    please dont tell me how stupid i am for what i did...i already know.

    last night i was at this guys house drinking a little. i blacked out very quickly and next thing i remember im on the freeway pulling over for a cop. my bra was off and my over shirt. i blew a .288 and got arrested for dui. i am 19, its my first one...i have a clean record, no tickets. i spent the whole night in jail and called the boy i was with and he said he took my clothes off in his bed and thought i wanted it, i said no got up and took off in my car. now i have a dui. whats going to happen? i live in nevada by the way....have you gotten a dui? im deeply ashamed in myself and totally stressed out. i need input and help

    Not sure if you would go to jail for a first offense, but you could possibly have your license suspended. Your best bet would be to talk to a lawyer with experience in handling drunk driving cases.

    You were drinking a little then blacked out? that doesn't sound normal, specially if you ended up in his bed.

    .288 is MAJORLY over the legal limit, like nearly 4x legal limit. And your underage which makes it even worse. But you say it's your first offense so you can probably get an ARD program which is probation with the chance to have your record eventually expunged resulting in no conviction. Depends on your state though and its laws.

    I'd suspect possibility of that guy putting something in your drink. But given that he was honest enough to admit that he tried to get you in bed but you turned him down, means either he's being honest and you drank way more than you remember, or he's downplaying the story big time and could be hiding something.

    Agreed. If you talk to a lawyer quickly and tell the police there's a possibility you were drugged, they can do a blood test and find out if there's anything in your system. Do it quickly, though; I'm not sure how long those sorts of drugs stay in your bloodstream. What do you have to lose? If nothing turns up, then nothing turns up. If something does turn up, though, it's a whole different story.

    A blood alcohol of 0.288 is quite sufficient to explain everything that happened to her, without needing to posit the existence of some other substance. She did write that she was only "drinking a little", but that sounds much more like minimization to me than anything else. The justice system doesn't want to see you showing up at age 35 or 40, heavily dependent on alcohol and with a chirrotic liver and a string of four or five DUIs, anymore than you or I do.

    Um, actually the story sounds like someone who was drugged. She should get tested if possible.

    Jules, you should talk to a lawyer, but don't lose your mind over it. First time DUIs are a misdemeanor almost everywhere and virtually nobody goes to jail over a first time DUI. You will probably lose your license for a period of time though.

    But, again, you should get a lawyer to help you through the process in order to help minimize fines and penalties.

    It's possible, of course. But her BAC was 0.288, which is quite high enough to cause unconsciousness all by itself (0.40 can cause death). If someone had drugged her with a respiratory depressant, such as GHB, on top of that, it probably would have been fatal.

    Oh goodness, a DUI at 19? My 70 year old grandmother, severe alcoholic, has served jail time for DUI's in the past. Mind you, it was after her 3rd or 4th offense. Go find yourself a lawyer.

    You made a very big mistake and you should be ashamed, but at least you didn't hurt anyone or yourself. You can get past this and move on. Hopefully you've learned your lesson. Don't drink so much dear, keep careful track of your alcohol consumption. If your a petite woman it's so easy to raise that BAC when you're having a good time.

    And find better friends. This guy sound like a bit of a dick. Trying to bone you while you're wasted and then letting you drive off.

    I'm not going to berate you too much - I've done things I severely regret in the past too. *hugs*

    Yes, but I knew someone who had a guy make her a drink that was drugged, and once the drug took effect he pushed numerous other drinks on her and got her into bed. The next day she literally only remember the one drink and suspected she'd been drugged, so she called the cops. She blew twice the legal limit and tested positive for GHB.

    Twice the legal limit is around 0.14 or 0.16 (depending on where you live). That isn't nearly enough to be fatal when combined with other substances in most cases (although it depends on the substance and the dose, or course). Even 10 mg of valium is dangerous with a BAC of 0.288.

    well i go into court tommorow and judge presents evidence and gives me a real court date. they did give me a blood test at the jail tho, along with brethalyzer. do u think they will look for other drugs such as ghb or just alcohol? i mean...i havent blacked out like that or for that period of time in a while if ever....

    dam...how will i ever get car insurance again?

    is there anyone out there that has gotten a dui?

    I'm pretty sure that most jurisdictions do a standard tox screen (which tests for several substances) on everyone who consents to it. It probably wouldn't include GHB, though.

    i also have 800 in overdraft fees on my old debit card iv been hiding from.....will they find that out to?

    Can you afford a lawyer? If not, when you go to court you should ask a judge to appoint one for you.

    Get a laywer and I would do another blood test to check whether other drugs were present. Do you remember getting in the car? You could have killed yourself, or someone. Dont hang out with idiots and drive like that. Most likely they take your liscense and your freedom of driving.

    Nevada DUI First Offense


    On a dui first offense, the consequences of a conviction of a DUI or a conviction of driving with an excessive BAC level can include, but is not limited to:
    • a Minimum of 2 days to a maximum of 6 months in jail, or with court approval at least 96 hours of community service.
    • a fine or fee of approximately $400 to $1200, plus additional fees and assessments.
    • a completion of an approved 8-hour DUI school or substance abuse program. This can be done online.
    • mandatory attendance at a drunk driving “Victim's Impact Panel”.
    • possibly requiring installation of "ignition interlock device" (IID) for 3 to 6 months.
    • if the blood-alcohol level is .18% or higher, submission to alcohol abuse assessment.
    • a suspension of your driver's license for 90 days (reinstatement requires payment of fees, passing tests and submission of an SR-22 proof of insurance form). It is, however, possible to request a restricted license permitting driving to and from work or in the course of employment once the first 45 days of the suspension has passed.

    as of now...before court....i breath test mon-fri and 2 aa meetings a week. then i have to pay 30 and do a victims awareness class.

    then court next month-150 for dui school, no license 3 months, community service, and huge fine. not too mention finding a new insurance and sky high rates....probably have to do counceling too. ugh

    And this is exactly why I'm glad that I don't drink.
    That really sucks... use it as a learning experience, I guess. Sorry to hear about what happened.
