    Thumbs up UK ladies- a little funny but true fact on expenses!

    just been watching this weeks QI and it was announced that there is a tax loopwhole on self employed people.

    basically if you are a brand (and i guess we are!) we can claim for the image of that brand ie we have to look pretty so can techniquelly claim for things like teeth whitening, make up, hair straighteners and other things that would go with your brand image

    i found this quite amusing and thought that if that is the case then why not add those to your expense claims.

    wonder if i or anyone else is going to try this......................................

    I was denied cosmetic enhancement , HMRC wrote to tell me it was all things I would be otherwise paying for , self employed or not ..... I don't know if I truly agree, but what I do know is , they're the last group of people I argue with :-)

    but if they themselves are denying you something that you can actually claim then you have a right to take it to the complaints board. and we do know what the government is like.

    the whole thing came about as al murray stated that a guy claimed for horses on his expense and they had to allow it as it was part of his brand image.

    As discussed in many Dollar Den threads, the US IRS is actually in conflict with itself in regard to many 'business expenses'.

    One IRS rule says that business expenses that are 'ordinary and necessary' for the operation of said business are allowable business expense tax deductions. Where exotic dancers, camgirls, etc. are concerned, the case can arguably be made that hair / nail / tanning salons, health clubs, makeup, lingerie etc. are an 'ordinary and necessary' business expense.

    But another IRS rule says that anything that an ordinary housewife would spend money on, with absolutely no business reason for doing so, is NOT an allowable business expense tax deduction. Obviously lots of housewives patronize hair / nail / tanning salons, health clubs, buy makeup, buy lingerie etc. ... which provide 'personal' benefits to said housewives. Thus these expenses fail the IRS 'Housewife Test'.

    In the final analysis, whether or not these types of business expenses will come down to the decision of an IRS auditor or Tax Court judge. However, in an attempt to avoid unwanted IRS attention, many exotic dancers will attempt to claim only 50% of the amount as a business expense tax deduction that fails the 'Housewife Test' ... using the argument that the business benefits versus personal benefits resulting from these expenditures are shared.

    There are also a number of specific laws / rulings that affect potential business expense tax deductions. For example the US congress has passed laws which state that ALL cosmetic surgery procedures are 100% for personal benefit, and as such not deductible as a business expense. There is one subsequent exception 'the Chesty Love letter ruling', where a feature dancer successfully convinced a US Tax Judge that having huge breast implants was in fact a negative attribute in her personal life, that the purpose was 100% business related, and that the associated costs should be allowed as legitimate business expense tax deductions. The judge agreed that 'professional sized' breast implants are a legitimate tax deduction. But meeting the 'professional sized' criteria means implants over 1000cc ( each ).

    There is also a similar ruling regarding the 100% deductibility of theatrical makeup. However, this must be purchased from a theatrical supplier not a department store.

    Where 'costumes' are concerned, the precedent has generally held that anything that can't be worn in public, and anything that wouldn't be worn by a typical housewife in her bedroom, qualifies as a legitimate business expense tax deduction. Like the theatrical makeup, lingerie from a professional supplier will probably qualify, while lingerie from a department store will probably be questioned.

    And while I'm certainly not a tax specialist or an attorney, it strikes me that 'brands' technically require legal registration ... i.e. registered trademarks, registered corporations etc. I would highly doubt that a self-employed non-incorporated camgirl or exotic dancer would legally qualify as her own 'brand' ... and thus would lack official standing to even attempt making the 'brand' argument regarding business expense tax deductions.

    Obviously, tax laws and details in different countries are different. But many of the underlying principles are the same.

    I'd sooner shit in my hands and clap , than start drawing attention to myself with HMRC . I don't think denying me tooth whitening is such a sin

    If your laptops for work , that's completely different , and of course you may put it down as expense , there's no blurry area with things like that .....Naturally I claim my laptop .... I believe you're not allowed to claim your ISP if it's the only ISP in your house, because most families have one anyway , we have two , therefor the tax office let me claim for the 'work' one .

    HAHAHAHA @ Katies tits well I think your tits are easily more worthy than the Duck house a certain politician claimed for , mentioning no names, ahem , Sir Peter Viggers , not to mention the PORN claimed for by the husband of Jacqui Smith, while she advocated anti porn legislation.     and if you would rather sit in the background with hmrc then it does suggest you have something to hide. like with the whole put your receipts in a bin bag and give it a good shake then hand it to them to sort it out means that them sorting it all out and most likely wont find a discrepency anywhere and beleive your next set of paperwork. ( yes the tax man asks for proof of expenses but doesnt state they have to be neat and tidy and in order!)

    melonie- you register your 'brand' when you sign up to the sites and the content that you sell is (hopefully!) watermarked so that is your brand, and yes as we are all unique we are our own unique brand anyway so yes you could techniqually say you are a registered brand.

    Malika - You are wrong . I pay my taxed, I don't sit in the background . However taking them to 'complaints ' for not being able to claim tooth whitening is a whole other bag , and not something you should encourage girls ( my friends ) to do ....

    HMRC doesn't ask to see proof of expenses, only that you keep them , hell , they don't even ask you explain each expense

    ( I'm wondering if you've filed before ? because you would know you don't send off any receipt under normal circumstances)

    They will ONLY expect a break down of expenses if you are investigated----- At which point , I'll let you take it to complaints and I know who I'll be placing my odds on !!!! There is a BIG difference between, lurking in the tax shadows - and running off to complaints.
