    Cliffs: Do not confess to breaking a law, i.e., speeding. Doing so waives your 5th amendment right.

    You are entitled to due process.

    You have the right to refuse a search. How NOT to waive this right.

    Always be polite and courteous. You have nothing to win and everything to lose by talking back.

    You can verbally refuse consent to search by a police officer but never physically resist. Even touching a police officer is assault.

    Shut up. You are not required to answer police questions without the assistance of a lawyer. The job of the police is to arrest and convict you. Police are not your friends.

    If you think an officer has violated your rights, file a police misconduct report immediately afterwards.

    The home is entitled to maximum protection from police searches and seizures. Police can't search your house unless you allow them without a search warrant. Allowing an officer to enter your home gives them consent to search. Step outside to talk to the police.

    You do NOT have to answer all questions asked by the police, but do not lie.

    Exceptions to "consent to search" are airport security, entering private property (events), etc.

    3 lines to rehearse:
    1. Officer, I do not consent to any searches.
    2. Officer, am I free to go?
    3. Officer, I have nothing to say until I am represented by a lawyer.

    Question...

    I've heard the, they can't search your car without permission, but i also heard that they CAN search without permission if they have suspicion, like a smell. Is this true?

    Also, is there a law against verbal abuse from a police officer. One night I was driving home from work and their was a cop car blocking the road i was on. i stopped the car and rolled down my window to ask him if i should just u-turn or what not, but before i got a word out he yells, "turn around ass hole!" I was just kinda in shock and was like, excuse me, why am i an ass hole? which he then starts walking up to my car and calls me a bitch, dumbass, and asks if i wanted to get arrested. we exchanged a few fuck yous, i called him a pussy for abusing his power and sped off before he got to my car.

    i then called the police station to file a complaint. the sergeant or whatever tells me that the consequence would be him receiving a "stern talk", but that i should just know that the police officer was working a long double shift and was probably tired. This was all around 4 am after i too worked a double shift of grinding cock while his ass was tired of driving around the beat and yelling at little girls.

    Is it okay for police officers to talk to regular civilians like that for no reason? I was a little mad that nothing was going to happen to him and that his superior really tried to excuse the cop by saying he was tired. Like are you serious? It's a REALLY scaring feeling when the law is attacking you.

    ^This will help answer your question. If you do not consent to a search of your vehicle there are very few times they can search anyway without a warrant.

    We had a discussion about this a couple of months ago.

    Here a little preventative foresight would have helped -- don't carry paraphenalia or pot in your car. People get stopped in cars all the time for sometimes very flimsy reasons, like a driving light is burnt out or you forgot to signal a turn out of a parking lot.
    I loved going to strip clubs; I actually made some friends there. Now things are different for the clubs and for me. As a result I am not as happy.

    Customers are not entitled to grope, disrespect, or rob strippers. This is their job, not their hobby, and they all need income. Clubs are not just some erotic show for guys to view while drinking.

    NOTE: anything I post here, outside of a direct quote, is my opinion only, which I am entitled to. Take it for what you estimate it is worth.

    FYI just because you don't give officers consent to search doesn't mean they can't call in k9 unit to to do a sniff-around. If they hit, we can get in based on that. The citizen's demeanor, behavior, level of officer's suspicion, and all that is in plain view plays a factor in the decision to pursue a search of the vehicle. Yes, smelling an odor of marijuana in the vehicle can serve as probable cause to search the vehicle. There are new laws governing vehicle searches though. They're lengthy, but not very hard to understand. Also if you get arrested, or an officer tows your car, a vehicle inventory must be done prior to the tow to safeguard the department against lost belongings. HOWEVER if anything illegal is found during the inventory, you can be charged for it
