the property is left in acceptable condition.

    I, personally, would not go by the complex and confront him. You need a paper trail documenting your attempts at contacting him. This is extremely important. Keira, I would say the same for you. Stop calling him. Send him a letter and threaten legal action if your deposit is not received by August 13 (give them a little more time, but not too much).

    so wait.... legally they have up to 30 days??? well then my LL's 30 days was up July 13, a week ago. Should I give him more time or just send a letter? I called him today and he said (again) he is going to try and get it out by the end of next week because he's broke... well to his knowledge I'm a pregnant teenager w/ a good for nothing abusive boyfriend, and you would think.... he would send it ASAP.

    ^ Well, it varies by local laws, but overall, I believe the "average" is 30 days. Him being broke is bullshit. A security deposit is NOT for the landlord to spend. It is SUPPOSED to go into escrow. I know that your 30 days has passed, but since you've only been calling him...you need to send him a letter giving him your current address, etc, etc, etc. This way it's in writing and he cannot say, "I wanted to send it, but she left no forwarding information". You will have proof that you gave him your info and he read it (by sending it certified mail).

    You may want to consider filing a complaint with your local housing authority (you'll have to find out who handles this stuff between landlord/tenent, etc). They absolutely cannot co-mingle security deposits with their own money. It's illegal...completely...and they can get into big trouble (fines, etc) for doing so.

    Venus Goddess is right....have all communication go through certified mail, and make sure someone at the LL's office/residence signs for the letters. Also keep copies of the letters that you send so you will have explicit proof of your efforts to resolve the situation. If it comes to court, the evidence will then work in your favor. If they keep the deposit beyond 30 days, your state might award you punitive damages. If you're allowed to record phone conversations (1 party consent states), record the landlord if he calls you. Some are hesitant to communicate in writing even though you send certified letters.

    After you get the deposit, review the apartment complex or building on apt review sites so others will be wary. Hope you get the deposit back!

    SHANGHAI: South Korean man Kim Soo Seok, 44, faced a trial Tuesday at the Shanghai No 1 Intermediate People's Court for kidnapping, together with his two Chinese accessories Jin Mingyu and Chi Minhao who were charged with illegal detention.This is the first kidnapping case involving a foreigner in Shanghai.Kim was accused of plotting to kidnap another South Korean man and demanding a ransom of 300 million won ($295,000), the court was told Tuesday.On December 24, under the order of the second defendant Jin Mingyu, Chi Minhao, a 29-year-old Korean minority from Jilin province, contacted Jean Moon Gyun, a 23-year-old South Korean studying at the Shanghai University of Sport.Chi told Jean that a friend of his father's was visiting Shanghai and wanted to meet him, the prosecutor said.Jean's father, Jean Sam Duck, is the president of a taekwondo association in Gyeongsangnam-do, a province in the southeast of South Korea, and owns several properties, Kim's attorney Yin Yongyu told China Daily. Jean Sam Duck also has a fast food business, Kim told the court.Jean Moon Gyun arrived at a coffee house in the city's suburban Minhang district that evening and met Chi, and was later taken to an apartment nearby.He was detained by force until being released by police on the afternoon of December 26."I have never attempted to insult him or hurt him physically," Chi told the court.During the three days, Kim called Jean's parents back in South Korea and told them he had their son and wanted 300 million won.The parents called the Shanghai police. In stead, Kim, who get to know him by attending some taekwondo activities, had asked to borrow 15 million won from him in last June but was refused.No verdict has been announced yet
