    Default Petition: Tell the FBI to expand their definition of rape

    Each year, the FBI fails to count hundreds of thousands of rapes in its Uniform Crime Report (UCR)—even missing many rapes that are reported to police. That’s because for over 80 years, the FBI has been using the same fundamentally flawed definition of “forcible” rape: “The carnal knowledge of a female forcibly and against her will” to track rape statistics in the UCR.

    This excludes rapes involving forced anal sex and/or oral sex, vaginal or anal fisting, rape with an object (even if serious injuries result), rapes of men and transgender people and other injurious and degrading sexual assaults. Also, because the definition includes the word “forcibly,” police departments often interpret the rule (against UCR guidelines) as leaving out rapes of women with physical or mental disabilities and those who were unconscious or under the influence of drugs and alcohol.

    A recent Ms. investigation revealed that the archaic definition plays a key role in the vast underreporting of rape in the U.S.:

    · The FBI’s 2007 Uniform Crime Report listed 91,874 “forcible rapes”, but some estimates suggest the actual number may be 24 times higher.

    · Police departments go to great lengths to look good on the UCR, the FBI’s comprehensive national crime report by which all U.S. police departments are judged, and federal funding is determined. Often this means interpreting “forcible rape” even more narrowly than the FBI does when classifying sexual crimes.

    · Police departments across the country, notably Baltimore and Philadelphia, have been found to be juking the stats—coding legitimate rape cases as “unfounded” in order to make it appear that rape numbers have declined.

    Without an accurate definition, we won't have accurate statistics about rape, and without accurate statistics, we will never have adequate funding for law enforcement to solve these crimes. A change in the definition of rape would lead to better law enforcement response and could thus reduce dramatically the incidence of rape.

    It’s high time for a change. For rape survivors, a modern definition of rape at the federal level would acknowledge, once and for all, that rape is rape—and that the stories and experiences of all rape survivors count.

    Make sure that all rapes are counted. Sign this petition to tell FBI Director Robert Mueller and Attorney General Eric Holder to update the overly narrow, outdated “forcible rape” definition.

    I agree with this. I was orally raped and I consider it being raped.

    I think it's good to cover all the bases. That way, there isn't a chance an alleged rapist gets off on a technicality.

    I hate that--
    I remember reading one magazine article that because the woman asked her rapist to wear a condom so she limited her exposure to std's/pregnancy, that that was consent and the rapist was declared "innocent."

    I signed this.. had no idea the idea of rape was so vague- I am disgusted. I have had someone slip something into my drink before. I hope this helps a little.

    Seriously, how many women report rapes as some sort of joke or revenge? ... I am certain that it is rare and I think more women DON'T report it ... the process of the reporting itself is awful... and any incidence where a woman lies about it, is probably a lot more rare than the growing incidences of autism occuring in children within days of a vaccine shot that the FDA claims is rare.

    And if you are a dancer or in the adult industry, most people just think sexual assault or harrassment is acceptable and sometimes we do just accept it. One time, I was dancing for a guy at a club and this dude sitting at another table just reaches over and grabs my cooch! I slapped his hand away. I went about 5 tables down and danced for another guy and that same dude walked by while I was dancing and literally grabbed my cooch again and ran off to the bathroom. Then on his way back, he did it a 3rd time. I did not even bother telling management, which I should have because that club was very good about backing up the girls ... I just snapped and chased him down and was getting ready to punch him (he was a small guy and I was about 8 inches taller than him with my platforms) luckily, the gm came over and pulled me away before I beat the living crap out of him. But, seriously, if I were to have reported that, I seriously doubt the cops would've really done anything about the fact that I was sexually assaulted. Although, in retrospect, I wish'd I'd given it a shot, because I would like to have seen what they would really do, because I am really just making a probable assumption.

    Ugh, or the story about the man in Italy who was acquitted of rape because the jury agreed that the skinny jeans the woman was wearing were too tight to remove by herself.

    UPDATE (I got this in my inbox this morning):

    This is big. For the past 80 years, the FBI has used an extremely narrow definition of rape that led to massive underreporting of rape and insufficient federal funding for police departments to fight violence against women.

    But after months of sustained pressure, including 140,000 messages sent via Change.org, Director Robert Mueller announced this week that he gave final approval for the FBI to update its official definition of rape!

    That means you moved the FBI. And that’s not an easy thing to do.

    Director Mueller’s decision is the most recent proof that when people band together to make change, no institution is immovable.

    The e-mail didn't say anything about the new definition, but it's included in an article about it in the Huffington Post:


    The new definition, which excludes the word forcible, defines rape as: "penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim."
