    Default Injuries at work?

    Considering dancers aren't technically employed by clubs and are often only contracted to work for them, what happens if, say... you slip on stage and sprain or break your ankle, or you slip on a spilled drink on the floor or even on a table dance, or (I hope this is an UNLIKELY scenario) you're doing some extreme spins on the pole or ceiling wheel and it comes unbolted and you go flying off stage?

    Do dancers get workman's comp of sorts at all?

    That depends. In Indiana, wokers compensation is the exclusive remedy for a dancer injured on the job. If the club claims the dancer is an independent contractor and is thus not on their insurance, the Industrial Commission automatically awards double damages. You need to check your state's laws.

    If your state does not extend WC to dancers, then the ordinary rules of negligence apply. To recover, you would have to prove:
    1. a duty,
    2, a breach of the duty, and
    3. damages resulting from that breach.

    Ask a lawyer for each state you dance in what the rules are.

    If the pole came unbolted from the ceiling, couldn't you sue your employer for not providing a safe workplace?

    My club offers WC. So I'm sure some others do.

    At my club you sign a waiver when you are hired saying that you accept your status as independent contractor and that the club is not liable for any injuries etc. that happen on the job.

    Again, it depends. In states where workers compensation extends to dancers the is no right to sue an employer. In states where WC is not extended to dancers, then the general rules of negligence apply. In comp states, you don't have to prove negligence though, simply that you were injured at work.

    Nope, not at my club. We also sign a waiver stating the club is not responsible for any injuries. This is pretty standard for clubs to have girls sign waivers like this. Is it still possible to get money if the pole comes unbolted from the ceiling? I don't know, but probably not, and not without an excellent team of lawyers.

    Most strip clubs have the entertainers fill out a contract. In the contract normally there is a clause that they sign that says the club is not liable for injuries that the entertainer may recieve while working. This does not mean you can't sue the club though. Its kind of the same thing as say a customer comes in and uses the bathroom and falls down because it is wet and they hurt themselves. The customer can sue and so can the dancer. They are both on the same level as far as the law is concerned. Most clubs don't think the dancers are smart enough to do this though so alot of the times the work conditions are not good. Alot of dancers are smart though and I have read about cases where the dancers have gone after clubs. Here in Portland, a dancer has sued Cabaret One for having a hole in the stage where she caught her heel and fell off. I don't know if she won or not but im sure it caused the club a scare and they probly take care of the dancers a little better now.
