Hardcore porn production is only legally protected in two states - California and New Hampshire. Everywhere else its dicey but most local authorities will not prosecute it but it has and continues to happen.
I had one client in the midwest that had his computers, cameras, lighting ect - all of it seized on the day he launched his site. He wasnt prosecuted but the police told him if he wanted his equipment back (about $20,000) he could come down to the police station and claim it. Well he never did and just got out of the business.
A more serious reality is that anyone producing porn outside CA and NH might not have valid model releases. You cannot contract for illegal activities. Therefore the model release might not be deemed to be legally valid by a court. Which means its possible that a model might be able to sue a producer for profits made from the content instead of just being limited to what she was paid for the shoot.
