    Default Should I sue?

    Should I sue a club that won't let me work there, but is still using my picture and photos I took for them for advertisements?

    I started to freelance at a club I had been on schedule with for nearly 2 years. A few months into freelancing - doing a few dayshifts a week - I started working a new club and showed up at the old one less. About 2 or 3 weeks ago I called the club asking to come in and they said no, they were set for the night. But then a friend told me they were short on dancers that shift

    So I called the GM and asked him if I could keep freelancing there. He said, "No, you've made it clear you don't want do dance anymore."

    I'm not sure what he wants. Me on schedule, quit my new club, or stay out. But at any rate, MY PHOTO and pictures I took for him are still promoting a club I'm not allowed at. I haven't brought that up with him because I would still like to work there every now and then. I'm pissed. And confused. What should I do? What the fuck would you do? Is it worth getting lawyer involved in?

    Never signed a thing. Just looked at it as an extra-cirricular activity for the club.

    Ultimately, no. I highly doubt it esp. considering there was no written agreement in place of any kind in relation to you working there and the link with the photos/your image being used to promote the club.

    This is why I won't do anything of this sort of with any club as they can use your image/photos forever and may do so... long after you have left this business behind.

    Take it as a lesson learnt: you have to pick one club over another. Not many clubs will willingly allow you to work multiple clubs unless those other clubs are "sister" clubs.

    Even tho' we are ICs, this is the way it is...

    ^^^This is untrue. They fucked themselves by not getting a model release. Without that signed release you can ask them to pull the photos at any time. If they refuse, they are violating a body of law that has been established through court precedents called "right to privacy". In general, one cannot publish someone's image to endorse a product or service without first geting a model release, which is usually a contract between the publisher or photographer and the subject. As far as the law is concerned, you never gave him permission to use your photos in the first place, if that makes sense.

    For the record, it is legal to photograph anything that can be seen while standing on public property. That's why it's legal to post topless pics of celebs in their backyards. Also, the precedents are a little more lax with public figures, dinstinguishing them starkly from private citizens. These photographs were taken of you, a private citizen, on private property, and used to advertise a business...

    If this means enough to you to proceed, the law is on your side.

    Whew. A fucking A in that grueling Communications Law class and I don't think I've ever had a chance to use it!

    Ask the club to stop using your images and point out the fact that u never signed anything. If they don't, ask them again and threaten legal action.

    well u cannot demand to work at the club, no dancer has a right to work at any club as we are not employees.
    all u can do is ask them to stop using the images. you cannot demand payment for photos you already allowed them to take as there is obviously not contractual arrangement.

    Yes, if you never signed anything, then they cannot use the photos. Tell them to stop using the images.

    Write a cease and desist letter. Save a copy. If they don't take your pics down, the case is yours.

    Yep...a club did this to a friend of mine.She sued and the pics were pulled. If you didnt sign a release...they have no right to use the images.
