    Default Legal question

    So I have/had a heating pad. I had it for a cpl years...no receipt. It has a code on it that basically assure that it will never burn. Yeah well it did. I had it on my sore neck one day and it suddenly burned through...the core, the fabric cover, my neck AND there are burn hole in the pillowcase and pillow I was resting against.

    It really freaked me out. If I had happened to fall asleep(which yes you should never do with a heating pad on,but I'm sure it happens) I could have been seriously injured. My house could have burned down.

    What are the odds I'd win in a court case?

    Why sue? Why not contact the company and see what they say?

    I had a blow dryer blow up in my hand, burning me. I contacted the company and they made it up to me.

    Litigation should be a last resort. I think it hurts society as whole to get so litigious .

    Honestly...because I cant find a company name on it,a lot of the words were burned/melted off. Or I would. I figured an attorney would research and figure out who it was.

    Edit...I found it! Its a Sunbeam...I sent them an email...we'll see what they say.

    Sorry to hear that. I guess you should count your blessings that you were not hurt.

    But, to answer your question, I'd guess your odds are pretty low. Although I do not know the law in the "in my head" jurisdiction, unfortunately, I pretty much agree with Rooster -- in order to recover damages from a manufacturer, the product must have caused you some injury. Aside from the pillow and the product itself, there is no injury here. You freaked out, but unless it caused you some psychological damage, you probably wont recover on a NIED claim either.

    my curling iron exploded in my hand one day...but i think that was a power surge at the club, not the curling iron's fault...

    but yeah, I agree to contact the company. I dont think you could sue on what could have happened...only sue on if your house did burn down because of it, or if you were burned because of it.

    sunbeam has been around for a long time (remember the mixmaster?) and while some of their production values have been shipped offshore (and down the river), they are mostly a company interested in maintaining a good name.

    write them a good letter and see how you go from there.

    Thanks everyone.I was burned,but it has healed and I didnt take any pics...dumb me.

    I found a place to send a message to the company...hopefully they will be cool about it.

    Just really sucks....it was a REALLY nice set of red sheets hubby got me for Christmas(I've ALWAYS wanted a nice set of red sheets/comforter)...of course THATS the pillowcase that gets ruined.ugh

    My uneducated opinion is that it doesn't sound like you have a case. No proof of injury, and there is probably something in their 20+ page instruction manual that you violated. Not that it's your fault, but I think most companies know how to protect themselves.

    I have a hard time understanding the whole sue-happy approach Americans have. I'm not necessarily critical of it, but everyone I know personally (Canadians) would respond by contacting the company. I don't get the whole sue thing?

    Good luck dealing with the company. I hope they are able to deal with the issue properly and ensure that this doesn't happen to anyone else. You were lucky.

    For the most part it's people looking to make a quick buck, but in some cases people really do have experience an injury and the company won't help so they sue.

    Yeah I'm not litigation happy. I'm just thinking ahead in case they dont want to help me. The only other lawsuit I've ever thought of was a club which BELIEVE me..deserves it(and I wouldnt be the first to sue them...cant believe they are still open)

    So please dont label me as sue happy just because I asked a question.

    And the other lesson is get documentation. If something like this happens, take pictures ASAP. That would be helpful in court or simple customer service complaints.

    Yeah that was stupid of me to not document my burns...duh. I know better too....I was fucked over by a tanning salon when I first moved to FL. They were supposed to put me in for like 5 minutes (I was REALLY white and had never tanned before). They put me in for 20 minutes at the highest setting...I had 2nd degree burns over 3/4 of my body and New Years Eve was ruined because I couldnt go out. I couldnt even wear clothes I was in so much pain.

    Didnt do anything about that either..and yes the tanning salon is still in business.


    So I'm just stupid and I keep getting burned(literally and figuratively!!LOL)

    I believe that you have to prove actual damages, not just potential damages.
    I loved going to strip clubs; I actually made some friends there. Now things are different for the clubs and for me. As a result I am not as happy.

    Customers are not entitled to grope, disrespect, or rob strippers. This is their job, not their hobby, and they all need income. Clubs are not just some erotic show for guys to view while drinking.

    NOTE: anything I post here, outside of a direct quote, is my opinion only, which I am entitled to. Take it for what you estimate it is worth.

    They just sent me a new one for free. They asked if I wanted to fill out paperwork to claim the other damage but I didnt think it was worth it.

    You had high thread count designer sheets and you have to get the smell of smoke out of your drapes. I think they will send you a few hundred with no questions asked especially now that they sent you a new pad. Keep your request below 1K and you may get it for the cost of a stamp.

    I"ve already turned it down..there was no smoke smell and all the was ruined was a pillowcase and pillow.SO not worth it
