    Ok, two big points here. First for BBWChanel:

    While you're correct that guys recording your videos is ALWAYS a danger, and happens, it is also true that you CAN demand they take the vids if you find them, and I have never actually seen anyone stealing videos from girls like THAT, and SELLING them. Because that IS a prisonable crime.

    I also want to point out just the huge difference between someone stealing your stuff (COMPLETELY out of your control in most cases) and signing away all rates for the rest or FOREVER on EVERYTHING including privates to a cam company to make PROFIT from, with absolutely NO recourse.

    Totally and completely different levels of scam there.


    And for Pushit:

    I agree, streamate IS exactly for stealing customers from...And I wanted to point out if you were making $105 per hour for YOU, you were actually making $300 per hour. Sucks eh?

    Yea, unfortunately the sad thing is- is that once your video is out there- it's out there. If your vid gets uploaded as a torrent- you're pretty much screwed as far as trying to get any legal recourse. Once it's out there- it's free for whomever to grab it, and keep it going. Maybe they won't be making any monetary gain- but it's still a video of you, doing your thing.

    If there was a way to get stream or any other site for that matter, to post a big, red, warning label across their site that said "WE WILL SELL THESE VIDEOS OF YOU THAT YOU ARE RECORDING AND YOU WILL NOT MAKE ANY GAIN FROM THEM" I bet a lot more girls would think twice about it.. but lots of companies use their legal jargen as a mask... Also, just because you sign a waiver, doesn't mean that the terms of the contract are legal. But the sex industry is unfortunately synonymous with thievery and liars.. always has and always will. Another problem is that not enough girls will get together and take action- our judicial system isn't exactly worried about 'us'. Sometimes you just get screwed.

    I have been camming for 2 yrs and the only time my stuff ever leaked was b/c of a mainstream site, indy is a way less chance of your content being stolen. period.

    The internet is so vast that it's very difficult to even know if your stuff has been leaked, or even guys have taken screen shots or vid and put them on other sites. Once they remove your name from it- it's almost impossible to find. Like I said before, with the torrent becoming more and more popular- if someone decides to upload it onto a torrent sharing site- it's a done deal. You never know what's out there and what's not out there.
    I remember a couple of girls from here being leaked on HGF (mainly black girls, but I have seen a couple others on there as well), but I've seen lots of girls from stream have their shows posted on there from users saying 'i was lucky enough to get this for free' and shit like that. Well, once it's stolen from that site, and then it's posted somewhere else, and somewhere else, and somewhere else. times 100. True, indie IS WAY less of a chance- but a chance nonetheless.

    Watermark ALL video. That removes MUCH of the negatives from the whole theft issue.

    Theft is a problem that is actually Not that big. In essence if you have a really hard time finding vids of yourself, the guys out there do as well, in the sense that these won't be sites with a million traffic. Also, you being naked for guys who have no clue who you are cannot be said to materially affect your income, since they are not customers who are watching your vids and not spending money on you. Most customers will not be happy with vids when they are cam-voyeurs, since cam-voyeurs get off on the LIVE nature of it all.

    On the other hand, the stuff you've signed over to a cam site is being sold and used by them for profit, also as promotion of their site and not you specifically, and therefore it IS money directly from your pocket.

    Stuff to think about.

    True, water marking is a help. But constantly being worried about your shows being sold is not going to help you. In the long run, if a guy is buying your show, and he knows who you are, eventually he's going to end up in a paid chat with you. It's the guys that are watching the free videos of us that we need to worry about. It's horrible that we don't get some of the money from those paid videos, but I doubt that it's generating a lot of money for them. I think the live part is what keeps the boat floating. But even if it is or isn't- we SHOULD have a cut. It just sucks- there's really not much we can do about it.. just hustle harder.

    BBWChanel, you're talking about a completely different issue. There will always be the problem of guys recording videos and posting them where you don't like. That's not what Bambalina is talking about. What Bambalina is saying is that Streamate can take your pictures and vidoes and resell them however they like. They can make a DVD and sell it in 7-Eleven and you can't do anything about it and you won't get paid for any of it.

    If a guy steals your video and makes a DVD of it, you can sue him and win damages. If Streamate makes a DVD you can't sue to have it removed and you don't get a share of any profits.

    Right now Streamate can make a website called bbwchanel.com and have all your videos for sale. You wouldn't be able to stop them and you wouldn't make any money for it.

    You can evaluate if that's a risk you want to take. However, it's not the same thing as some guy posting your video on a random forum.

    Yes, I did understand that- and addressed it as being a nuisance- however, I said above, that just because you agree to a contract- doesn't make the terms of said contract legal. You can sue for ANYTHING nowadays- it's just a matter of doing so. If streamate were to make a dvd with content that has US performers on it- the women in said video does have a right to sue, regardless of what the contract says. Whether you win or not- is another issue. If all women on said video came forward in a lawsuit- then the outcome may be more towards their favor.

    we signed the contract- everything falls on that agreement legally.

    Anything can be litigated... most of that has a loophole- for instance- in the streamate agreement it says you are allowing your 'moral rights' to be waived- and in some jurisdictions in the US, you are not allowed to waive your moral rights.

    But let me clear this up- I'm not trying to argue with anyone or make it seem as if I am for this company, or any company, that does this type of thing. It is WRONG. All I am saying- is that hope is not completely lost if streamate for some reason or another, or any site, decided to use the material on a physical DVD, or use your real name to identify you in any way to the public. You can fight it. I'm also not dignifying myself by remaining to use streamate as a form of income. I know what the possibilities are, and recognize that yes, they are scary.. but the possibilities of someone ripping you off in the sex industry is just phenomenally high. And it happens- a lot. It's a RISK that we TAKE. If you don't expect to fucked in this industry- then you are in the wrong business. You always have to take the bad with the good. And I hope for all of our sakes that the union thing works out, and ya'll can organize and beat these bastards. I'm in it to win it like everyone else.

    Catgirl, take the mortgage scam in the U.S. into consideration... Big banks made people sign long contracts they didn't understand, knowing that they wouldn't understand them. A lot of the contracts had terms within them that were not legal even if you agreed to them, which puts fault on the bank because they made you sign an agreement that is not legally valid. Just because you sign it, doesn't make it true - only if all of the terms within it are legal where you live. That's where litigation comes in.

    But seeing where Streamate's legal holes are can't be done until they're taken to court.

    Am I the only one wondering what PornLaw has to say about Streamate's contract? As a lawyer, I'm sure he can see the legal loopholes...for CA, at least.

    Here's the thing about contracts- they can, number one, be contested, there are also 'illegal' and 'abusive' contracts, which can also be argued in a court of law. There are LOTS and LOTS of ways to get out of a contract- and fight if you feel like you have been wronged. You can also explain that you weren't fully aware of the legalities of the contract when it was signed. There are so many different things that you could do, with the help of one very good lawyer. And if a site is taking your vids and turning them into physical dvds to be sold- well, that can be fought and won. The DVD may not be taken off the shelf- but you may be able to get monetary gain from it. Regardless, contracts are not 100% proof.

    This is very true. I do know of one former chathost from Ifriends who quit the site, who had her lawyer threaten to sue (and was fully prepared to go through with it) and I read a note from her that they did take her content down.

    Unfortunately a legal battle will cost big bucks sometimes.

    ^^ I know, it costs $1,500 just for a retainer for a good lawyer around me. But some lawyers will take the case and will accept payment only if you win. I wouldn't care if I just broke even in the end - it's the principal.
