    Default Can I have things removed from my medical records?

    So...I got a new caseworker today and I had to go fill out all my 'treatment plan' paperwork. Whatever, every time I get a new caseworker they do some version of that. Everything was fine until she gave me a sheet of paper that said what my diagnosis is. It was SO wrong. It was filled out by a doctor that hasn't seen me in 3 1/2 years, and when he was treating me it was for 3 months. He and I REALLY didn't get along and he was part of the reason I spent more than a month inpatient back in '05.

    The stuff that is on there is like....not true. My current doctor has given me totally different diagnosis & treatment, but my caseworker somehow doesn't have any of that paperwork. She told me I can get the new diagnosis added on, but that I can't get rid of the stuff that's on there that is totally wrong.

    I wanted to cry and walk out, but I couldn't, so I just sat there for an hour while she went through everything else. Then at the end I had to sign my diagnosis page even though it was wrong and I said so. She told me if I get it updated she'll change it, but until then I have to just go with what's on there. Is there really nothing I can do to get stuff taken off, especially when there is no evidence of me ever having those things?

    Sounds like this is a state issue, not medical records per-se.

    I would check with the executive office at the state level, IE call, ask someone at the state office, not the case worker. Explain the situation, and, see if your new doctor can write something.

    Also I would suggest asking your new doctor to state that it is his professional opinion that you were mis-diagnosed under previous care.

    Thank you. I'm gonna ask one of my doctors what he can do. He's normally good at helping me out when it comes to stupid bullshit.

    I disagreed with a diagnosis and wrote a letter stating my position and why to all doctors involved via certified mail (btw, this was rheumatology, so I'm not sure if mental health is a whole 'nother story). It was important to me that the record reflect as much information as possible. I pointed out that the basis of the previous diagnosis was never noted, nor were appropriate symptoms that would merit such a diagnosis.

    In your state, there may be special laws pertaining to mental health records.

    I think people make such a huge DEAL over hte medical record, and its really stupid and inadequate.

    When i was first going about getting school support for my tendonitis, i was required to show the part of my record pertaining to it. It took me two months to get he paperwork from my dr's office, for hte visit in which i was diagnosed..... And what did i discover? TWO PAGES of paperwork, in which the dr documented asking me about my sexual activity, and depression history, and suicidal thoughts, etc. WHen i'd GONE IN for pain issues, and there was ONE SENTANCE on my tendonitis.

    Needless to say, the school deemed this to "not be enough proof" that i warranted special needs assistance, and i had to spend ANOTHER two months gettin the dr's office to WRITE about it on my record(since i'd seen them for it for YEARS, yet it barely made it on my record! WTF?!)

    Best thing you can do is to deal with your current dr. Ask them to state that it was previously diagnosed as xxxx but they feel it is yyy in light of zzzz info, and provide that for your purposes. Hopefully that should clear it up. It may just take going down to sign some things, since they cant release it without your signature. (this was the time consuming part for me, since i lived cross country from the dr where i grew up, so i obviously couldnt just go sign a paper.) Oh, and the certified mail with YOUR side of the story would be another good step.

    I'm so gonna call them on Monday. The place that does my case management was more concerned about me just signing their forms and getting me out of there, so they weren't all that helpful with helping me figure out what I can do.

    I am starting to feel bad for the people that have to be my case managers. It's always a brand new hire who has never dealt with mental health stuff before, and somehow I get dumped in their lap. I know as soon as they see 'problem patient' they have an awful perception of me, and I really am not that bad most of the time.

    maybe you could also ask your Dr. to ask them to change it to "Frustraited Patient".....you know.....to get the point accross to them

    Gosh I'd think you could at least add a statement PRIOR to signing to point out what you disagree with on the records and why.

    I don't have any real advice but I did want to give some support because it all sounds so wrong. I hope you get it worked out soon.

    Since 2003, there are national standards which protect the privacy and accuracy of your health records. Under HIPAA (the Health Insurance Portability and Accountability Act), you have a number of rights--including the right to have information regarding your medical and/or mental health corrected.

    If you visit the HIPAA website (), you will find a link titled that contains a helpful brochure, particularly the section "The Law Gives You Rights Over Your Health Information"...

    Here in TX a patient can request information to be changed in their medical records so like everybody else said just contact the state. Good luck!

    I guess I'm naive, but I don't get why it matters. I've had numerous sypillus tests come back positive (upon further testing, I do not have it and they don't know why it says I do) but since my medical records are only accesses by me and my family, does it really matter? Can other people get to those records?

    It matters when people are looking at past treatments and their effectiveness and what you've been diagnosed with in the past.

    What I find odd is that half the posters in this thread have been banned.
