    Default Deduction claims

    So the only way I can use this site is on my phone and for whatever reason it wont let me use the search so I apologize if this question has been asked before and I'm assuming it has but When. You file your taxes what do you put for your deductions? Outfits, shoes, makeup, waxing, tanning, etc....? Thanks in advance!

    From the official IRS viewpoint, any business expense tax deductions that fail the 'housewife test' can be challenged. Or put another way, if housewives spend money on department store makeup or lingerie or gym memberships or tanning sessions with absolutely no business reason for doing so, the IRS can contend that a dancer / webcam girl attempting to take business expense tax deductions for spending money on the very same things did so for 'personal' reasons not business reasons and thus the deductions should be denied !!!!

    On the flip side, another part of the IRS code refers to business expenses that are 'ordinary and necessary' ... which directly conflicts with the 'housewife test' doctrine. So lots of girls 'split' the percentage of business use versus personal use, and write off 50% of such deductions that fail the 'housewife test'. However, items that pass the 'housewife test' i.e. are clearly 100% business related with no use in 'normal life' situations ... like 6" heels and dancing outfits ... are 100% tax deductible.

    As to plastic surgery, the US congress specifically ruled that ALL plastic surgeries are for personal benefit and, as such, cannot be deducted as a business expense. However, there is one exception as the result of a court dispute between the IRS and a feature dancer ( stage name Chesty Love ). Based on her point that having huge breast implants constituted a 'problem' during normal life activities, thus getting huge breast implants was only of benefit to her business, the court conceded that 'professional sized' breast implants are 100% deductible as a business expense. However their definition of 'professional sized' is more than 1000cc ( each implant ).

    As to business travel, the IRS defines travel between home and a club / webcam studio as a 'commute' ... which is NOT tax deductible. Legitimate business travel expenses must either involve travel between one business and another business ( i.e. the clubowner sends you across town to work at a sister club ), or sufficient distance to warrant an overnight stay ( i.e. 'road trip' ). Travel expense deductions were the recent focus of IRS audits, and those being audited were typically required to show hotel receipts to go along with any travel related business expense tax deductions.

    Please note that these are IRS rules pertaining to American girls. Tax laws in other countries may be different.

    Any expense that is ordinary or necessary for the business is deductible. My first question on any expense is, who paid? If the expense was paid from the business account, it's probably a business expense although further investigation is often called for. Second question, does the taxpayer have one for personal use and one for business? If so, then the business one is generally deductible.

    Here's an example. Taxpayer has a prepaid "smart phone" that costs $150/month. She claims she uses it in her stripping business to send texts and pictures to customers, book shows at different clubs, keep track of her schedule, and of course, random web surfing. She also has a bare bones VZW contract phone with a minimal rate plan that she says she uses for call to friends and family. She pays the prepaid phone out of her dancing account, most of the time, but sometimes out of her personal account and sometimes her boyfriend pays. I say the "smart phone" acquisition cost and operating costs are all ordinary and necessary and thus deductible on her Schedule C.

    When I did my own Schedule C, on Part V, I had several categories:
    a. Telephone
    b. Theatrical Makeup (The IRS will disallow makeup, but specifically allows theatrical makeup. Helps to speak the language.
    c. Costumes (The IRS allows costumes as ordinary and necessary. Again, it helps to speak the language.)
    d. Training (here I put dance classes, and gym membership)

    Schedule C has other specific lines, I put most of them to some use. Although, I did not deduct anything for a "home office." For what I would have taken, it's just not worth the time spent fighting the service. So, I definitely overpaid on my taxes. As Mel says, commuting is not an ordinary or necessary expense. But, travel to an out of town club is. So, when I drove to Louisville from Indianapolis to dance, I would put down those miles as business miles. I also deducted motels when I was away from home.
