    Default Will they be hesitant to refund my money

    I've been doing a little too much online shopping since I delivered. And maybe about three weeks ago I saw this charge on my account that made it negative and had an overdraft fee. I got them to refund my money and the overdraft fee. Last week, I noticed there was this fraudulent(sp) charge for a grant search on my account which put me in the negative. I went to file an affadavit but all they did was make that company give me my money back but did not refund me the overdraft fees. I didn't realize this until yesterday. I got my debit card cancelled. I have no money in the bank so I really don't check my account that often so I checked it and that was when I realized they didn't refund me the overdraft fee. And I noticed several other charges that all incurred overdraft fees. These were with the same company as the first one. I looked it up and there is a scam report on them. Since I have been having all these issues will the bank give me a hard time about refunding me all these fees? The account is about 300 some odd dollars in the negative. BTW, I may even change banks but I don't know cuz it was not their fault that I got scammed.

    unfortunately, from the viewpoint of many banks these days, an overdraft situation did exist. Even though the overdraft was due to an improper charge being made against your account, an overdraft situation did exist. Thus the business that caused the improper charge can claim they have no responsibility in regard to refunding an overdraft fee, and the bank can also claim that they have no responsibility to waive the overdraft fee since an overdraft situation did exist.

    that's what i'm thinking. i'm kinda screwed unless i can find a bank who will approve me within the next few days

    Who do you bank with? Mine cancels/reverses any fees that are tied to an improper charge so long as there is documentation to substantiate the claim.

    I would think that the bank would refund any and all charges that is tied to a documented and proven "illegal" use of your card.

    Someone got a hold of our card number several years ago and wiped our account out of a couple thousand. We did get hit with a few hundred in overdraft fees and as soon as it was proven that the account was compromised (the card was used online and had a Brazil IP) the bank refunded everything...in fact, if you read the TOS for the debit MC/Visa, it should say what it covers in the event that something like that happens.

    Call your bank...I think it will be hard to get an account anywhere else when you have such a high negative balance at your current bank...not sure if that is reported immediately or what...but good luck.

    Read the literature your bank sent you and see what they say about false transactions. Bring it with you to the bank to support your claims.

    I would talk to a branch manager....sigh.

    I canceled with a debt collection company and they kept trying to take the money out of my checking account anyway and I incured many fees. My bank said it was not their error, so they did not refund the money and to take it up with the company.

    That said I am a habitual over drafter, so maybe that's why

    I just recently had a similar situation happen to me. It was a company called Reservation Rewards. I had to file a fraud claim right away. They did an investigation and refunded my money. They didn't refund my overdraft fee, so I called up the claim company and told them that I got my money back for the fraudulent charge, but my overdraft fee that occurred because of that fraudulent charge was not refunded. The lady asked me for my account info and saw that I was telling the truth. It only took a couple of hours for them to refund the money back into my account. So, I would do the same thing if I were you. You need to file claims for ALL the fraudulent charges and then if they don't refund your money, you tell them you only got the OD fees because of the fraudulent charges and you want it refunded. If you file a claim for fraud and you occurred over draft fees because of it, they do indeed have to refund the money. It was not an error on your behalf and therefore it needs to resolved properly or you take your business elsewhere and report them to the better business bureau.

    Used to work for Bank of America. In the case of fraudulent activity on your account, if the transaction is found to be fraudulent that and the overdraft fee would be refunded, and any other ODF's that occurred due to the fraudulent transaction.

    Anything that is not your fault should be refunded, no questions asked. If your bank is not willing to do this, find another bank.
