    Default Lawsuit against manager?

Hi everyone, I'm not sure if this is in the right section or not, but here goes. A few weeks ago, I had an incident with my manager at the club I was working at. Here's what happened: I was just getting off stage, and I took the long way around to talk to customers on my way. (I'm a minor, so I can't actually stop or sit down, I have to keep moving all the time, which I was.) I made a little quick smalltalk with a big group of customers when I heard my manager call my name. I looked up, made eye contact, he pointed to the office, and I nodded. Then I turned back to the group, and started my speil 'I gotta get off the floor cause I'm not 21 yet teehee blah blah blah' then, in mid- sentance, my boss grabbed me by the arm and physically dragged me into the office. (apparently he thought I ignored him and he got really mad)
My question is this: can I sue him for grabbing me like that? I mean, if we were working in a store, restaraunt, or office and he did that, he'd be gone already wouldn't he? I know that you can get a public attourney for free if you're being prospcuted, but would there be any way for me to get free legal representation? Any help or thoughts are greatly appreciated!

As much as it sucks, unless you have proof he did this : witness, bruise, video recording, etc. you won't have much to go on. your word against his and if you didnt file a police report right after it happened, you have even less of a chance.

I would complain to the hirer ups and if they don't repremand them or if you lose your job over it you could have a case.

Yeah my first question would be do you have a bruise or anything? Then secondly, was there witnesses? Any other dancers, bouncers, customers that might have seen it?

Also what are the laws in your state as far as being an independent contractor? Here in AZ we are not considered employees but independent contractors, and the management can get away with just about anything they want.

I worked with a manager at my last club that had a rep for pushing girls around, grabbing them, and I even heard a story about him beating a girl up once. I just wrote all of it off to gossip until I saw him violently grab a girl by the back of her neck one night, and his violent nature was apparent to me then. I was in shock but all the other girls told me he does it all the time, but because we are independent contractors, there's nothing anyone can do about it.

If there's nothing you can do lawfully, I would DEFINITELY not return to that club. There is no reason any of us should have to put up with managers that do this kind of shit.

It doesn't sound like you have a case. Maybe liquor control was in the building, and your brief conversation was jeopardizing the entire business. The best way to handle your hustle in the future is to have a small item to hand to your potential customer (boa, glove, garter etc) and tell him to meet you in the "minors-only" area so you can retrieve the item and continue your hustle.

Are you in Oregon? I ask only because that is the case at many Oregon clubs. There is a huge sweep going on through the state right now, and strip clubs are the main target of liquor control. The economy is bad and the state budget is hurting, so the state is trying to gain revenue through fines. It sucks, but your manager may be under tremendous pressure to follow the exact letter of the law right now. If your club gets shut down because some anal-retentive government employee decided the 30 seconds you stopped to talk was "breaking the law", you and everyone else that works there will be unemployed.

This did happen at a club I was dancing at in 2000. The violation? A dancer spanked her own butt while on stage. The club was closed for 2 weeks and lost their liquor license for 3 months.

I don't have a bruise, but I do have a couple witnesses. The bar was full of customers, but I'm not counting them cause I have no idea who they are, and no way to contact them. A couple other dancers saw, if that helps any.
Yes, I'm in oregon. Olcc is definetly cracking down on minor rules, and I can understand the pressure my manager must be going through. It just pisses me off cause he gets away with this kind of shit all the time and nobody ever does anything about it. He has a horrible attitude toward dancers, and women in general.
We are independant contractors. But there have got to be laws protecting us just like if we were employees, right?
Paris, that sucks about your old club. Spanking your own butt while on stage? I've seen girls do way worse than that. Management at my club has always been so vague about what we can and can't do on stage.

    Thanks for the relpies, everyone!

^^Oregon is hard core about the minor dancer laws. Seriously, if you have small trinkets you can hand to potential VIP room customers, this is the best way to work around those laws. The customers then feel obligated to meet you in the minor's section of the club to return your item. That will get him into a place that you can work your hustle. Especially when you just come off the stage and have your hands full of your outfit, etc. Ask him to hold you water bottle or whatever, then tell him to meet in another area of the club.

I know of some really crappy mangers that have made the rounds of some of the clubs in Portland. You may be dealing with one of those guys. There is about 5-6 of them that just keep job hopping.

The butt spanking thing is no longer illegal thanks to a ruling in 2005. Unfortunately, that same ruling allowed the clubs to get a lot naughtier since then, too.

That's a really good idea about giving them some little thing. Of course I wouldn't give them something I would be too heartbroken to lose, cause you know some perverts are gonna steal it I have such a hard time gettingcustomers to come over and talk to me. I wish we had like a 'playpen' or something, we just have to stand INSIDE the dj booth which is in this dark little corner.

This kind of shit is one of my biggest frustration-inducing issues ever. These POS managers who take max advantage of their position and the lack of laws protecting dancers. There is NO reason he should have put his hands on you. If I were you I'd be so mad i'd never go back, but that's just me. I'm not trying to tell you what to do, but have you considered looking at other clubs? or maybe traveling to another state where the laws aren't so ridiculous? I'm not even sure if you want to do that, but I am curious...

And no, there are no laws protecting against it, in any state where you are an independent contractor. There's a reason that the scumbag at my last club has been there for 17 years roughing girls up and has never been in trouble.
