    Angry Has anyone else gotten hurt in your club?

    Last weekend I fell coming down the steps off the stage onto the floor and broke my leg pretty bad. Ended up that someone had spilled drinks on the steps and they didnt have any grip stuff on them anyways... needless to say I am outa work and wont be able to make any $$$ for who knows how many weeks and possibly facing surgery with no insurance. The club owner has refused to pay for anything saying I should have been more careful and that as a "contractor" he isnt liable... Has anyone else had anything happen like this or have any advise?

    He has insurance. If you got a lawywer you could probably get all your bills reinbursed as well as pay for time off, if you can prove your income. Its the same as falling on someones property of in a commercial place, they have insurance for this. You want be able to continue working there though if you go that route. Also I hope you werent drinking, they will use that againt you if you did present a case against them.

    He is liable, because it's his property. But as the last poster said, I hope you were not drinking. That may make a difference...Consult a lawyer.

    Thanks... Yeah thats what I had thought... And of course i had a few drinks. My main fear is that I would be blackballed and at 32 there arent alot of clubs that will give me good shifts. I still have a good body and all but I am just worried about coming back and having a spot. I dont know. This just sucks! I go thursday to an orthopedic dr to see what they say is going to happen. I guess that will help me make a decision too... thanks for the help

    Did you sign a contract to work there? Some clubs will put in the contract that they are not liable if you are injured on the job. If did sign on, check and see if that's in the contract.

    I didn't break anything, luckily... just hurt myself pretty bad.

    I broke my foot at my club whilst climbing the pole they put me on the door for a couple of weeks so i could rest it. three weeks later i was rushing to get to the stage, tripped over a chair and fell down the stairs i have a nice scar from that one and a week avter falling down the stairs on stage i tripped over my shoe and faceplanted the mirror. (both me and the mirror were fine)

    Yeah I didnt sign a contract or anything... I did talk to the owner and he said if I wanted I could work the door or sell cigs and make change and stuff like that if I wanted while I am in this cast... But still nothing on the medical bills...

    i think a broken leg etc is one of my worst nightmares in this business. One time i thought i broke my knee at work. I walked into the dressing room and i slipped on--of all the fucking things--a dryer sheet! I assume it fell out of someone's bag. I landed on one knee and twisted my ankle bad. I actually had to lay there in the floor for awhile before i let someone help me up. My knee started to turn purple instantly and swell up all crazy. I had to call a cab to get me and take me to the ER. Luckily it wasn't broken and i just missed a week. Other than that i've never had anything too serious asides from a broken toe (fat drunk guy stepped on me). Good luck to you, how long will you be in a cast?

    If your club is like most the ones I worked at, you signed a contract saying if you are injured then they aren't liable. If it was due to true negligence then maybe it is different.


    In the meantime, does your club offer any other positions? I know some clubs might give the dancers a position as hostess or house mom or somethig when they are pregnant or injured so they can continue to make money, you should see if your club offers anything like this.


    That really sucks though. I hope you feel better!

    I haven't been hurt at the club when I was dancing, but a girl, close friend, was drugged at the club and had to be taken to the hospital. Ambulence and all. I don't believe that the club did any kind of reimbursement towards her for how long she was out. She may or may not have looked into it. I agree with the others, consult a lawyer. Figure it out. That bites though, I'm sory that happened.

    I own a club. This is how it works. You have not signed an independent contractor agreement(are you sure?) Basically if you injure yourself inside a business you are entitled to compensation unless you have that signed agreement. If you don't have that signed agreement you can still sue, anyone can sue anyone for anything. So you were buzzed.....Its the same as a customer who is likely to be buzzed coming into the club or being in a club and falling down on a wet mopped floor or falling down on anything wet or not. I doubt there were signs on the stairs that said "wet." right? Please contact an attorney. The club does have insurance if it plans on being in business. They are probably trying to make you not sue by offering you another job. You will probably be blackballed but you have no contract. There is a million other clubs dont worry about it. It will be a learning experience for your club. You will be compensated. You don't really have to worry about your alcohol intake since they were the ones to provide you with the alcohol and then you injured yourself on their wet surface. Did they offer to take you to the hospital when you fell down? If not that also looks bad on their half. The club is at fault for not having you sign a contract and if you have a contract you can still sue. You really have nothing to lose. Club staff should be more carefull and make sure the work environment is safe for everyone(customers and contractors.)

    It depends on the state too. For example, if this happened in Indiana, you are covered by workers compensation and since the owner claims you are an IC, you get double damages!!!! Woo Hoo!!!!

    Call a lawyer pronto.

    I have been told that a such clauses in contracts are moot and not legally enforceable. I'm pretty sure you can still sue them. A lawyer would know for sure.

    If you just happened to fall during a dance than you probably wouldn't have a case, but since there was water on the stage and nobody from the club bothered to clean it (!)< I think you should definitely go after them. A broken leg sucks!
