    Default I've Been Ripped Off $3000 by my Boss

    HELP

    I started a new day job where I was happy (just 3 people working there) for all of 4 days until the manager switched when my license was tranferred over to him and became obsessively micro managing and daily verbally abused beyond belief..

    After a month of this I left. He was very friendly about it. He told me to come back with my W9 to get paid for (total around $3000 commision). I tried to contact him twice and he ignored my calls so after sending him an email letting him know I was bringing the W9 and asking to pick up my check I took the W9 to his office.

    He wasn't there but his assistant was who screamed at me to get out and never come back.
    Half an hour later the manager calls and starts screaming

    "YOU F*ING WHORE, YOU BITCH, I'M NOT F*ING PAYING YOU ANYTHING YOU C***, YOU F*ING PIECE OF SH*T"

    He wouldn't stop screaming so I told him I'd see him in court and hung up Then he sent me an email saying if I contacted him again he'd take out a restraining order on me!!!

    I sent him one back asking how he would do that when I was doing exactly what he'd asked me to do - bring him the w9. I don't know what happened. The day I left he was totally fine.

    I haven't been able to work at another day job since (2 months now) because he's ruined my confidence.
    My ex club regular says that if I take this to court I have no chance of winning anything so not to waste my time and to just let it go and forget the money.

    I don't know what to do to get my money back. I don't know how to start. I'm afraid also that if he mentions that I was a stripper in court they'll dismiss my case immediately and say I'm a liar.

    What kind of deals did you do? Do you have the contact information for those clients, and would they be able to verify that you did a deal with them?

    Do you still have all the e-mails that were sent to you? Get your phone records to show that you called them like you said, but also to show that you did not harrass the office.

    Get an attorney. Call the attorney general and call the better business bureau.

    OK thank you. I didn't know about the better business bureau. I saved all of the emails and when the cell phone bill comes I'll definitely keep it for the civil court case. I also have the contact details (and copies of their applicaitons) of the clients.
    Thank you. I'm building up evidence as we speak.

    Yet another reason to dump the corporate world and run screaming back to stripping. Sigh.

    Your regular is wrong, you need to contact a lawyer. If you provided services than you are owed wages. In the U.S. it isn't even legal to volunteer to work at a company that isn't registered as a 501(c)3. This is by way of saying that even if this boss tried saying that you volunteered to work, the court would require him to pay you. Just go see an attorney and they will get you fixed up.

    I had a really hard time once when I tried to hire an lawyer, as soon as I said I was a dancer they declined. They said my creditbility was no good. I hope times have changed, good luck.

    $3,000 is a small claims court thing. It's pretty easy to file a small claim (by yourself, an attorney would cost too much), contact your local court on what to do and how to do it. Get records of everything and write everything down you can remember. You could probably find some info online about how to file, if not let me know and I can email you something.

    ^^ I agree about small claims court. Proof in small claims court is relaxed and without lawyers. But you still have to have documentation and probably witnesses. If you have that or a similar conversation where he calls you dirty names, take that along.

    When collecting a debt, I don't think a court order of protection is going to happen. Possibly you could preempt that by getting one on him. If it is needed, you'll hire an action server to deliver your summons to him. (probably about $50)

    Now if this were much greater than say 5-10,000 an attorney probably is a good idea.

    If the day job company does not know about your dancing job, do not bring it up. Do not mention it in court so you cannot be questioned about it. (For example, I once made the mistake of saying in traffic court that 'I had a clean license' but the prosecutor had evidence to prove otherwise, once I opened the topic for discussion.) If they bring it up, object that it is irrelevant. They may back down when you file, but get good legal help and prepare for court. Good luck.
