    I know very little on the legal side about all of this, but I know it all needs to get done properly if you're building a name for yourself. (Especially 2257's - if you don't want to end up in jail. )

    So I figured I'd open this up and anyone who knows anything can chime in.

    Its mostly a lot of legal paperwork you have to fill out & stupid fees they charge just because they can. I would suggest setting up your business as a LLC so if your business (cam name) ever gets sued and you lose, your business is affected but not you as a person. It takes the legal liability off you. I would suggest the LLC be a completely random name & then you fill out DBA forms as your cam name. But its mostly legality & paperwork. I would consult a lawyer or purchase/borrow a couple books on small businesses.

    As for the adult industry, I think the only thing that differentiates it from another small business is the 2257 compliance, and not doing anything illegal (in general, as well in in your country, state, county, and city).

    P.S. You can also purchase things in the name of your LLC. Although I believe everything has to be in cash. Its better to purchase a car in the name of a random LLC you created and pay for it in cash... The liability comes off of you as an entity.

    To provide some perspective, I used to operate an independent adult website / webcam in conjunction with a handful of other 'huge boob' girls. The advent of Section 2257 prompted my decision to shut down the adult website and to 'transfer' my independent webcam operations to established webcam host sites. Being a 'website owner' involves some fairly significant personal liabilities under Section 2257, which an LLC or corporation cannot protect you from.

    I'll also expand on some of the reasons that I opted to shut down my independent adult website and webcam rather than risk Section 2257 issues ...

    - where a 'website owner' is concerned, Section 2257 grants 'inspection' authority to any authorized person for the purpose of physically inspecting Section 2257 records. In the case of a 'home address based' website, this essentially amounts to granting the right for 'warrantless searches' of your home. And of course, if the 'inspector' notices anything illegal in your home, even if it is totally unrelated to Section 2257, it will be reported and prosecuted.

    - While it is technically possible to list every single picture and/or pre-recorded video that is posted on your website, and to create a Section 2257 file containing the required name / age / ID information for every model / actor appearing in each of those pictures and/or pre-recorded videos, it's technically IMPOSSIBLE to do so for a live webcam video stream which is being newly created minute by minute. According to my attorney, this makes any file based attempt to make a webcam stream fully comply with the technical requirements of Section 2257 deficient at best and unacceptable at worst. Again according to my attorney, the only sure fire method of totally complying with the technical requirements of Section 2257 where a live video stream is concerned is to post the models' / actors' real names, real addresses, real ages and other ID on the same webcam page. For better or worse, so far no Section 2257 prosecution has raised this issue of live video streams in court to create a ruling / interpretation of how 'acceptable' Section 2257 compliance can actually be achieved versus the technically 'impossible' requirements stated in the existing law.

    - Non-compliance with Section 2257 can result in a Federal Felony 'sex crime' charge. If accused, bogusly or otherwise, the legal fees to mount a defense in federal court will be on the order of $10,000 . If found guilty, bogusly or otherwise, besides the potential for a lengthy jail sentence there are also the secondary effects of a Federal Felony 'sex crime' charge / conviction ... which could mean having to report your whereabouts to local police for the rest of your life, which could involve having to inform your neighbors that you are a 'sex offender', etc. And obviously any straight job employer who picks up on a Federal Felony 'sex crime' charge in the record of a would-be straight job applicant is highly likely to allow that application to be 'lost'.

    While the Section 2257 compliance requirements for live video streams are still unresolved, at least camgirls who are utilizing webcam host sites have the webcam host site 'owners' as the primary target of any future Section 2257 enforcement efforts. But once you become the website 'owner' yourself instead of being just a 'subcontractor' on a website owned by someone else, you become a primary target.

    I'm opening up an LLC in Delaware because of the tax breaks, annual fees, and what not. I'm getting a FEDEX mailbox in Delaware. You can open up an LLC anywhere in the states.

    Nevada and Oregon are tax-free (state) so that's why a lot of people opt for those.

    Nevada it is! Since I need it for dance anyways lol. Its only $200 =) and tax free! Do I need to go to another place to get an LLC and is that an extra fee?
