    This week I was in an accident (on my birthday). I was riding my bike in the bike lane on the right side of the road; the driver was making a turn, didn't see me, and hit me and my bike. My bike's totaled, but overall I'm alright except for roadburn, mostly along the right side of my body. It's painful and not pretty, so I'm not going to dance until it heals.

    Can I get financial compensation for the income I'm losing? The driver has insurance and is the only one at fault. After the accident the police and fire department came, wrote a report, and gave me his information on a card. I'm not sure how things like this work, or if being an independent contractor as opposed to a full time employee will affect things. I don't really expect the insurance company to make up for everything I would have made dancing, but every little bit helps. I'd love any advice anyone here can offer. I'm calling the driver's insurance company on Monday.

    ^^^ the answer is a big fat 'maybe'. The first issue will be proving to some court just exactly how much income you are losing. If you can produce prior year tax returns showing that you averaged $1000 a week in reported income or whatever, then you've got half a chance. However, if you have been 'flying under the radar' in regard to reporting (and paying taxes on) your independent contractor earnings, then the court is not likely to take your claim seriously.

    The 'proof of income' situation you will face in court is essentially the same 'proof of income' situation that every independent contractor now faces when applying for loans, when credit ratings are calculated etc.

    Thanks. I've been dancing for less than a year and haven't payed taxes on my income, so things look grim.

    I was in a car accident that required me to be off work for several months. I beleive the insurance co. payed me about 50% of what my tax returns for the past few yrs showed I made dancing. WIthout those returns that will prove your income, like Melonie said... your screwed. Another reason you should pay your taxes.
    I must point out that its not to late to do the right thing and file for last yr. You will probably recoup any taxes due with the insurance money you get for being off work, and will be setting the table for a awsome yr.

    If I were you I'd make a couple of phone calls which will cost you nothing but a few minutes of your time. First call the insurance company and ask them how to submit a claim. Tell them what happened and how you want to file a claim with them directly instead of consulting an attorney. You may or may not get anywhere with them. I imagine they'll try to overburden you with forms and procedures. I'd say go for it, because you won't be any worse off if they deny the claim. If you feel like you're getting nowhere or stonewalled, call a lawyer. Find one that will work on contingency and who offers a free consultation. They may or may not be interested. Again, nothing ventured, nothing gained.

    Do you have any records through the club? Cash-outs, tip-out records, etc. that would give a ballpark of what you usually earn? For example, I'd be fortunate in this situation because Deja Vu could print out a total earnings report for the entire year if I needed it.... back home, my bosses could dig up paper records of my 10% tip-outs, too.

    This may work. My club started taking $5 from us for every lapdance, so they keep track of those. Shows are always written down, although not the amount we're tipped. I'll get in touch with the club. Hopefully they save their records.

    My parents don't know I dance and are handling part of the insurance situation, so there's another complication. If I can't keep this discreet I'll just forfeit the money.

    Setting up a meeting with student legal aid and reading about taxes. I'll let you know how it turns out.

    mentioning student legal aid implies that you are currently a college student ? If so, keep in mind that applications filed by your parents for student grant / loan money must be based on 'household' income ... which technically must include your dancing income. Therefore going on 'public record' as HAVING dancing income by attempting to claim lost income benefits in court as the result of this accident potentially represents another 'Pandora's Box' i.e. the 'household' income your parents reported to the gov't may be false, (some portion of) student aid money you received may have been granted based on that false info ...

    Then there is this, if your parents are still claiming you on there taxes as a "dependent" which is often the case in the case of "full time students" the fact that you dancing and by doing that make to much money for you to be able to be claimed as anyones dependent means that they will first of all find out you have been dancing the extreme hard way and as a bonus are going to be oweing the IRS those back taxes

    I decided I'm not going to try to get any stripper money. The potential drawbacks sound way worse than any small amount of I'd stand to gain. I never intended to go to court over this.

    I don't have any student aid, grant, or loan money paying for college. I'm not listed as a dependent; even before I starting stripping my income was too high to qualify.

    If you were injured, make sure you ask for compensation for pain and suffering.

    First, get a lawyer. The good ones work on a contingency, so they have every reason to maximize your recovery.

    Second, do not take the insurance company's first offer, it is always way too low.

    Third, the driver was at fault, the law says you must be made whole, that means pay your medical bills, pay for rehab, pay for prescriptions, lost income, pain and suffering and lost future income. A good lawyer will figure that out for you.
