    Default $650,000 settlement for being kicked in the face

    Oct. 15) -- A trip to the strip club turned into a trip to the bank for a Florida man who won a $650,000 settlement after an exotic dancer kicked him in the face.

    Michael Ireland received the out-of-court settlement after claiming he suffered permanent double vision when a dancer named "Suki" booted him in the eye at the Cheetah Club near West Palm Beach in 2008.

    Ireland's attorney said their client suffered a punctured eye socket and broken facial bones when the stripper kicked him in the face with a spiked high heel during a lap dance, according to NBCMiami.com.



    But according to MyFoxOrlando.com, Cheetah Club boss Rod Kimbrough said last year that the dancer in question is a "very nice, young small girl" who only kicked Ireland because she had been smacked first.

    "A patron violently slapped the young woman on her buttocks and she was walking around the top of the bar and I guess out of a natural response she turned around and kicked him," Kimbrough said.

    Ireland's attorney Lake Lytal says the settlement is well deserved.

    "When this case was first filed, many people criticized it simply because it occurred at a strip club," Lytal told the press. "But we feel the $650,000 settlement goes to show that this was a serious case with serious injuries."

    This isn't the first time a Florida man filed a lawsuit for injuries sustained at strip club. According to The Smoking Gun, Paul Shimkonis lost his 1998 case against a Clearwater club where he claimed he suffered whiplash when dancer Tawny Peaks struck him in the face with her breasts.

    ^ i think as a result, there could be more douchebags hitting girls so we'll retaliate and they can hit paydirt. a lot of clubs are already way too strict about letting girls protect themselves. usually the same ones that encourage extras. customer's always right.

    But I hope it mean they will be taking the abuse patrons give to dancers more seriously... since it affects the dancer's behavior. Sadly I don't feel like holding my breath..

    ^^^ actually, this is a bad precedent. As independent contractors, it is legally arguable that the DANCER be held responsible for at least some portion of these damages - as was the case with the lawsuit against former feature dancer Tawny Peaks !

    i've never kicked anyone in the face that didn't deserve it.

    it's really pathetic and says a lot about this backwards fucking society when a man can sexually assault a woman and walk away with over a half million dollars.

    i don't know why she doesn't get herself a good civil lawyer and countersue?

    this article actually is making me really upset. like, how can this judgement even be real life? dancers are not people and thus can not be assaulted? for $1, you have full reign of my body? and if i dare defend myself, if i dare react to someone violating my bodily autonomy, then i might get sued or prosecuted?

    i would say i'm sick of this industry, but it's not the fucking industry that's perpetuating this idea of dancers as less than human. god, this shit makes me absolutely sick. i wish only bad things on this man, the judge, and the jury involved.

    how you treat sex workers says a lot about your character, and anyone who thinks a dancer should not be permitted to defend herself against violent sexual deviants can kick rocks.

    these are the same people who regulate whether or not we have to cover our tits, or keep one leg on the ground at all times, or now perform "lewd" acts on stage, and they couldn't give less of a shit about our well-being. so tired of this holier than thou bullshit from people who couldn't give a damn whether we live or die.

    makes me absolutely irate.

    Didn't the customer hit her first for no reason what so ever? And wasn't she on stage when this guy physically assaulted her?

    I guess she would have been better off if she had simply walked off the stage after being physically assaulted by the customer and told a bouncer.

    A few years ago a regular at a club I was working at was getting a table dance from another dancer and she accidentally kicked him in the mouth and it chipped one of his front teeth. He did not sue the club or anything but I do not think he was happy paying the dentist to fix it.And he had to do some explaining to his wife about what happened. He still goes to the strip clubs all the time. Francinista

    Yeah there was a similar lawsuit against my club, but in our case the fiancee sued because he was marked up with a belt ( that the guys in his party asked for) and written on with a sharpie ( this is lolz really) I don't think it went anywhere. i mean if the guy lost an eye like in this case i can see it but then again those bachelors want and ask for the abuse. it was an accident obviously

    I'll be hated for this, but...

    Legally we don't get to respond like this. He should have been:

    A. promptly thrown out of the club B. arrested C. both

    Kicked in the face? Not really a proportionate response.

    Obviously we don't live in a perfect world, but when you go into the legal system that's typically what they try and consider.

    I still don't understand why the dancer/club didn't have the guy arrested when he filed the lawsuit.

    Actually, Tawny Peaks turned this ridiculous lawsuit situation into a career boost by moving the case to 'The People's Court' ... and thus garnering a bunch of free national publicity !

    Unfortunately, you are correct on this count.

    Actually, the only reason that this particular case 'migrated' into a lawsuit against the club is that the club first agreed to try and negotiate an insurance settlement. By agreeing to do that, the club essentially admitted that it bore at least some degree of liability for the incident. Had the club failed to agree to an insurance claim in the first place, it's a distinct possibility that, as a separate 'business entity', the dancer may have borne the liability instead.

    I dont usually kick customers but i do slap and knock drinks over.

    if a customer assaults me i should be able to assault them back. quid pro quo. Bouncers never throw them out anymore and arresting them is ludicrous-- if we started arresting every customer who spanked a stripper then SCs would be out of business.

    but a slap on the face is fair. and i cant disagree with a kick to the head either.

    This guy probably had that kick coming. The fact that he won that lawsuit is sad.

    i have to give the club props for standing behind the girl though.
    The best thing i have heard in a strip club to date:
    customer: we should get married right now! we should get a shotgun marriage!
    me: uhh... i think you are misunderstanding what a shotgun marriage means. A shotgun marriage means you knock me up and my daddy shows up at your door with a gun and forces you to marry me and raise the baby. You mean elope.
    customer: hmm... nah actually i will take the shotgun marriage. At least then we would be having sex.

    I agree with you Athena, I believe a slap is appropriate, but HOW hard you slap is what I question...
    I think the fact that the plantiff and the attorney were fully aware that lawsuit was frivolous and devoid of any merit.

    They HAD thrown him out...he managed to sneak BACK IN and hit the dancer in question

    Where was security? How did he get back in..get all the way to the bar and hit her..that had to take time. I believe he ordered another drink too so it wasnt like he ran in and hit her in a second. Where was security..oh wait..its Cheetah..security doesnt give a shit about dancers. Cheetah was where I was hit by a custie and security said "meh..he's buying drinks so whatever". Doesnt surprise me that she had to do it herself there.

    It may not have even been planned....she was on the bar, he grabbed her and slapped her hard. She may have just spun around in shock and kicked him.

    I've hit before...I've even broken bones. But believe me when I say it was WELL deserved and calling for a bouncer was NOT an option. It was that or get raped violently. And yes...I'm in South F (where this case happened) and getting raped at the club is always a possibility. Its bad here. Theres a reason why I'm now retired

    i think both dancers and customers need to reign in their behavior a bit. customers need to stop being total asses, and dancers need to stop acting like they can get away with everythgin under the sun and that getting very violently physical is the only way to deal with things.

    remember, self defense only counts as long as you only use equal/appropriate force to what was used on you/is needed to stop the situation.

    smack on ass does not equal kick in face.

    and i sayd this as a dancer who was drugged twice and technically raped once in a private room. aside from the regular sexual assaults in lapdances.
