    Default Web Cam Content Ownership / Copyright

    While recently, ah, researching, Michelle 'Bombshell' McGee, I noticed the following terms on a web cam site that she briefly used:

    <snip>
    Please Note: We have re-activated Michelle's profile here due to all of the media attention regarding her affair with Jesse James (husband of Oscar-winning actress, Sandra Bullock).

    While we are aware that Michelle worked with a bikini site that used our webcam services (aka a white label), we are truly the only website that has the recorded video chats and chatlogs stemming from Michelle's adult webcam shows. We terminated our work with that bikini company several months ago due to their questionable business practices amongst many other things and we are no longer affiliated with them.

    Michelle only worked with our company and the other companies who used our white label for a few weeks last spring (2009). Michelle worked on our hardcore webcam site during that brief period.

    We have yet to decide our course of action with the content from the adult video chats and the chatlogs.

    If you wish to speak with us directly, please contact us at onhercam at gmail dot com.
    <snip>

    Is this typical? Does the site own everything that you do online? Be carefull out there!

    YES. Upon signing a model-release form, the cam-girl is in fact relinquishing her image to the terms of the site. It is very common for content sites and any cam site that will record its models to sell the content to the highest bidder. I can only hope that Michelle McGee has a good agent doing the foot-work out there to find people like these who are holding her content and negotiate a terms of sale that are in her best interest.

    You're right, women should be very careful of who they let own and distribute their image.

    She was a camgirl? WOW...

    That's pretty fucked up that they would reactivate her account (I'm assuming without her permission) Ugh that just sucks!

    I had a contract drawn up for NinaNin and as standard, the compny does own all images, however, we do not record our streams and we do not have any chat or communication between customers and girls that could come back to haunt you.

    I have seen other cam company contracts though, and they are really one sided in favor of the company. They are sometimes exclusive, which prevents the girl from earning money in other ways. They are also binding for a term, whereas NinaNin can be immediately terminated in writing by either party. You have to be careful out there.

    It's funny that Michelle McGee has had all the same job titles as me... even working in a tat studio and being a hairstylist. My boyfriend cracked up when he saw that on TV. He was like, look it's you!

    I personally hate how the media is smearing her, and getting into the personal lives of the famous in general. It's really shameful how our culture thrives on other people's scandal.

    Sooo, basically they are activating her account with intent to eventually sell her previously recorded shows? (I know it says they are undecided but why else would they?) What a mess... I don't think I will ever be working with that particular company.

    If she was an independent contractor she could probably fight this in court. Just because it's in their contract doesn't mean it's legal. However, if they were paying he outright than any content created during her employment would legally be the webcam company's.

    What a disaster...

    I definitely feel that the media is demonizing her for being an adult star, stripper, and model. As usual...

    And I suspect her previous employers might soon play into that and sell her out to the highest bidder.

    unfortunately, this now comes with the 'territory' when the legal 'producer' of your material is the web hosting company as the result of webcam models 'off-loading' Section 2257 responsibilities.
