    Default TV and your rights.

    So since Monday Ive had dozens of messages from friends and random people on the internet to say they saw me dancing on tv with the female review I toured with recently . A film crew were filming a documentry about the boom in a Western Australian town in the venue we were performing at. 2 of the other girls flat out stated that they didnt want to be filmed at all and they were on tv too which is really fucked, there was a close up shot of the face of one of them also. The rest of us agreed to having certain segments of the show filmed which the film crew ignored. We then said we didnt want any of the footage to go to air and were told by the producer it wouldnt. None of us signed anything but we realise there are grey areas of the law where tv shows can do what they like. We just hope none of the other footage is shown at a later date. I dont think theres anything any of us can do, but I thought this was worth sharing in case anyone else is ever faced with this situation..

    Ok having not studied media and broadcasting law my knowledge here is limited.

    However documentary type filmmakers are required to have you sign a release if you are speaking on camera. that is an absolute necessity. There is no such requirement at public places if the people are just in the background.

    HOWEVER there is a requirement for people int he background in sensitive areas - he example given was gay clubs but obviously strip clubs would be considered sensitive to sign a release.

    they absolutely should have had you sign a release.

    If you want to pursue the matter I would say first point of contact would be the network on which the program was broadcasted.

    ...because, in effect, you guys did not speak on camera then your rights were reduced A LOT. All I know is that whenever there has been anyone in any capacity to film me, I've always had to sign a release.

    I would take this up with the network the programme aired and tell the other girls (and the company) about the use of the footage in the film so they all can air their 'gripe' with being used in a commercial manner without being re-imburst (or even having to sign a release allowing their image to be used in such a way) too.

    May not be much you can do now that it has aired (thus the damage is done)... however better late than never?

    I don't know if a bar is consider private or not. The girls gone wild videos get away with filming these things and not paying the girls because they are in public on the street or public beach.

    But they DO make them sign a release. If you did not sign a release,they cannot use your image for profit(aka..selling it to a network to be aired).


    I'd contact the network and a lawyer.

    Thanks Jai, I shall get back to you later as Im about to fly home.
    I spoke to someone who is in one of the performing arts unions and they said that theres a grey area of the law where if the footage is used in a so called 'public interest' story then basicly they can use whatever they like. It was a current affairs programme so... Also they said that if the venue or my boss had signed a release as a company that we were working for or under then too bad also.

    That might be right then. You could call the network and complain about it. I definitely think what the did was wrong esp telling u they wouldnt air the footage which seems to have been an outright lie. Def not ethical practice.
