I always wondered that too. If her name is spelled differently then I think its fair game. Not sure if she would get in trouble. I always wonder that with porn spoof videos. For example, there is a porn spoof off Sarah Palin and even though names are spelled differently, I'm surprised they're aloud to even do that. Especially her being a politician and all..
I think it is the same thing as SNL or other parody shows, once you are in the spotlight you are fair game to make fun of.

I like Jersey Shore and all...but who really cares - the real JWoww has just posed for a few magazines....and got her on tanning line. I am pretty sure she could care less about people trying to be here when she is basically a household name for Italians already....

She could only get into issues if she were claiming to be the actual person, and that person brought some kind of action against the "fake".
