Default MOLD in my apartment! Rant/need advice...

I'm so PISSED right now! Sorry this is so long....

I've been living in my apartment in FL since April (8 months). Before moving in, I never got sick. Maybe once or twice a year. Well, for the last 6 months, I've been sick no less than 9 times. Colds, sinus infections and other upper respiratory problems. I've been to different doctors trying to find the underlying problem, all of whom said maybe allergies. When I told them I have never had allergies, they all said I was just getting colds.

BULLSHIT! A few months after I noticed a very small black spot in between my wall and floor boards in my living room, and realized it looked like mold. One of the maintenence guys was in my apartment, and I had him look at it. He basically shrugged it off and I didn't think anything else of it (stupid, I know). After being sick so many times, I had a little theory... So, I went into the office of my apartment complex, and told them that I think my apartment has mold. I also mentioned that I had been getting sick and thought it might be in my AC unit. Then went to Home Depot and got a mold detection kit.

They sent in the same maintenence guy, who left this note: Cleaned out drain line from AC unit- Touched up stained areas. I saw him when he was leaving. He covered the small mold spot with normal paint- no Killz... nothing. So I used the test kit, and SURPRISE, SURPRISE, I have slow growing mold in my apartment A/C. Which means it is virtually everywhere (in the air).

    Has anyone gone through this?
Might I be eligible to get back rent?
Should I move into another apartment in the same neighborhood (love the location, not bad price for the area)? I

have heard of cases where this has happened that people have been paid back wages for days missed at work. I can't count how many days I've missed from being sick since move in. Since I am a dancer, I this will not apply to me, correct?

Hopefully someone can help! I'm bringing in my mold kit and maintenence records along with pictures to the management office in the morning...
    TIA

This happened to an ex of mine, you're going to have to move out- and fast. Maybe the landlord can move you to another unit while yours is being treated.

You need to contact an attorney or a Legal Aid office if you cannot afford an attorney to see what your tenant rights are.

Black mold is extremely dangerous and nothing to be taken lightly.

    Best of luck to you.

mold is an alergen, nothing more. It won't kill you. That said, if you are alergic to it, you'll have to move out until it is cleared. It is a result of moisture. Get rid of the source of moisture and it will dry and go away.

    Good luck.

Just so ya know, certain types of mold are extremely dangerous (black mold can actually be fatal in very rare cases), which is why I am so concerned. These are some of the issues that come with mold:

Allergic reactions including runny noses, itchy-watery eyes, coughing, sneezing, throat irritation, and exaserbation of asthma.
Non- specific health complaints including headaches, decreased attention span, difficulty concentrating, and dizziness.
Serious or life threatening disease normally affects people with abnormally functioning immune systems or under very extreme conditions, rare cases of respiratory arrest, organic dust toxic syndrome, hypersensitivity pneumonitis have been reported and neurological effects.
Mycotoxicosis poisoning caused by ingestion of a mycotoxin.

Shortskirts- Do you know if your ex had any allergies/health issues when in the apartment? Or if they went away when he left?

make sure it isn't black mold. i used to get majorly sick cleaning up the basement at my mom's house. there's a couple drains in the floor, so it would get damn and moldy a lot. ugh! i think bleach is supposed to be good for cleaning it up until you can get a professional to check it out

Angelicat: yes my ex had sinus problems when living in that house.

He moved out, they fixed it, then it came back and he moved out permanently.

There is a wealth of information regarding black mold and the health risks associated with it online, I found them through my friend, Google.

Get out as soon as you can!

My husband and I dealt with it when we lived in Miami. It didn't do much to me but boy, my husband was like another person. Soon as we moved out in to a nicer place he was back to normal and hasn't been sick or anything since. We should have moved out sooner.

this is just a combination of everyone else's suggestions, but contact a legal aid with the results of your mold kit, as well as any documentation you have (paperwork you filed with your landlord, a copy of the mold inspector's results, whatever you've got). find out if you're eligible for back rent, what your other options are.

then contact your landlord, let them know about the documentation you have and that you've spoken with legal aid and would like to talk to to them about your options, either back rent, being moved, being allowed to leave your lease early but still retain your deposit, whatever you can get. if they are unresponsive, contact the housing board, city hall, whomever the complaints are best addressed to.

also, i don't know if this is true in all areas, but in my city if you have a problem you're trying to fix and everyone ignores you, they have a whole section of the local news that you can go on and talk about it. a sharp wakeup call to your landlord for sure.
